Our records indicate the ISO representative called your business on or about October 18, 2016 to offer a new [redacted] and merchant processing services. Our records further indicate that a request for a [redacted] was submitted on or about October 20, 2016. Concerning your statement about the [redacted] ISO confirmed that our records do not indicate that we received an additional request for a [redacted] Had we received such request, we would have provided the requested equipment. For your review, please find the enclosed Free Equipment Placement Form on file. We strive to provide excellent customer service. In an effort to show good faith in resolving your concerns, MCPS will fulfill your desired settlement and has closed the account as of November 30, 2016 without penalty and will refund you the processing fees of $72.58 for October 2016. Additionally, as requested, MCPS will send a prepaid shipping label to your business address on file for the return of the [redacted]. We regret your experience and appreciate you allowing us to investigate these matters. [redacted] works with independent sales office (“ISO”), such as Merchant Services Partners, which refer merchants to [redacted] for card processing services. Therefore, we make every effort to ensure that ISOs and their representatives identify themselves when offering merchant services and we provide guidelines to such ISOs who offer such products and services. These guidelines include clearly identifying [redacted] and the products and services offered to prospective merchants. Please note that the sales office is not aware of which processing company or the account number a prospective merchant is currently using unless the prospective merchant provides a copy of their current merchant processing statement to ISO to conduct a rate review. Additionally, MCPS prohibits independent sales offices from implying or insinuating that it is a prospective merchant’s current processor.  MCPS considers any allegations of misrepresentation as serious matters and thoroughly investigates them in order to ensure compliance with MCPS requirements. According to our records, the ISO representative called your business on or about April 6, 2017 to offer a new EMV enabled terminal and merchant processing services. Although the representative disclosed that she was calling from Merchants Services Partners and was offering new equipment, there seems to have been miscommunication concerning who Merchant Services Partners was. MCPS values its merchants and potential merchants and wants to ensure they feel confident transacting business with us. In an effort to show good faith in resolving your concerns, MCPS has closed the merchant account as of April 26, 2017 and will waive the early termination fee. We consider the issues you experienced serious matters and as part of our investigation, we are addressing the solicitation and customer service issues with the ISO. Our records indicate that the sales representative at no time represented that he was associated with your current processor. The sales representative clearly states that he is with Merchant Service Partners. Additionally, all documents sent to Merchant also clearly identify MCPS. The Merchant had the opportunity to review the documents provided and ask MCPS and/or Merchant Services Partners any questions. The Merchant signed the merchant application on August 1, 2016. We regret your customer service experience with ISO and will reach out to ISO to address the length of time it took to address your concerns. Furthermore, in an effort to show good faith in resolving your concerns, MCPS has closed the account without penalty as of January 25, 2017. Additionally, MCPS has refunded you the monthly processing fees for October 2016 and November 2016 totaling $231.80 as of January 25, 2017 and you will no longer be charged any additional fees. Please be advised that upon account closure the Agreement between Merchant and MCPS is cancelled and you no longer have any financial obligation under the Agreement. I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me. I do want to clarify that they presented themselves as [redacted] and not Merchant's Choice.  [redacted] which is our bank, also has a Merchant Services and this is what caused all of the confusion. Also,  I never received a Merchant Resolution Form and this was never mentioned.  I was emailed a Contract Confusion Form .  It was not explained that the [redacted] was an equipment swap.  The salesperson, [redacted] stated that our "bank card processing machine was out of date." I would hope in the future when they are contacting other customers, that the please clarify that they are Merchants Choice and process through [redacted] Sincerely,[redacted]

We regret your experience and appreciate you allowing us to investigate the matter. We consider the issues you experienced serious matters and as part of our current investigation, we are reviewing this issue and will implement any necessary changes.
Our records indicate that on or about August 20, 2015 you contacted the independent sales office, Merchant Choice Payment Solutions Partners (“ISO”) regarding a $95 set-up fee. Our records indicate that on August 21, 2015 MCPS refunded the set-up fee to your bank account. Our records indicate that you contacted ISO on or about August 28, 2015 regarding off-season fees. At such time, ISO offered to place a request to review your monthly service fees during the off season.
Additionally, our records indicate that on or about September 21, 2015, you contacted ISO inquiring about the cancellation of your merchant account due to fees. According to ISO, ISO offered to refund the monthly service fees for September 2015 and the overdraft fee of $30 if you honored the terms of the agreement for the three year initial term. Our records do not indicate whether or not you accepted ISO’s offer.
Although ISO has attempted to resolve this matter with you, in an effort to show good faith in resolving your complaint, we will refund $174.95 and your account will be closed as of December 14, 2015.

We regret your experience and appreciate you allowing us to investigate this matter. MCPS works with independent sales agents (“ISO”), which provide card processing services to merchants. According to our investigation, you entered into a Merchant Payment Card Application/Agreement (“Agreement”) with MCPS on or about March 26, 2015. Our records indicate that you contacted MCPS on or about February 10, 2016, to inquire about cancelling your account. At such time, the customer service representative transferred the telephone call to your independent sales office for further instruction. Our records also indicate that ISO attempted to reach you on multiple occasions; however, on each follow-up attempt ISO did not receive a response and left a voicemail message. Per our records, we have not received a written notice of cancellation from you despite the various telephone calls. Had we received such letter, your request for closure would have been completed promptly.  MCPS values its merchants and wants to ensure they feel confident transacting business with us. In an effort to show good faith in resolving your concerns, MCPS will fulfill your desired settlement and will honor your request to cancel as if the written notice to cancel had been received on February 10, 2016. As such, MCPS will refund you the monthly service fees assessed subsequent to that day which includes the monthly service fees for March 2016 through June 2016 totaling $241.60 and will waive the monthly service fees for July 2016. MCPS does not conduct business as was described. MCPS works with independent sales offices (“ISO”), such as Merchants’ Services Partners, which provide card processing services to merchants. Therefore, we make every effort to ensure that ISOs and their representatives identify themselves when offering merchant services and we provide guidelines to such ISOs who offer such services. These guidelines include clearly identifying MCPS and the representative and the products and services to prospective merchants.
MCPS prohibits independent sales offices from implying or insinuating that it is a prospective merchant’s current processor and prohibits the use of scare tactics to sign up new merchants. MCPS considers any allegations of misrepresentation a serious matter and thoroughly investigates them in order to ensure compliance with MCPS requirements. As such, we requested information from ISO about the merchant solicitation. Our records indicate that the sales representative at no time represented that he was associated with your current processor, [redacted]. The sales representative clearly stated that he was with Merchants’ Service Partners. Our records also indicate that the sales representative offered the Merchant an [redacted] capable terminal and informed Merchant that their current terminal was not capable of processing [redacted] transactions.
Additionally, all documents sent to Merchant also clearly identify MCPS, including the Merchant Payment Card Application/Agreement. The Merchant had the opportunity to review the documents provided and ask MCPS or ISO any questions. The Merchant signed the merchant application on January 25, 2016 providing consent to open a merchant account. Enclosed is a copy of the signed merchant application with the MCPS name and logo clearly and boldly displayed.
Please note that MCPS sends the monthly merchant account statement to the business address on file and our records do not indicate any returned mail, correspondence or inquiry that the Merchant had not received their monthly merchant statements.
In an effort to resolve your concerns, as requested, MCPS has closed the account as of April 18, 2016 and will waive the early termination fee of $495. As such, you will no longer be charged any additional fees. Additionally, as requested, MCPS will refund you the monthly processing fees for January 2016 through April 2016 totaling $361.06 and will send a prepaid shipping label to your business address for the return of the [redacted] Pin Pad.
