I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my dispute.
After Mr. [redacted] inspected my properties I submitted insurance claims for roof damage for 4 of them.After insurance adjusters inspections, Mr. [redacted] and I met and negotiated the best way to repair theproperties to insure each property was damage free.This included fence repair, gutters, chimney removal, and several other items- a list of which I kept.Mr. [redacted]'s invoices were over $39,000 and included $2000+ "out of pocket" chargesThis represents a significant investment for me - both in cost and in real estate appreciationSince the complaint concerns 4221 [redacted] Drive, I will refer to items pertaining only to that property.[redacted] RESPONSE--- Regarding Mr. [redacted]'s "free repairs", his invoice and contract show an "out of pocket" charge of$2000.That's my pocket that paid $2000.That is not free.The $2000 was for expenses over and above the insurance settlement of$37,000+---1 sent text pictures of the damage to the soffit and gutters to Mr. [redacted]It was necessary to do so several times before he replied on May 17, 2016 at 12:06 PM.In that text he says" .... take some tools back and get it a little better and I'll cover the whole n the soffit w apiece of flashing for u. Prolly won't get to it till next week tho ... ".On June 7, 2016 at 9:21AM he sent me a text saying" ..... ur on my list I'll try to get u done this week. Allthe rain just put me so far behind I'm trying to get caught up".Mr. [redacted]'s Message from Business says he "notified Mrs. [redacted] to this conclusion" (not to do the repairs).He never notified me he would not do the repairs. Never.May 17th and June 7th he was going to do the repairs and then no more messages.I have already submitted both texts in their entirety and they indicate Mr. [redacted]'s willingness to make therepairs- what he was going to do, how he was going to do it and when he was going to do it.--- I asked my agent, Tom [redacted], to contact Mr. [redacted] because after saying he would do the repairs, Mr[redacted] was not answering my messages and I hoped he would answer Mr. [redacted].Mr. [redacted] said has not heard from Mr. [redacted] regarding [redacted] in his 9/25 email to me.---1 contacted Mr. Michael [redacted], adjuster for American Modern Insurance who inspected the propertyReason:1) I wanted to know if the insurance company covered the $2000 out of pocket expenseIf it was covered, how did I file an amendment for the extra costBefore he could make that determination Mr. [redacted] needed to check with Mr. [redacted] to get the details.He contacted Mr. [redacted] twice.Mr. [redacted] has not responded. (I can submit a 9/26 email from Mr. [redacted] to verify)2) I wanted to know if the soffit and gutters were covered by the insurance.Again, if they were covered, could an amendment be filed.3) I wanted to know if the mold was present during the insurance inspection.Reason:If there was mold, could the damage be added to the insurance claim.Ifthere wasn't any mold when inspected and there is mold now, the cause could be something covered bythe warranty.Mr. [redacted] informed me that the report said "no interior damage".He suggested various reasons for the moisture causing the mold including improper seal, flat roof transition,replacement issues, etc.He suggested I use a third party contractor to receive a reliable report.--- Regarding my "numerous messages", Mr. [redacted] says he was "on vacation during the majority of them"My records show that I sent 41 texts between June 7 and September 14That is 15 weeks - almost four months - no replyThat is 41 texts plus my telephone calls plus Mr. [redacted]'s messages plus Mr. [redacted]'s calls - no replyNo response from June ? until I contacted the Revdex.com---The warranty is for a year on workmanshipThat gives me 52 weeks to make a claimMr. [redacted] will not make an inspection to investigate the ceiling mold.I have no idea as to the cause, magnitude or duration of the problem.And it is a problem I cannot ignoreRESOLUTION:Fix/repair soffitFix/repair/replace guttersDetermine cause of mold and repairI have a small business renting and maintaining properties. I am not a contractor. I am dependent on thehonesty and skill of the people I employ. I depended on Mr. [redacted] to make me aware of all the repairs neededon the property and to make them. Seriously, can you see a 69 year old grandmother with a hip replacementgoing on a roof to check out the damage? I wouldn't know what I was looking at.I gave Mr. [redacted] the benefit of the doubt that he had missed the repairs by accident.Who would do $39,000+ in repairs and neglect to include everything that needed fixing?[redacted]

In regards to Mrs. [redacted] complaint, none of the repairs she has indicated in her complaint have anything to do with the work we performed, nor are we under any contractual agreement to make any additional repairs to any of her properties. Her first contact with me in regards to these damages was...

almost three months after we fulfilled all of our contractual agreements with her. When she contacted me, I went to the property, inspected the areas, determined they were not as a result of anything we did, and notified Mrs. [redacted] to this conclusion.   The gutter damages are a result of her tenant backing a moving truck into it, the soffit damage is caused by settling and the roof over the patio where the leak is was not replaced by us, as it was not damaged by the storm and as such not covered under the Insurance claim and not included in my contract, or my warranty.   I sent Mrs. [redacted] a message last week to let her know I would take care of these repairs but that there would be a fee for these repairs, as I could not afford to do any more free work for her. She has not responded to that offer. I suspect because she is only wanting me to perform these repairs for free.    I performed numerous free repairs for her after my contractual obligation was completed and she has continued to get me to do more free repairs. I am a small company and am unable to spend anymore of my time and resources without being compensated for them.   In regards to her numerous messages to me, I was on vacation during the majority of them and when I returned I contacted Mr. [redacted] in regards to one of his properties, but he made no reference to Mrs. [redacted] at that time nor since.   In conclusion, I will gladly make any necessary repairs to this property but there will have to be reasonable fees applied.   Sincerely, [redacted], Owner MD Restoration Inc.
