We had temporarily been instructed by our franchisor that we could no longer service the NYC territory but the misunderstanding has subsequently been resolved We've been authorized by the franchisor to proceed with this customer's installation I will be reaching out to her today to schedule the installation

[redacted] 's complaint is filled with misleading information:We did not "demand payment up front" as he claims As is customary on most construction or home improvement projects and, as we do with every job we sell, we took a 50% deposit at the time that [redacted] signed the contract Then, upon delivery of the materials, we asked for and received 40% payment as had been agreed when she signed the contract If [redacted] had a problem with either one of those policies, the time to express his reservations would have been before he or his wife signed the contract agreeing to both of those payments It is not in our DNA to "demand" anything from our customers We asked for, and as [redacted] had previously agreed, received a 40% payment upon delivery leaving a 10% open balance for the customer to hold back as protection for them that we would fulfill our responsibilities under the terms of the contract The part that [redacted] leaves out of his complaint is that he then, illegally, put a stop payment on that check and it bounced We did not, as [redacted] claims, willfully leave the material in a pile in his garage More accurately, [redacted] stopped our installers from proceeding with the installation and then instructed them to leave Further, he attempted to steal their tools and refused to give the tools back to the installers We only received our tools back after visiting [redacted] 's house with the Suffolk County Police.I think the email thread that was exchanged between [redacted] and our Sales Manager, Sue, speaks for itself We were in contact multiple times with [redacted] prior to the scheduled inspection and you'll see that Sue first warned him that she wouldn't come to his house if he continued to hold our tools hostage and then notified [redacted] eight hours prior to the scheduled time that she would not be coming In fact, [redacted] had taken a very aggressive approach with our installers as well as in the tone and context of his conversations and emails with Sue and she felt threatened by him and his actions As an employer, I would never knowingly ask one of my employees to meet with someone who had exhibited such hostility Here's the email thread that indicates the level of professionalism with which we dealt with Mrand [redacted] (please follow it from the bottom up): [redacted] [redacted] [redacted] [redacted] [redacted] [redacted] [redacted] [redacted]

The business' response is, unsurprisingly, full of distortions that I would like to refuteFirst of all, regarding payment, I did give them a 50% deposit and understood that an additional 40% was due upon deliveryHowever, upon arriving at my house, this 40% payment was demanded BEFORE the materials were unloaded from the truckHad I been able to inspect the delivery, I would not have given them a checkI did put a stop payment on the check because as soon as I pointed out the damage, the immediate response I got was "NO REFUNDS." This made me feel as though my only recourse was to place a stop payment on the check.The pile of material in my garage was left because yes, I did tell the installers to stop working as soon as I saw the damageHowever, Closets by Design has left the pile sitting there and refused to come get it. The tools were left by the installers; I did not, by any means, attempt to "steal" themI did hold them as an incentive for Sue to come meet me at my house to discuss the situation with the damaged materials, as I had a feeling that she would avoid doing soMy suspicion proved correct, as she has not, as of this writing, made any attempt to meet me at my house as promisedI did return the tools to the installer once I realized that they were not the property of Closets by Design; the assertion that the police were involved is completely falseIf anything, I should have called the police on the installer, as he came to my house, unannounced, and very aggressively demanded that my underage daughters let him in to retrieve his tools while my wife and I were outThey were terrified by the experience, and I can't believe Closets by Design would employ someone who would harass minors in this fashion.I find it very interesting that their response to my complaint doesn't mention the root of the complaint a single time: the fact that they delivered shoddy, damaged materials to my house and refused to give me a refund or any kind of resolution to the situationI have attempted to upload pictures documenting the damage, but the interface does not appear to be workingHowever, I made a video documenting the issues, which can be seen at the following link:***Thank you

I believe that *** *** is confusing us not responding to him with us not giving him an answer that he wants to hear We have been in touch with him many times throughout the process but he appears to be unwilling to allow us to come complete the job per the terms of the contract that we mutually entered into We're ready, willing and able to come finish the job as soon as he'll allow us

 We have been very consistent and responsive in communicating with CBD team and offered sufficient time and opportunity for them to deliver the product as defined in the contract.The last email sent to Sue O'B[redacted] on August [redacted] has not been responded to.  Losing all hopes, we have engaged with another vendor who since then delivered the product to our full satisfaction.Sue has contacted us again on 9/**, which is 8 weeks since our last inquiry, and offered to re-attempt the installation of the product.  Obviously after waiting for so long and having another vendor to install the closets, there is no way for us to satisfy CBD team's request.
