[redacted] *** [redacted] *** [redacted] *** [redacted] October 28, 2014 On Friday evening October 17th 2014 [redacted] dropped off his [redacted] after hours at Meadow Creek Tire & Service. He filled out the after... hours work order and handed the paperwork through the front window to the closing Manager at about 5.50pm. On Saturday 10/18/14 a work order was generated at 8.15 am and the alignment technician was given the work order to perform the alignment around 8.30 am, following normal shop procedure prior to performing alignments the vehicle is road tested to identify for any abnormal conditions such as pulling to the right or left and to check if the steering wheel is centered. When the technician drove onto the entry ramp on 170 to return to the shop a slight vibration became evident and he immediately slowed down to try and identify the problem, while pulling to the side of the road at approximately 25 mph the left front wheel detached from the car. The technician called me at 8.58am on his cell phone and I advised him to make sure he was in a safe area and we would come to his assistance as soon as possible, I arrived with my leading tire tech with jack and extra lug nuts at about 9.20, inspected the wheel lug studs and car for damage and it appeared to have only minor scratches to the wheel and no other apparent wheel damage. After careful inspection of the suspension we decided it was safe to install the wheel and drive the car back to the shop. All other lug nuts were checked and found to be below manufacturers required torque specification so all wheels were re torqued to 90 ft lbs. My tire technician rode with me and followed the car back to the shop at 30mph and observed no visual driveability problems. On arrival at the shop we put the car on the alignment rack to take measurements and make sure there was no further damage then completed the alignment so Mr [redacted] would be able to drive his car safely. I called Mr [redacted] and advised him of the situation. He did admit to replacing his tie rods and doing all the work himself including installing his wheels in the parking lot, I asked him what he had torqued the wheels on with and what they were torqued to and he replied that he did not have a torque wrench but thought he had tightened them correctly. Mr [redacted] filed a report with the Frisco Police Department and Officer [redacted] came down and wrote a report, we made a rack available for Officer [redacted] if he wanted to do a full inspection of the vehicle. Officer [redacted] suggested he contact his insurance company. Copy of the report is attached. On Monday morning October 20th at 8.20am an insurance report was filed with [redacted] Insurance by Eric and the report # [redacted] was then assigned to [redacted] @ [redacted] na.com. After a full investigation was completed by *** insurance, the investigator determine that the air spring failed from age and wear and tearWe have the air spring in our possession and our certified technician is in total agreement.

The copy of the repair order from *** also states the other side air spring also shows normal
wear and tear and is about to fail*** suggested to the customer to replace the passanger side, but the customer declined the repairsI have spoken to MrJim *** from ***, in Broomfield, CO, and he assured me we did nothing to cause this failure as both air springs are worn out; furthermore this is the life expectancy of an air spring on a BMW X5.
Since we attempted to assist on diagnosis of the problem and the customer told us in no uncertain
manner that we were not to touch his car, we tried in good faith to resolve his situation; however, we do not feel any responsibility for damages to the customer's BMW X5.

Many attempts have been made to satisfy Mr*** concern with his vibrationMr. *** Toyota was road tested by myself and our
front desk service writer, and no obvious balance problems were detected in this truckStudded snow tires will normally provide a slightly harsher ride than all season tires, especially after coming out of storage and being remounted back on the truck in Winter, after two seasons of useSlight uneven wear of the tire can provide ride disturbance, but will generally go away as the tire is used on the car againThese tires would normally not be adjusted for a ride complaint after two seasons useMany attempts were made to satisfy Mr***, but it seems we were unsuccessful His expectations for a smooth ride with studded tires may be too high. These tires were submitted to Nokiian Tyre for a special adjustment and a replacement set of new tires were sourced from a dealer in Portland Oregon, thus causing a delay. *** Tyre and Meadow Creek Tire have gone above and beyond to satisfy Mr. *** complaint and feel he has been fairly treatedSome of the delay in time would be due to many companies being closed over the Christmas/New Year holidaysMr. *** received and accepted new replacement tires on 2/19/and I believe Mr. *** has been very fairly compensated.
