I am rejecting the business response made by *** *** on behalf of Mecum Auction. First of all my boat was delivered to Mecum Auction, at the time the boat was
delivered and given to a Mecum representative on 1/24/ My boat at that time did not have no more than hours on it. My boat was auctioned and sold to *** ***/
*** *** on 1/24/Mr*** did inspect the boat prior to purchasing the boat via the winning bid. I purchased the boat the prior year for $45,000. I was told the boat
Valued at $75,and I dropped the reserved at $32,to sell the boat because we didn't want to endanger others by attempting to learn how to maneuver a boat of
That size and speed. I was contacted originally by *** *** of the Mecum Auction Resolution Department concerning the sale of my boat to Mr, ***. *** *** stated to
Me that Mr, *** briefly powered up the engines on the boat and I stated to him that those engines should never be powered up unless the boat was in water. In respect
to the hours stated on the contract, at the time of registration the Mecum employee(name *** ) listed all information from the prior years information (because she remembered
Me from the prior year when I Initially purchased the boat) but she did ask the current years hours and I stated to her its either or no more than (I also
explained to her why the boat was only taken out once and for a short period of time and I also had the batteries charged prior to bringing the boat to Mecum)
so I told her that I would go out to the boat and get the exact hours and she stated that wasn't necessary she would list the hours at approximately hours. I felt at ease taking her
suggestion regarding the hours because of her experience working at Mecum.
The Facts are as stated:
1. I did not agree to any relocation of the new owner's boat to a storage facility and I will not assume responsibility for any charges. *** *** acted out of his own
free will.
2. At the time my boat was given to the Mecum representative on January 24, the engine hours on my boat was approxto hours (on both engines). For it to be reported that
one engine had hours and the other one had that is totally obscured
Regarding statement five (5) on the response given by *** *** ( February 24, on behalf of Mecum Auction)
I did not misrepresent any information and I am not aware of any "AS IS " clause. I will forward a copy of the contract that I signed
My boat was sold to *** *** /Jackson Motors and I was given a check in the amount of $28,(after Mecum sellers fee was deducted), there was a stop payment
issued by Mecum. I feel that Mecum overstepped their boundary and they took a personal interest in the above mentioned transaction. I not only feel violated, but I also
feel like I've been scammed
I registered vehicles that were auctioned at Mecum. All of my vehicles were listed in excellent conditionAs stated on the Auction Listing Contract and also that could be viewed
as such on Mecum's website.

We are replying to your request to resolve a consumer complaint from the above person.
1. [redacted] signed and agreed to the Auction's Listing Contract (copy of signed document
attached).
2. [redacted] entered into a legal binding contract to sen his 1999 Eliminator Eagle 34'...

(VIN#[redacted]) and agreed to the tenns of the Action Selling Contract.
3. On the Auction Listing Contract that was signed by [redacted] he listed: "160 hours on
engine".
4. Upon further inspection shortly after the auction by the Buyer it was determined that the
engine actual hours were mimpresented since one engine bad 169.8 hours and the other
had 173.3 hours. It should be noted that when [redacted] bought the boat at our 2013
Kissbnmee Florida auction (lot #[redacted] January) 8, 2013) the engine hours listed were
160 hours.
S. As outlined in the Auction Sel1ing Contract. Fraud or Misrepresentation by the Seller can
supersede "As-Is" in a court of law. A seUer may remain liable far issues with the vehicle
because of misrepresentation or hud.
6. Since the actual engine hours where in excess of what was advertised by [redacted] the
Buyer no longer wanted the boat and the sale was voided.
7. [redacted]'s suggation that the engines were started "without being in water" and resulted
in the additional hours being registeted on the engine hour meters is unlikely since water
is required to cool the engines and neither engine could have been run without any
coolant "water'" for that many hours.
8. We contacted [redacted] at approximately SPM on January 26'" to infonn him that the sale
was voided becaU.ge the engine bours were misNpresented and asked that he remove the
boat for the Osceola Heritage Pat'k property.
9. After numerous attempts to contact [redacted] the Operations Manager at Osceola Heritage
Park demanded that the boat be removed from the grounds and a transport company was
contracted to move the boat to a local storage facUity.

10. [redacted] was contacted by our office and made aware that the boat was moved on
FebruSIY 13"'.
11. According to the Auction Selling Contract the Seller ([redacted]) is responsible for not only
the transportation costs to move the boat but also the storage fees that have accrued since
Febl1laJy 13th when it was moved to a storage facility.
