The quote that I received by Mr. Merino to back-fill dirt, quadrupled after I obtained the permit. I found another company to do it for 1/3 less. Mr. Merino does a poor job, and then tries to strong-arm you into to paying an outrageous cost to fix their mistakes. The dishonest and pathological lying of Mr. Merino should not go unnoticed. I can provide documentation for all of my claims, Mr. Merino just makes false claims. It is not my fault that they didn't file a permit, had to tear down the wall, had to rebuild around the tree (when I gave them the option of removing it) when it wasn't circular, had to rebuild a window well brick because it was too shot. Everything, as I can document with pictures and a tape measure is off. If you take your car into a shop for spark plugs replaced, and they only replace 5 out of the 6 but wash and vacuum the car, the shop failed to do their job. Thank you for inquiry into this matter.  We began on the project with a contract with the client to build a 30-36” wall, front entrance steps, landing, Wrough Iron Handrails, basement stair case wall, and flower bed.  Given that we found out we needed a permit for the retaining wall.  We informed him of a problem and rectified by getting permits and architectural drawings as needed.  He recognized that we had made a mistake and was disappointed but we were making all things to rectify the issue.  Even though we estimated for a 36” in retaining wall which didn’t require a hand rail.  We absorbed the cost for permits, architectural drawings (cost $1,830).  In addition, the client at that point wanted a higher wall, in which we complied and didn’t charge him for it.  So instead of a 36” wall, it become a 60” wall, which was almost doubled.  All this without asking for any more funds. During the time of acquiring the permits, we asked the county if such retaining wall required handrails in which they responded that it wasn’t required.  I informed the customer in regards to this and they agreed to continue. We also, made an additional wall next to the basement staircase, which he stands that it’s not squared.  We disagreed, but told him we could take it down or we would fix the small gap in the stairs.  He stated that he could live with the wall but wanted additional work done for free.  So, we agreed that we would fix some cracks on his driveway and resurface his basement stairs at no additional cost.  Additional free items: were free installation of front door fascade and pediment, removal of downspout and rechanneling drain, lay brick around tree, paint removal from brick, and much more (Cost value $1,800+), The retaining wall pass all inspections but at the end the county inspector stated that the wall now needed a hand rail in the newly built retaining wall.  We gave the client a quote for that and he proceeded to state that it’s our fault that we didn’t warn him of that problem.  So, now he wants us to do the work for free.  The client knows the amount of work we put into this project and amount of money lost and have yet to recover.  In addition, this client allowed us to finish the remaining work on the contract, added some more items and then said that he will not pay us for the remaining balance ($1,300.00+) as to somehow hold us hostage to that amount.  So, he let us finish the work so he can in turn, start discrediting us to get work done for free.  It is a shame that this client will go to this length to try to discredit us, when we have gone far beyond what is expected of a contractor and even lost money on this project.  We acknowledge we made a mistake, but we did what was asked to rectify, This client is a person that took a mistake to his advantage and got to get things done for free.

Review: This complaint is concerning Merino Home Improvement (###-###-####, MHIC License No. [redacted] | Certified MBE No. [redacted]). This pertains to Mr. Adan M[redacted] and Mr. Jhonny M[redacted]. For simplicity I will break down the complaint into 3 main areas. Area one consists of failure to follow codes and regulations, area two is poor craftsmanship and area 3 is failure to complete the contract.

I. Failure to follow codes and regulations

a. Miss Utility

i. Mr. Jhonny M[redacted] requested that I call Miss you utility:

1. Exert from email sent on 6/3 : “#1 I went to call 811, or fill it out online. When I was about to fill it out, it said that the contractor needs to fill it out if I hired someone. I don't mind filling it out, but I am just afraid that if they see read the work description they will know a contractor was hired. Just left me know if I should proceed. In case something does happen I don't want to cause issues.”

2. Response: “#1. You don’t have to say anything regarding hiring a contractor. You can just tell them you have a project in mind and would like to know what is behind your house. You just want to have a peace of mind nothing is behind there. That is all. “

3. This is a clear violation of Miss Utilities code and Ethics code of a Contactor: “Homeowners may NOT contact Miss Utlity and obtain a locate request for someone else (contractor or professional excavator) will be doing the excavation. It is legally thwir responsibility to obtain their own excavation ticket” from http://www.missutilitydelmarva.com/Homeowners/

ii. Failure to file permit for 5 foot retaining wall

1. Mr. Merino started building the retaining wall on 6/17. Material was delivered, cement was poured and 2 rows of cinder block were laid. Mr. Merino then reported that Cheverly Code enforcement red flagged them for not obtaining a building permit.

