Friday, Jan. 11, 2019 - I went to Medical Vision Technology at ***. I picked out an eyeglass frame, lens shape and lens options with the help of employee, ***. When the transaction was being totaled, she said the frame was $414, although the advertised price tag is noted $140 and would not sell me the eyeglass frame at the price on the tag. (I have a photo of the advertised price tag available.) I asked to speak to the office manager but she was not in the office. *** said she would have her call me on Monday.
Monday, Jan 14, 2019 - Medical Vision employee, *** called and left a voicemail stating the manager would not approve the eyeglass frame tag price but will take $100 off the cost of the frame. (I have a photo of the voicemail available)
Monday, Jan 14, 2019 approximately 1140AM - Instead of calling, I stopped by the office and spoke with office manager, ***. I explained the above situation because the only note she had was that I didn’t like the price of the frame. She said she would not have approved taking $100 off the price of the eyeglass frame. Manager, ***, asked if I was willing for the business to lose money to get that retail price? I asked is she more concerned about the business losing money instead of customer service? She said she will email the owner and call me back.
Monday, Jan 14,2019 approximately 4:15PM - I returned a phone call to Medical Vision, office manager, ***. She said she spoke with Medical Vision Ophthalmologist Dr. *** and Medical Vision owner, Dr. *** and the advertised price tag on the eyeglass frame will not be honored, the price is $414.
I feel this was a “bait and switch”! After approximately 20 minutes of searching for a frame and lens shape, I chose this particular eyeglass frame for the style and advertised price on the tag for $141. Yet, when I attempted to purchase them for $141, I was told the price tag is wrong, it’s $414!! 1
I have attached a photo of the advertised price tag for the eyeglass frame.
Please advise me if there is anything else you may need.
To whom it may concern,
The situation described by *** in her complaint is an issue of a clerical error whereby the wrong barcode tag was placed on the frame in question. During the finalization of the order in our computer system, compulink, the correct retail price was reflected and the error discovered. Our Optician attempted to explain this to the customer who didn't want to then buy that expensive of a frame. The original sales transaction was never completed once the error was noted. She was welcome to explore other less expensive frame options but chose not to.
I am rejecting this response because: California Code, Business and Professions Code - *** States:
(a) It is unlawful for any person, at the time of sale of a commodity, to do any of the following:
(1) Charge an amount greater than the price, or to compute an amount greater than a true extension of a price per unit, that is then advertised, posted, marked, displayed, or quoted for that commodity.
Medical vision Technology refused to let me purchase the eyeglass frame for the advertised amount on the price tag attached to the eyeglass frame. I feel this is a case of "bait and switch".
