Issue #1 Our new next door neighbors are just about ready to move in. They have expressed wanting to share in the cost of the fence going between our houses. Meridian Fence has not provided us a break down of what our gate, side and shared fence fees are.
Answer:  Because this bid was ran through the builder, if a break out is needed they need to contact the builder for that information.
Issue #2 * to [redacted] and fencing pulled a plot map as the rebar post was not accurate and had been moved around. They took measurements off of the property plot and there is more than a 3.5" discrepancy. This validates our original concern that Meridian Fence did not put the fence down the middle, and did not due their due diligence in verifying our actual property line. So in essence, we have lost almost 6 inches. 
Answer: Fence companies work with what they are given.  We are not given plot maps by the builder.  We do not move pins or rebar.  If the pin was moved, it was not by us.  If the pin was in the wrong place from the time we showed up, it is not our fault. There would be no reason to think that the pin was wrong and the line was wrong.  You could place blame on the surveyor, excavator, foundation company, [redacted], etc.  Typically the fence company is the last one to do work and if the pin is out of place, it could be for several different reason.  It is not our job to verify if the pin has been moved.
Issue #3 I did call [redacted] fence and 2 others before filing the complaint, as well as speaking to [redacted] with * to * fencing who all validated that when putting a fence in a neighborhood with common shared good neighbor fencing you always go down the middle, regardless of who called first to have the fence installed. Answer:  First of all, I would be careful in the frequent use of * to * name ([redacted]) because when it comes to industry standard, he is on the opposite end.  Probably not a source you want to be referencing.  Feel free to call the owners or [redacted] and Boise River, two of the largest fence companies in town and they would be happy to explain to you why we don’t split lines.  If that doesn’t work, here is a quote from a very respected local real estate attorney on this situation:
“[redacted] - I know you know this already but, in addition to potential criminal trespass charges, under Idaho Code Section 6-202, you cannot trespass on someone's property
without their consent, otherwise, you could be held liable. This includes the construction of a fence. When you are constructing/installing fences, they need to be on the
client's property, unless you have the neighbor's consent. [redacted]” ----[redacted] Legal
Issue #4 Meridian fence did not try to contact us as stated; I have the phone records to prove otherwise.
Answer: Please provide the phone records I would like to see them.
Issue #5 I NEVER threatened to sue them, let alone several times. I conveyed my concern in their unwillingness to address our concerns, return our phone calls and stated that if they were unwilling to try and work this out, I would seek legal counsel as to my rights as a consumer
Answer: Not True.  I have office staff who say otherwise.Resolution:  I am not willing to move the fence or give any concession.  I am not sure why this situation is so hard for the [redacted] Family to understand.  I was never told by [redacted] to split the line.  If I was told by [redacted] to split the line I would have told him the neighbor would need to sign a contract stating it’s ok to do so like I have done a million times.  The neighbor was never even mentioned or even a possibility that they would split the cost.

Again, Meridian Fence did not disclose that putting 100% inside the calling parties property was their common practice, nor is it on there paperwork. My husband stated he wanted the fence down the middle and we were not home when they installed it; therefore we did not point out where to put it. We trusted them as the professional to do the measuring. With regards to the other side of our fence, it is irrelevant to this concern. I personally had not spoken to the fence people, but I know our neighbor told them not to tie in. Since that was there wishes, we respected that; Again, although Meridian Fence brought this up, it is not what our complaint is in regards to. It is not an issue regarding our builder, it is solely an issue with Meridian Fence not verifying our property line. 
We are still requesting that Meridian Fence pay for moving the fence to the accurate property line per the property plot map. The fence company installing the new neighbors fence is willing to move the fence, Meridian fence did not try to contact us as stated; I have the phone records to prove otherwise. I NEVER threatened to sue them, let alone several times. I conveyed my concern in their unwillingness to address our concerns, return our phone calls and stated that if they were unwilling to try and work this out, I would seek legal counsel as to my rights as a consumer. 
We are in a tough spot right now as our neighbor is needing to tie into our fence, but neither one of us want to move forward knowing our property line is not in the right place.

Complaint: [redacted]I am rejecting this response because: Just got back in town today. Not satisfied with their response. They obviously have no intention to work with us to come to an agreement suitable to both parties. We paid in full up front prior to work being done as good faith.  Lesson learned to wait till work is complete. I don't fee this process has helped, but appreciate the opportunity to voice our disappointment with our services with Meridian fence. Sincerely,[redacted]
