We out of a courtesy gave you the 4% How did we practice a deception? We did not show offer to show any particular property in fact said it in a courtesy In fact it is unreasonable to assume if *** was acting deceptively then why would he even say that if he could make more money with the 4% If you are such a good sales man why have you not sold your property after years? We are not being negative about your property but truthfulAt the end of the day you will get maybe $for it that is something to be positive aboutIf you want to get top dollar then you will need to do these things Finish the stair case with hand railAdd split minis ac and heat units to main house and guest houseFinish the shoddy finish out work in the guest house Add a closet to the master bedroomThat should get you the $priceWhere the deception is and what got my goatIs when you agreed to the withdraw of the listing and but you could not sell or relist until it expiredAnd you agreed to that I sensed that you wanted to cancel the listing so you could sell it to you cousins and cut us out of the dealAnd you told me things like this well I just don't want to sell now maybe next year in the springMaybe I will call you in JanuaryI said to myself if he is telling me the truth I will not hear from him in a while or at allIf he is lying to me I will get a call tomorrowBut I hear from you the next day complaining why we were not canceling the listing Then I knew Dan then was being dishonest with meDan wanted to cut us out of the contractSo NO DEAL and you have NO CASE

Tell us why here... My name is [redacted] I am the Broker of Medina Lake Realty. My grandfather was a salesman, my father was a salesman, I am a salesman, and my son is showing himself to be a good salesman. [redacted] in the past 6 months has 8 sold and 4 properties under contract and currently 7...

listings. To address the complaint, first of all there were not 2 deals but 1 deal and in both instances it was the same buyer. The buyer came in with an offer and backed off then he came in again with another offer got an inspection and then backed off. [redacted] never met this buyer never talked with him over the phone because he was represented by another agent and agency. The only word back to the seller as they elected to use their option was that there were too many things wrong with the property on the inspection report. To think that [redacted] was responsible for this deal not happening is absurd. To address the house, the house is in rough condition. The ceiling is not painted, the crown molding needs to be caulked, puddied, sanded, and painted. The staircase is lacking kickboards and hand rail. The flooring is showing gaps around the base board and doorjambs. The entire house is poorly and unprofessionally textured.  The House has no heat. Hot water heater did not pass inspection.Not to mention the functional aspects about the house the Master Bedroom has no closet or bathroom having to go down stairs to potty at night would be a problem.  Now when it comes to these issues we sell houses like this all the time. But they do not get top dollar. On top of that FHA, VA, and many conventional loans will not loan on a house without heat. These are the reasons why these sellers have gone through 2 agencies and have not sold their home since May of 2015. When it comes to their cousin, [redacted] first thing filled out the paperwork to act as an intermediary for both parties. As an acting intermediary we are obligated by TREC to disclose any known property condition. That being said [redacted] did not error except he should of informed the Sellers about releasing the inspection report. Also the sellers agreed to an intermediary relationship in the listing. However in corresponding with the sellers on this deal and even in this complaint it is like they wanted us to usurer the cousin in and have him sign documents like a high pressure time share sales organization.  We do not act this way nor or can we act in this measure. Which also the cousin stating a need for some reassurance on his purchase of this property it is appropriate to say “you might want to look at some other properties” this is in line with our duties to the buyer.  We never met the buyer never showed him anything not even the subject property. [redacted] only had a few phone conversations. The reason the sellers are unhappy over the situation is that they do not want to pay a commission. They think they can get the cousin to purchase the property without a realtor. They might be able to do that after the listing expires. However if they do “Good Luck” you are going to have a hard time finding financing with no heat. However I would like to say thank you the [redacted] family for the opportunity to work with them. I am rejecting this response because:
Again, the reason I am upset is that [redacted] tried to sell a different property to my cousins because I lowered the price for them, then said "all buyers are liars". A person who provides a service should never insult someone's family...or anyone in that matter. I guess it is like you said "lessons learned for [redacted]". It was only in his best interest to do the paperwork and receive the 4 percent...but obviously it wasn't enough for him to make an entire family happy. He had to steer and control things his way, and I now have a controlling and unethical ex-real estate agent that is so unprofessional that I am not able to list with a trusting and more reputable service. I am not a home salesman, but have definitely had more success getting closer to a deal than your business. I definitely had to make some improvements to my property before even listing it with you. Sadly, the improvements that you mentioned in the last message maybe should have been suggested in the very first conversation with your company...just something for you to consider if you have a desire for any kind of success. Now I will take this further to be able to relist with someone I trust. We have both made our mistakes, but I made the biggest one in trusting in your company to deliver a quality of service and customer satisfaction. You fail in my opinion from this ex-customer. My time is wasting while my house is off of the market, so I will not quit until my home is relisted. You have ruined the sale with my cousins for me, and I hope you are happy. They do not want to have any business with you either. You should not try to control people...especially when your company made most of the mistakes. Regards,[redacted] & [redacted]
