I specifically requested the patent number which Melnor claims for one of their oscillating sprinklers [which by LAW is public information]. Also asked them to explain the difference between their two seemingly identical products -- one claiming 'patented' to work with well-water; the other lacking patent claims but identical in every other way except black plastic casing instead of gray plastic. They call the sprinkler bearing the 'patent'-claim '*** Turbo Drive', whereas they call the black-colored sprinkler "Infinity Drive".
Melnor's 'contact us' website form claims to respond to all inquiries "within 48 hours", yet after THREE WEEKS of waiting I was forced to phone them. Although they admitted receiving my inquiry, at first they claimed I'd submitted my question to the 'Warranties' page or some-such nonsense. When I vigorously disputed that accusation, then their story switched to, "your question was sent to our engineering department". After that phone call on 19 November 2019, I have yet to receive any response from Melnor. I believe their advertising claim of 'patented technology' to be false, and that Melnor should be convicted of both patent law violation as well as False Advertising. Finally, Melnor should be enjoined against making false promises on their website, that they respond in timely fashion to consumer inquiries.

Dear ***: We did get contacted by *** with an inquiry for information about Melnor's oscillating sprinklers. Her questions were answered in a timely manner in accordance with our statement on our Website, but *** requested additional information containing very specific information about the technology used in our oscillating sprinklers. We executed our right to protect our intellectual property and did not disclose the information *** requested. Obviously, she didn't like the response and kept asking the same questions over again, at which point we recognized we cannot satisfy her request and stopped communicating with her. The patents used on our products are available on the USPTO Website. With a little research, *** can review all our patents, but there is no legal obligation for Melnor to provide them to a third party. The terms “*** Turbo Drive" and "Infinity Drive" are Trademarks Melnor uses on oscillating sprinklers. We are not sure what possible issue *** could have with Melnor using these Trademarks. If *** truly believes that Melnor is infringing on any patent, then we would encourage her to file an official claim with the USPTO or any other institutions she believes is appropriate to handle her claim. If *** has a problem with area coverage using her water well, our recommendation is to find a way to increase water pressure by perhaps using a different pump. As far as being reimbursed for her purchases, all retailers selling Melnor products have a return policy. Usually the consumer can return the product (if not satisfied with the performance) and if there is a proof of purchase, the retailer will reimburse the consumer. alll.

On July 2nd, 2019, I purchased a Melnor *** Internet Controlled Smart Water Irrigation Timer, Kit, Basic from Melnor, Inc's online store front on ***.com I paid $115.16 for this item. Shortly after the return duration on *** ran out the unit stopped functioning properly as port 1 became stuck in the open position. I went to Melnor's website directly and placed an inquiry through their web form and never received a response. I went back to *** and provided feedback, and again no response.

Dear *** and ***

Melnor received your letter from the Revdex.com today 9/25/19. I went to our customer service manager and we had no record of either filling out the form on line or our phone records showing any calls to or from the numbers listed on the complaint? I did check with our engineering team and they did show that on 7/3 *** did set up his WIFI timer so I have no doubt he purchased the unit. I cannot explain why we have no record of his contact? The model *** purchased has a 7 year warrantee. Melnor strives to provide outstanding customer service and our normal policy would have been to replace the valve unit If we would have known about it. Since over a month has gone by since his problem and *** is frustrated by what he feels is our lack of Melnor’s response I will have a check issued for $115.16 and mailed to *** Blackwater, VA ***.

*** I apologize on behalf of Melnor for both the problem and the frustration.
