Good AfternoonWe looked at the information we had for this claim and were unable to have concrete facts that the other party hit your vehicle. I'm sorry you are unhappy with the results but with out any independent witness's to the loss we can not just accuse someone of being responsible for damages they are adamant they did not cause. This is a multi-vehicle loss where we have a Property Damage limit of $10,000.00. To date we have an excess Property Damage exposure to our policy and the damages will be pro-rated between all parties. The inspection of *** *** vehicle indicated that her
preliminary damages totaled $911.12. The other party’s insurance carrier initially reported that their subrogation amount was at or near $30,At that time, we were still waiting on their subrogation demand in order to calculate the pro-rata offers to both parties. *** *** was notified of our limits issue on 8/9/and was advised to mitigate her damages with her carrier and that Mercury would offer a pro-rata amount to her carrier once all Property Damage amounts were known. We were then advised that *** *** did not carry collision coverage to resolve her damages with her own carrierOn Friday, October 20, 2017, the subrogation amount from the other party’s carrier was approved, and we are now in a position to extend pro-rata Property Damage offers. We are in the process of sending our pro-rata offers out to both parties along with releases to be signed and returned by both parties. Once we are in receipt of these releases, we will be in a position to issue the settlement checks. Tell us why here

The above listed complaint has been resolved and the total loss of the customer vehicle has been paid. Our official response to the complaint is attached above

A renewal offer was mailed to Mr*** on 4/1/to be effective 5/1/16. Mr*** had set his policy up for automatic withdrawals by signing a form that states that the Company needs business days to stop a debit from occurring on a policy. Mr***'s renewal payment was deducted on
4/29/and we have no record of him contacting the company until 5/3/to sign a request to cancel coveragesPolicies are canceled effective 12:01a.mthe day following written receipt of the request to cancel and we use a short-rate table rather than a pro-rate table to calculate the refund any time a policy cancels prior to the expiration date. The only time we do not use a short-rate table is when we initiate the cancellation for underwriting reasons. This is a cancellation fee equal to 10% of the unearned policy premiumBased on receiving the signed request to cancel on 5/3/from the customer, the policy was canceled effective 5/4/and the refund of $is correct. No further refund is due to the customer at this time

The reason my tow from Road America Towing was canceled was due to a minute wait to get a Tow truck to the scene of the accident, which was blocking trafficNot to mention, they would have towed it an hour drive away from the scene of the accident.The police officer was nice enough to arrange for a free towIf any Mercury agent had taken a minute to give me a phone call and find out how I was doing or what had happened, they would have found that the car had been towedWhy didn't anyone see that the towed had been canceled? Did anyone care to see if there wasn't a car in their yard?Those loss of two days waiting for Mercury to get their act together essentially cost me addition days because of aforementioned negligenceIf anyone from Mercury had made just the slightest effort to look into my case the day of the accident, the car would had been towed two days earlier

We have reviewed Mr***'s complaint and have forwarded it to a manager at *** which is the roadside assistance company that Mercury contracts with for further information and have asked them to contact the customer directly

As stated previously, the Company welcomes Mr*** to submit proof that the Acura was sold or insured through a different carrier prior to the cancellation of the policy June 23, to possibly backdate the removal of the Acura

This is a disputed loss in which Mr*** vehicle was struck while it was parked and unoccupied. The Mercury Insured driver continues to dispute fault, but the property damages exceed our insureds policy limits. We have made pro rata property damage offers to the vehicles
involved in the loss. Of the property damage exposures, we have only received a signed property damage release from Mr***. As we have previously explained to Mr*** and in order to fully protect our insured, we typically require that all of the signed property damage releases for the pro rata amounts be returned before resolving any individual claimant. However, we've recently discussed the situation with the Mercury Insured, who has agreed to resolve Mr*** claim based on the signed property damage release we've received from him. The property damage check will be mailed out on Tuesday, Feb6,

As previously stated, the amount we deducted from the insured's current policy was to satisfy an outstanding balance on a previous policy. This was premium that was fully earned and therefore, will not be refunded
