To satisfy the customer we will be willing to provide a refund on the battery, if the customer is willing to return the battery in exchange for a used battery. That used battery would not to be used for the customer’s vehicle but rather be used as a core value exchange when the customer would go out to buy another battery.The customer got  his “free” ride out of the service station and got to where he was going. The customer was not bound to the new battery; the battery that was taken out of the car could have been put back in. Furthermore, if the customer really did not want the battery, why did he pay for it? Do we pay for something we did not order when we go out to eat?Memorial Drive Mobil

To Whom It May Concern:The vehicle serviced was not driven into our facility, but was towed in by [redacted] (please see attached photos of vehicle on tow truck). The customers statement does not make any sense by saying he only came in for an oil change, by just coming in for an oil change the staff...

would not just jump out and say we will check your alternator for free. There was a conversation on why the car was towed in, the need for a battery replacement, and checking the alternator. The standard procedure after replacing a battery is to have the alternator checked to make sure it is working and charging the battery. A faulty alternator can cause damage to the battery and at one point prevent the car from starting. For the customer to know the fee for checking the alternator, the customer asked how much the fee was for checking the alternator, and that is when our staff told the customer there is no fee. After the vehicle was brought in for the battery replacement, the customer added on the oil change, paraphrasing his words: You might as well do the oil change while its in there.If the customer was unsatisfied, he had the option of putting the old battery back in at the time, he did not mention anything about taking the battery back out or refusing to pay. I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted]. Please add your rejection comments below. 
This response is completely factually wrong.Yes, I brought the car in on a tow truck, but I NEVER ONCE STATED THAT I WANTED A BATTERY CHANGE. I never even uttered the words "battery change" the entire time I was there.  This is the order of events:1. My car failed to start.2. I got it towed to Mobil.3. The tow truck driver jump-started my car battery when I arrived, so I told the person at mobil "I do not need your help now, because the tow truck driver started my car"4. The guy at mobil said that they would check my alternator for free5. THEN I said, "ok, well I guess I will get an oil change while I am LOCATED here" I never mentioned being there to get a battery changed, and this was evidenced by my extremely surprised and angry reaction when they told me they had changed the battery without my knowledge or assent. They offered to check my alternator as a courtesy, because I told them that the car had failed to start that morning. I DID NOT ASK FOR A BATTERY CHANGE, AND DID NOT ASK FOR THEM TO EVEN CHECK THE BATTERY. I will also mention that it is not standard practice to replace a battery simply because the car needed to be jump-started, so there was not an assumption AT ALL that Mobil would be replacing my battery. If anything, I would have paid them to jump-start the car, if my tow truck driver had not offered me that service for free! The response by this business was completely wrong on all of the points mentioned. Furthermore, I DID complain the second I was handed the bill, because I asked them specifically to do an OIL CHANGE ONLY.I did not refuse to pay the bill, because of the undue influence of the people working at the store. They instructed me that I had no choice but to pay the bill they handed me and that it was "absolutely necessary" for the car battery to have been changed. Again, I will reiterate my point: when a business provides a service that is not requested, they have no right to bind the customer into paying for it. That is a contract with no "consideration" - this sort of contract is commonly invalidated by courts of law in the state of Massachusetts. I only promised up-front to pay the amount of money needed to do an oil change, so legally Mobil can only hold me to that amount: $21.95.  Therefore, I again request that this business refund the amount on the credit card that is in excess of $21.95. I will also state again that I am currently at Harvard Law School and that I would prefer not to take this complaint further than it has to go.
