I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
Again as stated in my previous response I understand that a refund is not availableYes I did pay for almost a year without complaint but that was before TMIKY tried to ##### me over in the first place with finishing my externshipUnless I didn't receive the copy of the paper that states that the externship was to be completed in weeks I was NEVER informed of thisI knew I had to complate hours but that was itYou were negligent in giving me all needed information prior to it needing to be completedI've had an Education Lawyer look at the papers I received, I'm not just basing it off of what I've seen. I'm not going to continue to argue about thisWhat's done is done and the offer to finish my externship is a little too late after I've been told several times that since I missed the deadline I'd have to take the courses overAs previously stated I now have a full time job and I'm about to have knee surgery and will be out for recovery for monthsI'm not dragging this out any longer.

I spoke with Ms. [redacted] on 6/27/2016 by phone, and discussed this in detail.Ms. [redacted] complains of "advertising issues", when in fact our advertising is geared for prospective dental assisting students. TMIKY firmly believes our advertising is 100% true and accurate. Students do become...

trained as a dental assistant in 16 weeks, just as advertised.Ms. [redacted] complains that an admissions rep told her she would be a “certified" dental assistant upon completion. The employee no longer works for our company but the school's student catalog [redacted] received, only lists "program certificate of completion". (Page 15) Ms. [redacted] is confusing "certified” and receiving a “certificate”.Ms. [redacted] lives in Tennessee, she chose to attend school in Kentucky. TMIKY’s catalog addresses out of state students, they are encouraged to check with their local dental board for state rules and regulations governing EDDA in their state. (Page 15-16)Ms. [redacted] is asking for a partial refund, but she has completed over 51% of the program and is able to obtain employment from the education and knowledge received at TMIKY. The catalog states the refund policy on page 5-6. [redacted] is not eligible for a refund.[redacted], Education DirectorSee attachment for original response.

On Monday, June 27,2016, I arrived at school for class and was told by [redacted] that I was not allowed to attend class due to my complaint to the Revdex.com. He would not allow me to let me teacher know what was going on. I spoke on the phone with [redacted] as well, who also stated I was not allowed back in class because I supposedly made a "false" complaint.  [redacted] typed a letter out on Monday, June 27th, 2016 to me stating that I was not allowed to attend class again until I retracted the Revdex.com complaint or until it was resolved. Nevertheless, I contacted the Revdex.com regarding this issue, letting them know that The Medical Institute of Kentucky is not letting me back in class unless the complaint is retracted. The complaint department I spoke with state that once the complaint meets the complaint acceptance guidelines it stay on the site for three years. I'm fully aware of what I signed for TMIKY, I have a copy of all signed documents pertaining to me attending the program.  I understand that I can't receive a refund for the money I've already paid because I have completed the online courses.  But it was to my understanding that I wouldn't be paying back my tuition until EVERYTHING was completed,  if TMIKY is saying I have something left to complete then obviously everything hasn't been completed yet. I don't accept the offer to complete the externship. I work a full time job now and I'm about to receive surgery that'll put me in recovery for 6 weeks. I should have been made aware of the deadline before it was time for me to complete the externship. TMIKY was  negligent in doing so, again my copies of the documents doesn't state that the externship was to be completed in 4 weeks. They state how many hours need to be completed.  A lawyer has looked at the documents as well so it's not just me stating so.

On 11/11/14 [redacted] applied for the Dental Assisting Program at The Medical Institute of Kentucky in [redacted] (TMIKYBG). She was approved for $1,000 through our third party financing towards her $8950.00 tuition cost. Like most of our...

students Ms. [redacted] was in need of help to achieve her stated goal of becoming a trained Professional Dental Assistant. Ms. [redacted]’s Admissions Representative, [redacted], was in training with our Director of Admissions whom is no longer with TMIKYBG. We were just beginning to work with [redacted] at the time and [redacted] has advised me that she did not advise [redacted] to “lie” or for that matter manipulate anything during her [redacted] process nor did I. I was brought in to help Ms. [redacted] work on how to attend TMIKYBG on 11/25/14 once her denial at [redacted] occurred. Part of my role is to enforce rules and guidelines here, not encourage behavior unfitting of our School.
We were informed Ms. [redacted] was staying at the [redacted] here in [redacted] and upon that knowledge we wanted to help her any way we could to get her life going for her and her [redacted]. I did in fact advise her to speak with the leaders of [redacted] to see if they had the ability to provide help as I had a conversation months before with [redacted] on how we were interested in helping them in any way we could to provide opportunities for their young women to seek professional career training as part of them gaining their new independence. I also took the initiative to reach out to [redacted] of [redacted] to discuss what may be possible if in fact anything. At that it was upon Ms. [redacted] to take the initiative with [redacted] and she did. Not before or anytime during was I ever aware of what Ms. [redacted] calls [redacted]. I am now aware of [redacted]. based on her complaint. During this time [redacted] informed me that they could help. I was only told what they could help with and no other details. I was informed [redacted] needed a letter from me stating Ms. [redacted]s acceptance, details of her time in school, description of program and if in fact we would still honor the original $4000 that Ms. [redacted] tried to get from [redacted]. I was agreeable to that and allotted Ms. [redacted] $3950 from our Scholarship Fund to assist her needs. It was agreed $4,000 from [redacted] would come once Ms. [redacted] was in class and stable with the program. I have enclosed the letter I wrote to Ms [redacted] at [redacted] per her requirements that is dated 12/18/14. This is not our normal procedure but we do try to work with anyone in any way we can. A significant part of our School Mission is to help those in need. We bent over backwards for Ms. [redacted] in every way.
Ms. [redacted] was not told she had to “pay the $4,000 up front before beginning classes” as she states. [redacted] does not even pay for their students until they complete at least one half of our program. We often allow students to make their own payments if in fact we are comfortable with them to do so. Ms. [redacted] was told that we had to know “How” she intended to fulfill her obligation before she could attend and that her obligation would have to be met before she could graduate. That is our school policy and to our knowledge the policy of most any school in the land.
Ms. [redacted] was walked through each step of the process from 11/25/14 and I know this because I was involved in it. Helping Ms. [redacted] was something I was committed to personally at that point. Not once did she mention the issues in her complaint during this process and she was explained, in detail, each step of the way. [redacted] and I wanted to be sure she was comfortable with each step. She was passionate about her desire and focused on getting what she wanted. Her interest rate of $14.9% on the $1,000 she qualified for was not only explained clearly but is in bold print right next to her signature on the document. On two occasions she brought her [redacted] counselor to TMIKYBG. And [redacted] even agreed to pay for her books. The same books we helped her sell after she withdrew.
In dealing with Ms. [redacted] during this process she has told me that we in fact tried to help her and she only put up the Revdex.com complaint “because my [redacted] made me”. She has twice told me she would retract the complaint but like many issues involving Ms. [redacted] she did not. While I stop short of any accusations of lying, etc…it has become obvious to us Ms. [redacted] is simply upset over our clearly defined Policy of Refund. Her signing of documents and conversations we have had during this entire process support our consistent procdure of total disclosure and that her accusations are inaccurate.

Sincerely,
