[redacted] ,We are replying to the complaint filed to the Revdex.com by [redacted] on 11/03/with a reference # [redacted] with our Digital Agency Media Prowler[redacted] states to the Revdex.com that we did not notify him of how we received his email address, but you will see in the emails attached that we did actually inform him how we do build our databases and specifically included public forums where his email is available to public viewing and accessPlease [redacted] .com and you will readily see that his information is available to the public.I have also attached a quick sheet which gives the guidelines of Can Spam Compliance, which we completely fulfilled in his case and you can see he readily admitsWe did apologize to him for receiving an email that he states he did not want and removed him from any future mailings per Can Spam Compliance.Our company is going on years in business with never once having an issue like thisIn fairness, the time we spent to ensure that we did in fact give [redacted] the time to explain why he received one email and promptly removed it from any further emails should be clear that we have done nothing wrong legally or morallyWe also tried our best to make this person satisfied.Please view the facts and understand that we as a business rely on our reputation.Thank youRick

I am rejecting this response because:The response from Media Prowler is misleading and false.The company has NOT explained *specifically* where it obtained my personal data, replying only in simple, broad terms which it uses to absolve its possibly illegal behavior. I have been very clear and specific about the information I have been requesting for nearly six months.Regardless of the company's claim in response to my complaint filed with the Revdex.com, the CAN-SPAM Act PROHIBITS the use of harvested data, which is EXACTLY what Media Prowler cites as its sole defense and acquisition method in its response to the Revdex.com.I must also highlight the inefficient and evasive behavior which Media Prowler and its clients have employed to hinder and evade my efforts in discovering how and where my personal data was obtained.My first outreach to Media Prowler's client who sent the email, [redacted] Radio, was June 24, 2015, the day the spam message was sent to me. I have been in contact with no less than six people seeking an answer to my inquiry; none have replied with any level of specificity. At one point, Media Prowler took three weeks to reply to me because the person with whom I had been corresponding had, unbeknownst to me, left the company (he wasn't the only employee with whom I was in contact to leave during my investigation). Late in my probe, due to the repeated runaround and obfuscation, I attempted to contact the company CEO, Richard W[redacted], via three emails between October 15 and October 26; he never responded, nor did any proxy. That is, until I filed a complaint with the Revdex.com.I have been more than patient with this company, which lives up to its "prowler" name because I feel as if my personal data has been ambushed. And I still have no sufficient answer to my query from a company that appears to be in violation of the very law it claims as its defense.See[redacted]"Q. What are the penalties for violating the CAN-SPAM Act?A. Each separate email in violation of the law is subject to penalties of up to $16,000, and more than one person may be held responsible for violations. For example, both the company whose product is promoted in the message and the company that originated the message may be legally responsible. Email that makes misleading claims about products or services also may be subject to laws outlawing deceptive advertising, like Section 5 of the FTC Act. The CAN-SPAM Act has certain aggravated violations that may give rise to additional fines. The law provides for criminal penalties – including imprisonment – for:...harvesting email addresses"
