Review: I bought this membership for my husband, in December of 2012 he went into the club to cancel it. They sales [redacted] explained that there wass a 60 cancellation policy and that we would be billed thru Feburary of 2013. ok we understood all that. March came we were billed. My husband went into the club with his cancelation paper work on the weekend and the girl behind the counter told him she couldnt do any thing but put the account on hold untill someone could figure it out. I got billed in May , my husband went back to the club and again was told that there was no one there who could help him, but that [redacted] would call. [redacted] left me a message on my cell phone " I remenber talking to you but since you put your account on hold you must still want it and we will not refund your money> I called the [redacted] she was not available so I told the story for the $th time in2weeks. She callede me backm and said I guess you changed your mind by putting your account on hold!!!Desired Settlement: I would like them to refund April, and June and cancel the account as per our paperwork of 2012.

Review: I have a heart condition as well as being morbitly obese and problems and pains in my back and joints. I joined medford fitness for 3 main reasons . 1. due to my health issues they had 4 aquatics classes per week and water excercises was best for my condition. 2. daycare 3. location was close to home. I joined in oct 2013. I was quickly dissappointed to find their day care was unsafe and not sucre enviroment , they leave the daycare door open which is approximately 10-12 feet from the front entrance doors. My daughter who was 5 years old was wandering the hallway after one of my swim classes. I expressed my concern to the manage[redacted] who assured me it will never happen again. However it did and I again told the manger of my dissatissfaction. I never broght my daughter to daycare again because it was unsafe. they canceled saturday classes so now the gym had only 3 aquatics classes a week, it was 4 when I joined. the pool water was extremely cold all the time. many of us expressed their concern to the manage[redacted] however once again empty promises. the female life guard would sit in the pool room with a coat hat and scarf on so you can imagine what it was like being in a mere bathing suit in the pool room and imerging your body into unswimable temperatures. This was not good for my heart I complained so many times my class got small because people stopped coming I was talking to a few of the women (mostly the whole class is elderly except me) and theydont cancel because they told me they get their membership free through their insurance sothey just stop going. to top it all off the life guards never pay attention to the pool an elderly man almost drowned and the aquatics instructer had to come to his resque because the guy (life guard) never bothers to look up from his phone. all the reasons I joined have been void, it is not a safe swimming enviorment due to guard constantly playing on cell phone, pool room and water temperature is unbarable and unsafe daycareDesired Settlement: I am have complained numerous times and these people will not let me out of contract. They dont care that they provide unsafe enviorment and daycare and they dont care about the temperatures in the poolroom and water. I dont know what else to do. I am requesting a back refund of december2013and, january, feburary and march 2014 membership payments. I was not able to utilize this gym due to them breaking the contract by cutting classes, providing unsafe day care, unsafe pool enviorment and unsafe temperatures. Please help me! there has been so many complaints about this place and they just dont care they get your money and thats it. I would like a refund of the last 4 months and I would like to cancel the membership so that they cannot take anymore money from me. This is so upsetting and I am begging for your help on this matter

I am rejecting this response because: I sent [redacted] the email that she asked me to submitt in reguards to my health and unsafe pool and daycare conditions in order to terminate my contract and owe no fees or mothly dues and she didnot accept my letter. She told me as of April 4th the day I had the conversation with her that she would terminate my membership effective that day and she admitted her gym was unsafe and when I sent the email that she asked for, the next day, she told me she misspoke and could not release me from this contract. this gym is unsafe for me and my child which is why I cannot use it. [redacted] wants me to lie and state the ONLY reason I want to cancel my membership is due to me having medical issues . I dont want to lie . The truth is the gym has an unsafe pool guards and temperature(which is not good for my heart condition) and unsafe day care. [redacted] even admitted to these complaints that the pool and daycare is unsafe and I had a witness present during that conversation. All I want is my money refunded and my gym membership canceled. Its very simple. It is to my understanding there is currently a number of complaints from others and a lawsuit in process by numerous other members for the same issues I am complaining about. I am requesting your assistance because this Manager [redacted] was rude and nasty to me and unwilling to resolve the issues about her gym than when more people started to complain and come forward she called me to say if I sent her and email requesting to be terminated that she would terminate my membership effective immediately and apologized for the unsafeness of her gym and admitted it was unsafe. than I did as she asked and the next day she was changing her mind stating she would not let me out of the contract unless I wrote a letter stating that the ONLY reason I want to terminate the membership is because I have medical issues that prevent me from going to this gym but that is not true, I do have a heart condition and if the pool waters were kept at a decent temperature I would be able to use the pool which is the main reason I joined because they had a pool and daycare, however temperatures were kepte at chilling temperatures enough to bring goosebumps on your skin and would shock your body getting in because it was so cold(hence not good for one with a heart condition)it remained cold and never warmed up I had to leave class many times because the water temperature was extrememly cold and aquatics classes got smaller due to the unbareble temperatures of the water, the life guards were constantly on there phones texting and a man almost drowned and the life guard was oblivious to this matter because he was playing on his phone, daycare was unsecure way to many children and only one attendent who didnt keep the door locked at times didnt even keep it shut. my child was wandering the hall which is only several feet from the front door interance. So as you can see the gym is unsafe and that is my reason for wanting my membership terminate I can not use a gym that is unsafe for me and my child and I feel it is extremely unfair that they continue to take my money when they know I have not been there and all the numerous times I brought these complaints to [redacted]s attention none of the issues was ever resolved. so it becausme an unsafe place for me and my child.. please help me to resolve this matter in getting my money back that this gym has continued to take from me $37.50 per month since october 2013 and $39.99 matenence fee in Jan 2014 and please terminate my membership so they can stop taking my money for a gym that is unsafe to even utilize. Hello,

Let me start by notifying Ms [redacted] that her membership has been cancelled due to medical reasons. However at no time did I "admit" to the complaints of an unsafe facility. I said I will look into the concerns Ms. [redacted] had and would take action where it was warranted, and that was in regard to her nursery and lifeguard concerns. In reference to her concerns about the temperature of the pool, please note that the temperature is kept at 84 degrees malfunctions not withstanding. If a malfunction occurs we address it as fast as we possibly can. 84 Degrees is the temperature recommended by the [redacted] Foundation. Ms. [redacted] had a valid and legal binding contract with us and continued to use the facility until just prior to filing this complaint, as her attendance records show. No refund is due to her based on these facts. The enhancement fee is also a part of this contract. Should Ms [redacted] need a copy of her contract and attendance in order to verify these fact we would be happy to provide that to her. Thank you.
