Dear Ms. [redacted]: Please receive this correspondence as our
reply to the above captioned complaint. The $62.25 additional billing incurred
from our rental contract is correct. Contrary to Mr. [redacted]' complaint, we do
advertise the possibility of a cus[redacted]er incurring additional charges...

for
excessive use both in the rental contract he signed at the time of the rental
(copy attached) and clearly on our website (screenshots of appropriate pages
attached). I note in Mr. [redacted]' complaint that he let the equipment he rented
accumulate runtime hours while he was discussing various matters with "his
cus[redacted]er''. This indicates to me that he is in business and was using the
rented equipment in the course of his business. As a businessman he should be more
aware than the average homeowner of the particulars of equipment rental
transactions. Our "excessive use" policy follows the industry norm.
We decline refunding the additional charge as it was not the result of
misinformation. Sincerely, [redacted]

Dear Ms. [redacted],
My complaint against Mechanicsville Rental Center is based on their advertising policy of advertising daily, weekly, monthly rental fees in big bold numbers/letters on their website only to redefine in their own terms what a daily, weekly, monthly length of time is in fine print on "page2" of their website and reverse side of the contract. I find this policy misleading and untrustworthy and just shy of being a "bait and switch" and entrapment.  Hopefully this complaint will establish new policy within the company where the cus[redacted]er/consumer will be verbally informed of what Mechanicsville Rental defines what a day, week or month is to them.
Mr. [redacted] erred in assuming I own a business. I am an unemployed military veteran that performed a task for an elderly gentleman I've known for years that was unable to do the job himself. My use of cus[redacted]er was solely based on the lack of a better term. With the multiple training I've had in anger management, both the military and as management in the civilian world, the only time someone "should" be aware of something is when they are verbally told and shown. Written terms are for documentation purposes and verbal reinforces the terms so there is no misunderstanding. The only other equipment I've ever rented was a car years ago for a day- 24 hours and the terms of mileage usage was clearly stated and verbally spoken at the time of pickup.
If you will also note on the contract endorsed by me, on the top right corner under the company's phone number and website address, there are spaces for date and time out and a few spaces below is a space for date and time in. The difference in time is <12 hours. This became an issue for me the day I rented the equipment. I attempted to contact an associate upon completion of my use of the equipment only to be forwarded to voice mail. I left a message and rushed to have the equipment back before the time expired and I would be charged an additional day. Just as I was about to unload the equipment at the Rental center I received a return call to be informed that I had an additional 12+ hours before I would have to have it back. This was verbal information, while helpful, it was too late as I had already refueled the equipment and cleaned it as the norm for rental policies. I was going to include this information in my initial complaint. For brevity reasons I excluded it and only bring it to your attention to show that the companies contract is flawed and their failure to assimilate information causes consumers/cus[redacted]ers to be misinformed.
I hope this clarifies my point of view on the rental policies of Mechanicsville Rental Center.
Regards,

Review: Contacted rental company to purchase 2 attachments for a skid steer they only had 1 in stock and I was asked to come in and do paperwork. Drove to office and sale person said he could not get a price for the second attachment until the next day. He said if we would pay for the 1st attachment that he would hold the processing until we decided on the 2nd attachment. I decided not to purchase anything and cancelled. I was charged an processing fee of $184.Desired Settlement: $184 refund

Business

Response:

Our customer prepaid for an order he placed using a credit card. The next day he called us to say that he changed his mind and wanted to cancel the order. We advised him during that call that he would incur a cancellation fee, which he acknowledged. We immediately refunded his credit card the entire amount less the fee. We actually charged him much less than our posted restocking / special order fee, which is posted in plain view in the area of the store in which the transaction took place (photo of notice is attached). The $184.00 fee is correct and was acknowledged by the customer during his phone conversation with our salesman [redacted].

Response:

I have reviewed the offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

9/17/2013 [redacted] called Mechanicsville Rental Center talked to [redacted] wanting a purchase price for two items for a skid steer. [redacted] gave [redacted] a purchase price, while on the telephone, on one of the items and advised [redacted] to come into the office and do paperwork and [redacted] would call and have the price on the 2nd item when [redacted] gets to the office. My wife and I went to the office of the Rental Center and [redacted] said he could not reach the salesperson to get the price on the second item he would have the price the next day. [redacted] ran our credit card and assured us that nothing would be ordered or charged until he could get the price on the second item and we made a decision on what we would be ordering.

9/18/2013 [redacted] called [redacted] to cancel the order. [redacted] said there would be a fee charged for the amount the credit card company charges the Rental Center. That would be the only charge. I did not understand why there was any charges because [redacted] had explain there would be no charges or orders placed until we made a decision on what we would be ordering.

9/19/2013 the bank statement showed that Mechanicsville Rental Center had charged $184 fee for what [redacted] said was the fee the credit card company charges for processing but that he had nothing to do with billing. [redacted] said he would have the billing person telephone [redacted] to explain the charges. I receive no call from billing. [redacted] complained to [redacted] concerning the credit card fee being excessive and [redacted] said they had to charge for the initial charge and for putting it back on the credit card.

I did not return anything because I did not take anything home. Restocking fee would not apply.

Regards,

Response:

Spoke with a [redacted] of the business over the phone. The restocking/special order fee is a **% fee charged to an order that is cancelled and refunded. It is a fee that is stated out in the open on a large bulletin board. The fee charged to this customer was less that the normal **%.

Review: I rented a piece of equipment on 11/21/2015 (contract # [redacted]). They advertise a rental fee of $249.00 (plus taxes etc, etc.) "per day" which to me is 24 hours. No one explained nor is there any wording in their advertising/contract that was explained to me that a "day" is only 8 hours. During the course of use at my cus[redacted]ers house, him and I discussed this, that, and the other numerous times at which time I only would put the machine at idle. Had I known that the hour meter determined usage I would have turned the machine off.

Upon receiving my final bill I found an additional charge of $62.25. I spoke with an associate on Monday, 11/30/2015 and we discussed the issue. I informed him of no one informing me of the hour usage. I explained to him I did notice the hour meter but assumed that was for maintenance purposes. He informed me that he would have [redacted], an owner, call the next day. That was 3 days ago. I feel as if I'm getting the run-around. I have not returned a call as I have been busy with other issues.

I feel that the company was obligated to inform me of hour usage and did not provide full disclosure in the contract, verbally, or in their advertising. There was no owner available to resolve this issue when I contacted them, they advertise misleading and or incorrect information and I find it very unprofessional for them to do so. All of which is found on the company's web-site under "About Us".Desired Settlement: Refund based on misinformation of $62.25
