Review: We rented a handicap van from this business to transport my brother who suffers from chronic progressive Multiple Sclerosis to my father funeral in [redacted] CT on [redacted]. The automatic door on the van seemed to function normally when we picked up my brother from his nursing home in [redacted] CT and transported him to [redacted] Funeral Home located at [redacted], CT. The automatic door opened okay and the ramp deployed when we arrived and unloaded my brother and it again opened okay when we were leaving to go to the church for the funeral service. We loaded him into the van and secured him in place, but when we used the power controls to close the door as instructed by [redacted] at Wheelchair Getaways the door would not close and would come forward about 6 inches and then go back. We repeatedly tried to close the door by this method with no success until it finally started to close. As it advanced along the door track towards the closed position it appeared to come off the top track and the door fell completely off the van. The door was now completely disconnected from the van with the exception of two cables attaching the door to the van. We had 15 minutes to get to the church and had no choice but to leave my brother sitting in the van in 90 degree heat while we went on to the funeral or to interrupt and delay the service. My older brother [redacted] decided to cut the two cables so that we could remove the door and transport my brother [redacted] to the church. So we cut the cables, removed the door and stored it in the funeral home until we could comeback to get it and we went on to the service with the van. After the service we tried to arrange alternate transportation for my brother but none could be found so we had to use the van with the door missing to transport my brother back to [redacted]. Because the ramp didn't work anymore either, we were forced to lift my brother into and out of the van while he remained seated in his power wheelchair.Desired Settlement: DesiredSettlementID: Refund

Refund of the $228.54 charged to my credit card for the rental of the van. In addition, [redacted] has indicated that he wants me to pay for repair of the van which I feel is unjustified since the door failed under normal use and at no time was any force or damage done to the door which would have caused the door to come off the tracks. More than a dozen people witnessed this and will testify in court if necessary.

If there was a problem with the rental van, the client could have and should have called us. We could have walked him through the problem over the phone or we could have come out and given him a replacement van. That would have been a better alternative than cutting door cables and driving the vehicle with the door off. That was worth over $2,000.00 of damages to the vehicle. In addition, these vehicles have a manual backup to all of the power functions which we could have helped him with if he would have bothered to call us.They claim to have tried to find alternative transportation but yet never called us. In addition, after having worked in this business for 22 years, I have never seen a door come off it's track unless by use of excessive force.

Under normal circumstances where the door jammed in the opened or closed position and we were not under a time constraint I would agree that we should have contacted the vendor and waited for them to offer a solution. But this was anything but a normal situation. Again, the door fell off under normal operation of the power controls as instructed by [redacted]. No one at any time tried to manually close the door by using excessive force or even minimal force. This was witnessed by more than a dozen people outside the funeral home at the time. I feel that the door should not have fallen off the vehicle under ANY circumstances short of a serious collision of some sort which did not occur. Waiting for the vendor to drive the 50 miles from [redacted]l to [redacted] would have meant delaying or canceling my father's funeral or leaving my quadriplegic brother in the van in 90 degree heat for an unknown period of time, none of which were acceptable options since we could not remove my brother from the vehicle with the door attached by the two cables. [redacted] was contacted from the church immediately after the funeral service and did not offer to provide another van to bring my brother back to [redacted] which we really didn't expect since he had told us earlier that no vans were available for rental until he was able to produce the one in question that ultimately failed. We were forced to use the vehicle to bring my brother home because no other options could be found on short notice on the [redacted] holiday. My position is that none of this would have happened had the vehicle functioned in a safe and effective manner and all of our actions were necessitated by the failure of the vehicle and the circumstances of the day. We felt that the decision to cut the cables and remove the door was our best option out of a series of very bad choices. We would be willing to pay for the repair of the two cables provided that a detailed repair invoice is provided but we feel that we should not have to pay the rental fee and any charges relating to repairing and reattaching the door to the vehicle.

Business

Response:

If the client agrees to pay for the damages they caused, I would be willing to compromise on the rental cost.
