While in for service in May of (approximately months after his delivery), [redacted] stated that his vehicle was in an accident that was not reported to [redacted] until well after he purchased the vehicle from Mercedes-Benz of Huntington He stated that his insurance company was surcharging his insurance policy because of a $40,charge-offI had never heard of such a surcharge before If there was a $40,accident, the insurance company would have considered the vehicle a total loss In any case, we put the vehicle up on a service lift and found no substantial body work We did find a little over spray (of paint), having to do with the repair of the front spoiler (bumper).I could tell that [redacted] was unhappy with the vehicle and offered to “swap” the vehicle with another we had in inventory He agreed to the swap and we made the vehicle ready for deliveryWe added equipment that [redacted] requested i.erear deck spoiler After we made the vehicle ready for delivery, [redacted] reneged on that agreement We offered him another vehicle that we was a little more expensive and told him that he would have to pay the difference of the two vehicles He told me no, that hewanted us to find another vehicle exactly like the one he had purchased After several months went by, I received a letter from his attorney I wrote back to the attorney that we acted in good faith with the information that we had at thetime of the sale.We have accommodated [redacted] as much as we can, but at this point [redacted] will have to come pay us for another vehicle He has put over ten thousand miles more on his car and there is another year of depreciationAt only $per mile, [redacted] would have to come up with at least $plus another year of depreciation on his vehicle We would be willing to trade his vehicle for anotherHe has a very favorable interest rate now but, that loan will have to be paid off and a new loan started, (at whatever the current rates are) We will use the best rates available from our loan institutions or, he can obtain his own loanRight now we have favorable rates [redacted] ’s vehicle has a Mercedes-Benz Certified Pre-Owned WarrantyAll of his issues have been addressed and repaired under that warranty That is what the warranty was intended for We are willing to take his vehicle in trade and work with him on another that he will be more comfortable in I feel that we have acted in good faith with the information that we had at the time of the sale and have tried to accommodate him several times Thank you for the opportunity to respond, [redacted] ***, [redacted]

With regard to the mechanical issue; the issue was resoldved as per the new car warranty.
In the attachments you will see the original order form for $800.00. There was a $deposit that was paid by *** *** upon the shippers request:
Price Quote:$- Payments Rec'd: $- Total Balance: $Deposit Due: $200 COD Amount: $Unfortunately, the driver asked for and was given the full $800.00. when the sales person realized that we had overpaid he asked KTransport Incto send the $overcharge directly to *** ***. Copies of the checks and correspondence is enclosed
So, as I had responded, the total cost to ship the vehicle was $800.00.
We appologize for *** ***'s mecdhanical issue but, that is what the year/50,mile factory warranty is for. The CPO warranty will take over at the end of the factory warranty and add another months with Unlimited miles.
There is no need to compensate *** *** for the shipping costs. Again, we have tried to satisfy *** *** and garner good will. WRD

In regard to the mechanical defect, (which was not fully addressed by Huntington), there is a serious transparency and truth in Advertising issue as the product advertised was delivered with obvious and distinct mechanical problems and was not certified as there is NO WAY it would have pass the CPO process with the loud and apparent noise when driving

Review: Starting in April 2014 I searched the Mercedes Benz web for a Certified Pre Owned car. I found one in MB of Huntington, I talked with sale person who ensure me the car was certified and had NO mechanical issues, he also stated the car was a Certified Pre-Owned vehicle . I purchased the car via wire transfer on April [redacted]. It was delivery by transport company May [redacted]. The cost to delivery the car was a total of $600.00 which was charged to me. I drove the car 50feet and heard a loud grinding sound. I called the dealer to tell them the car was defected. They suggested I take it to a MB dealership in my city (MB of West Chester). Net, within 40 min of delivering me the car it was at another MB shopping having both the from Wheel bearings replaced. MB of West Chester alerted me the car was NOT a Certified car. We called the Huntington dealer who stated the paperwork/process takes time to post as Certified. upon that explanation WC repaired the car as not charge. The car also was NOT detailed (as it should be for resale) in fact it was also filthy. I called the MB Customer Care line and they have tried to help we work through the issues. The Case worker, after investgating found the car was Certified but at this point I don't trust it was. I am very concerned that the Huntington dealership in NY knowingly sold me a car that was defected and I calling their intergity into play. The MB Case worker aligned on 1) MB of [redacted]o detail the car MB of Huntington to cover the cost 2) MB of [redacted]o Full the tank with gas, MB of Huntington to cover the cost (as it was empty upon delivery to me) and 3) to "look" over the car. 1 and 2 I agree to, 3, is not acceptable. Although the car was Certified I have NO confidence that the car is mechically sound. I asked that MB of Huntington to cover the cost for MB to [redacted]o run the same inspection (different from a "look over") as the the Certification process. I have also asked for the MB of Huntington to refund me my entire shipping cost. Currently they refunded $200.00 so I am asking for the additional $400.00.Desired Settlement: I asked that MB of Huntington to cover the cost for MB to [redacted]o run the same inspection (different from a "look over") as the the Certification process. Review: Purchased a 2011 E350 Artic White sport mb Certified Pre-Owned in March 2014. Car was in an accident prior to my ownership (not reported to DMV until May 2014). It has been in the shop numerous times for leaks and driver and passenger window problems. Was asked if I would accept a "swap". I agreed for the same car that I purchased. Was offered a 2012 at considerable more money. Rejected as I don't believe this "swap" should cost me any additional money. Was offered a "luxury" vehicle which doesn't come close to the sport edition. It has been over a year since I purchased this vehicle. Have heard nothing from MB of Huntington in months. They are not even trying to locate a comparable car.Desired Settlement: Same year, color, model as I have or newer one with no out of pocket cost to me.
