I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint.I never received the said email from the BP of sales as mentionedThe details of the nonrefundable amount for the design center were not statedWe are not going to purchase a home with first AmericaThe sale price of the house reflects the upgrades charges regardless if they were to our specifications or notFirst America is recouping the amount we paid upfrontI still believe we are due a refund from First America in the amount of $Period. Sent: Monday, October 02, 4:PMSubject: response to Revdex.com case #*** Response to Complaint ID #*** Mrand Mrs*** purchased a to be built home from us in our *** *** community in February of 2017. Their credit scores needed improvement for them to be in a
position to get a mortgage, so they put up $1,non refundable earnest money with First America and we enrolled them in our third party credit repair program. Although this $1,was non-refundable (and the ***s acknowledge that fact in their complaint), it would be credited to the customer 100% when they close on the home. Additionally, the ***s went to our design center and chose option/upgrades for the home. Several of these upgrades required deposits, and as such they put up $in deposits. These deposits were for their specific options they selected for their home, and throughout the contract they signed it clearly states that option deposits are non-refundable, should the purchaser not close on the home, for whatever reason. We built the home for the customer, but unfortunately their credit was still not a point where they could secure a loan once construction was completed. Since more work needed to be done on the customer’s credit (again, they were with a third party credit repair company we use), we let the customer know that we were going to put the house back on the market, but that we would honor their $2,($1,earnest money plus $in option deposits) towards the purchase of another First America Home, once their credit was to a point where they could secure a mortgage. This is a more than fair offer, since by contract we are not required to transfer that money towards a future purchase. My understanding is that the ***s refused the offer, and made the decision to not move forward. We did not collect the appraisal fee ($525) that was reference in the complaint. We are the builder, not the lender, and as such we do not collect appraisal fees. The ***'s will need to take that up with *** MortgageAdditionally, upon receiving this complaint I had our VP of Sales reach out to the ***'s via email to reiterate the offer to reengage the third party credit repair company to proceed with their file, and further to honor the full $2,(earnest money plus option deposits) towards the purchase of another First America Home. We wish the ***'s the best and would be willing to continue assisting them toward the goal of owning a new First America Home should they decide to do soThank you, Dave *** Division President
