Further to your correspondence to me of September 25, 2017, at the outset I apologize for not getting back to you sooner however it longer than anticipated to prepare a response. Regarding [redacted] claim that I left the job without...

finishing because they were unhappy with painting and finishing I offer the following comments.
I observed and note that one or both of the clients were present for all of the renovations, and it is my opinion that communication between myself and [redacted] ongoing, and as changes, or items of concern came up, they were addressed accordingly.
I was contacted by [redacted] who were interested in hiring me to do renovations. I first met with them on August 3, 2017, to discuss the particulars of the renovations. Our meeting lasted for approximately 2 hours. Following our meeting I prepared a Proposal which outlined the details of the renovations that I would complete, a copy of which is attached hereto.
Regarding the bathtub, the Proposal outlines that the existing tub was to be reinstalled if possible at a cost of $[redacted], and if a new install was required there would be an additional cost for the shower stall. Upon further discussion with the clients [redacted] explained that when she first had the tub installed the contractor she hired at that time told her installation of a one-piece install could not be done. When I told her it could be done she told me that is what she wanted. It was understood and agreed upon that a new one-piece tub and surround would be installed.
On or about August 8, 2017, [redacted] came to my home and we sat at my kitchen table and discussed the renovations again. We went through my home looking at flooring materials, and paint colors. During the tour of my home I showed them the one-piece shower stall which is located on the second floor of my home. I indicated to them that I was very confident I could get a one-piece shower stall in their bathroom as well. They agreed they would like to have that done. That meeting/visit lasted approximately 4 hours. I reviewed the Proposal with [redacted] who verbally accepted the terms contained therein, and I began renovations on August 29, 2017. The Proposal outlined 12 items. The first 11 items were with respect to repairs and the cost for same. The 12th item on the Proposal addressed the matter of additional work.
On August 25, 2017, a new one-piece unit was purchased. On August 29, 2017, the one-piece tub was delivered to Mr. and [redacted] home and placed inside their carport. Late in the afternoon of August 30, 2017, [redacted] was home with her son, [redacted], as we brought the new shower stall into their living room. We placed it on floor protection in front of their living room picture window. We even removed some cardboard so she could see inside the unit. She was very pleased with her new unit and commented, 'This is what I (she) wanted in the first place.' On August 31, 2017, the old tub was removed. The new shower stall was set in place and the plumbing reconnected. [redacted] was home for all of this. Shortly thereafter, [redacted] returned home. She and [redacted] expressed that they were very pleased to see the unit in place. We told them they could bathe that evening however, they could not shower due to not having a shower rod or curtain.
The following day [redacted] and I met at [redacted], We spoke to [redacted], an employee of [redacted], and discussed ordering a new shade for their kitchen light. We also picked up a shower rod (which I paid for) for [redacted] new shower, and to date [redacted] has not been invoiced for it. As such, I am confident that the bathtub renovation was completed as outlined in the Proposal and agreed upon by the clients.
Regarding damage to the bathroom sink, I am unaware of any damages, and this is the first I am hearing of it. I would like an opportunity to review [redacted] photographs of the damages to the sink and compare them to the photograph that I have which shows no signs of damage,
Regarding painting, when it was agreed that I would paint I advised [redacted] that I happened to have paint with me. She saw the color I had and agreed to it being used saying, "That's fine." She was present when paint was applied to the walls, however, the following day she contacted me and advised me that the wrong color was applied. When I arrived at her home I was advised by [redacted] that she had been scraping at the walls. Upon inspection I could see the paint had been scratched off of several places. [redacted] further advised me that she has O.C.D. (Obsessive Compulsive Disorder) which according to her, "kicked in" and made her start picking at the wall until the paint was removed. In addition to scratching the paint with her fingernails she advised me that she also used a putty knife and continued digging at the walls. Upon further inspection I could see there was also damage to the walls in the bathroom and hallway.
There was some problem with crackfill up high on two walls which I recrackfilled immediately. I also crackfilled the areas of damage caused by [redacted] 'picking,' some of which were at the far end of the hall where I had only painted. I note that some of the walls did not require crackfilling prior to painting by Lyons Estates Inc., but did require crackfilling after [redacted] had picked at them. (They were not billed for any of the time spent to recrackfill touch ups.) I also offered to repaint. [redacted] advised me not to worry about it because she was going to repaint the bathroom and hall anyway as she still could not stop picking at the walls. [redacted] further reiterated this point on an occasion when she found a gallon of paint under the bathroom sink which according to her, she forgot was there. She told me that she and her husband would repaint at a later time. As such, it was my understanding that any issues with respect to painting were resolved. However, at this point I felt I had cause for concern with respect to how further work done by my company would be picked at as a result of [redacted] disorder that would require me to re-do completed renovations.
Having said that, I did not complain about the extra work that was being created, as I feel I handled each situation as it arose professionally and courteously. For example, there was an occasion when the clients chose wrong paint color for a touch up which took time to sort out. We attempted three times to color-match touch-up painting in the kitchen using paint supplied by [redacted]. The first color I noticed was different when we were prepping the paint roller (even though I was told it was the correct color). I then dabbed the wall with the brush proving it a different color. When it was agreed that the color did not match I had an employee retrieve a new brush, roller, and tray to apply the second color which also was not correct. However, the third color was the correct color and we applied it to the walls completing this task.
Regarding the mosaic tile installed in the bathroom, it comes prefabricated, and it was installed properly as can be seen in the attached photograph. Regarding the paint being caked and running between the tiles, as she said she was going to repaint the room herself (as was mentioned previously) I advised [redacted] the paint would come off easily using a putty knife similar to the one she used on her walls. As for the paint running between the tiles, once the grouting is complete any paint lines will not be seen.
Regarding the cupboards, the original hardware was larger than the new hardware which made the finished area dissimilar. Also, there was a tarnish residue which bled through the semi-gloss paint, which I supplied to [redacted] but did not bill her for. In addition, I left some of this paint in a container (which she provided) as she said she would finish it at a later date.
I have been in this business for over 29 years and I have learned that serving the public requires a level of intuitiveness, tact, and decorum. After spending a short time with [redacted] it became evident to me that they were having personal issues and those issues had on occasion interfered with the productivity of my employees. Mrs. & [redacted] personal life choices of swearing, raising their voices at each other, and crying was increasing in frequency, and although they were in the basement for most of these occasions, or outside, I felt they were still in way too close a proximity to my employees and me for this behaviour.
My employees were concerned for [redacted] on more than one occasion and wished to intervene. I told my employees it was not our place as they were a married couple and we were guests in their home. I felt it best to finish our job as outlined in the Proposal and leave. However, on one such occasion, on or about September 8, 2017, after what was, in my opinion, a particularly emotionally heated exchange between [redacted] I felt it prudent to address the matter with [redacted] as I wanted to get a sense other discernment of the situation. On that occasion she was getting ready to go shopping in Maine, USA, and she was doing her hair. I spoke briefly with her outside of her bedroom (which is adjacent to the bathroom), and I asked her, 'What was that all about?" She replied, "It's just the way it is." I told her she did not have to put up with that (the behaviour [redacted] was exhibiting earlier). I got the impression there was someone behind me. It happened to be [redacted] and quickly changed the topic of discussion. There appeared to be no safety concern, and shortly thereafter my employees and I left for the day.
On another occasion when they were having their discussions, I noticed their 5 year old son, [redacted], unattended on the road. That particular road (Route 107) is a major trucking route. This was not the first time I noticed their son on or near the road even with his parents present. On this particular occasion I quickly walked toward [redacted] as I asked him to please get off of the road, and explained to him this was very dangerous, and to please never go near the road again, even if the dogs were near or on the road. I told him he should get his mommy or daddy to get the dogs for him.
On the morning of September 9, 2017, at 11:30 a.m. [redacted] were showing me all the pick marks in the bathroom walls from [redacted] picking/O.C.D. [redacted] was standing to my left, [redacted] was to my right, and I was in front of the bathroom sink. On that occasion [redacted] laughed and said to me, "You know what she does for a living, right?' to which I replied, "No, actually I don't know what she does for a living." He said, [redacted]." To which I replied, "Oh." [redacted] said, 'Do you have anything to say to that'?" I replied, 'Good for you. I can do this all week long, it doesn't matter to me,' It was after this exchange, and in addition to the exposure to their marital conflict, that I felt it in the best interests of myself, my company, and my employees to complete the terms of the contract between [redacted], and Lyons Estates Inc. and to not take on any further tasks. As such, shortly thereafter, I advised them that Lyons Estates Inc. was not interested in grouting their bathroom tiles or taking any other extra projects. (I felt they were trying to intimidate me and I did not appreciate such unprofessionalism and I will not tolerate it.) I did however let them know that I would assist them -- at no additional cost to them -- (as a neighbor), for an hour on the technique of grouting, being absolutely certain there was no affiliation with Lyons Estates Inc. or any of its employees, and that I would await their call (which never occurred).
At the end of day (at approximately 4:15) on or about September 8, 2017, I submitted my invoice to [redacted]. They told me they would transfer money by email and asked me if I still had the original Proposal. They requested a review of the original Proposal to which I let them know that I would bring it the following day, Saturday, September 9, 2017, and I arrived at their home at 11:30 a.m. on that day with it, and reviewed it with [redacted]. On that day, and again on Monday, September 11, 2017, I advised [redacted] that I would not, nor would Lyons Estates Inc., be interested in grouting their tiles, however, I would attend at their home for approximately one hour to assist them with the grouting, but it would be non-company related and there would be no charge.
I told [redacted] that once all of the sanding and painting was completed (and the re-painting as a result of the damages caused by [redacted]), I would then caulk the sink with white caulking as discussed. Again, I advised them that I would await their call for this, and I have not heard back from them.
I do not recall receiving a call of complaint as stated by [redacted].
I do not recall being advised by [redacted] that she would not be paying for paint or labour.
I do recall speaking to her about painting the hallway but I did not offer to do it free. [redacted] told me she would complete this herself.
I did receive a telephone call from [redacted] ten minutes after I had left on September 11, 2017. He was approximately one minute ahead of me on his way to work. He was inquiring about our conversation earlier with respect to grouting. He asked me if I was joking when I said I was not interested in grouting the bathroom tiles. I advised him again that I was not joking and I reiterated that I would volunteer an hour of my personal time to assist him and [redacted] as they competed this portion of the project. I further advised that I would be returning as a neighbor (rather than a contractor), and that I completed repairs as outlined in the Proposal and was ending our contract.
The final invoice, which is attached hereto reflects the terms as outlined in the Proposal. As such, I am confident that [redacted] have not been charged for work that has not been completed, and that the cost to them properly reflects the cost of materials and labour as outlined in the original Proposal. It is noteworthy that [redacted] paid only for the cost of the grout and not the installation of same. It is further noteworthy that I installed a curved shower rod as requested by the clients which I supplied but have yet to bill to them. And further still, I left a can of exterior paint; color, Distant Thunder, on Mr. and [redacted] back step for them as they were going to paint the exterior foundation wall. To date they have not received an invoice for that paint.
It is my opinion that Mr. and [redacted] complaint to the Revdex.com is extremely unfortunate and unfounded in light of the circumstances.