2. Mr. Merino blamed the town for the incident: “Sorry to bother you while you are on vacation. We have some bad news. As we started to work on the retaining wall, we started to get material delivered and soon thereafter, the city code enforcement came by and we got red flag while in construction. What this means is that we have to get some drawings done for the retaining wall since its more than two (2) feet high. Also, this means we have to go and pull some permits. We have to do this soon, as it will be shared fine if we don’t do it. I believe is $1,000 for you and $1,000 for us as well. I have attached a form that will allow us to get this started and hopefully try to solve it sooner rather than later. I know this is not what you would like to hear but as of now, we can’t move along and all the material is at the house already, and just needs to get worked on. Please let me know if you have any questions but we are working hard to get this done but unfortunately, this type of things are going to happen, specially in lovely, Cheverly.”

3. Mr. Merino assured me that the wall was to code, however it was not and their work had to be torn down, more concrete poured, as well as rebar added. Had Cheverly code enforcement not caught them, I would have a wall that was not too code an illegal.

4. Mr. Merino will argue that they were building the wall correctly but once the height changed, however the original contract said a “30 to 36 inch wall” – That is clearly above a 24 inch wall, and would have required a permit; which they did not obtain!

5. Failure to pass inspection. The height of the wall is too high.

a. When we saw the height of the wall we questioned Mr. Merino about it, and how we did not want a railing. Mr. Merino assured me that we would not need a railing because his Engineer and Prince George’s county said we didn’t need one. It is pretty clear in the code that anything over 30” needs a railing. As a contractor they should know this. After we were told we need a railing, we looked for alternatives. Mr. Merino gave up and I ended up going to DPIE and getting a re-grading permit. Mr. Merino quoted me 900 to re-grade before I received the permit, but then upped it to over $3000.

b. Breaking a written contract – Mr. Merino stated on July 17th, in writing : “In addition, we recognize that is our fault and we will cover anything additional cost to the project. We are going to be set back on our time line but hopefully not too much to burden you guys. Again, our apologies and we will make sure you are satisfied at the end. Again, sorry for the inconvenience.”

iii. Failure to file permit for replacing retaining wall around basement stairs.

1. No one caught that this was happening, but the height of the wall is 7 feet and it is 8 feet wide. Based on DPIE a permit was needed to erect this wall.

2. This was built crooked (photos below).

II. Poor Craftsmanship

a. Shutter Installation

i. The shutters are already pulling away from the house

b. Flower bed retaining wall

i. The wall is built crooked; the mortar was not cleaned and different colors of mortar used. (under 20” on one side; 21” on the other)

ii. The wall’s mortar is inconsistent; again mortar not cleaned.

c. Front Stoop

i. Built off center. (Railing to edge of façade is 15” on one side and 14” on the other – this causes even more problems later on)

ii. Not Square (41” on 1 side and 40” on the other)

iii. Bricks are set crooked.

iv. Threshold bricks are crooked

v. New railings are painted and chipped

vi. Different color mortar used throughout (can be seen in above pictures)

d. Façade

i. Built crooked – molding spacing at top is 3” at the bottom is nearly 4”. Please note this is only on ONE SIDE of the threshold. This happened because the stoop is 1 inch off center!

ii. Not fully patched and painted and hydraulic door arm mounted on a none-supporting medium. You can also see nail holes throughout.

iii. Material not fully cleaned and was labels were painted over rather than removed.

e. Front Door And Storm Door

i. Front door does not latch properly

ii. Storm door is missing a piece, will only latch if slammed and is mounted to a non-weight bearing material (picture seen above)

f. Not only is the side slanted, the trim above the door is ¾ of an inch slanted as well.

g. Rear Door

i. Re-door was re-finished and all of the glass was scratched during the process.

h. Window Boxes

i. These were originally built at different heights. That was “corrected”; but different color mortar and sub-par masonry work was done. To “fix” the problem additional mortar was added, so they now look different.

ii. Different types of bricks were used.

i. Retaining wall

i. Originally attempted to be built without permit.

1. Got caught my Cheverly Code enforcement

2. Failed inspection and had to be torn down (footers were not large enough to hold the weight)

3. Failed final inspection due to height – need a railing. We spoke about this several times, and told them that we wanted to wall lowered if a railing was required. They told us it was fine and that their engineer agreed. At this point, since we don’t want a railing, we are going to need to spend $3000 to backfill the bottom of the backyard. Mr. Merino originally quoted us 900, and then changed it to over $3000. Mr. Merino was unable to obtain a grading permit, and thought I wouldn’t be able to; however I was able to. That is when the cost rose substantially.

4. On June 17th after the stop work occurred Mr. Merino sent this email “In addition, we recognize that is our fault and we will cover anything additional cost to the project. We are going to be set back on our time line but hopefully not too much to burden you guys. Again, our apologies and we will make sure you are satisfied at the end. Again, sorry for the inconvenience.” Since the wall has not passed inspection, they have not done what they have said.

5. Constructed the wall visually incorrectly – visually we should not see bricks.

j. Retaining wall steps

i. Steps were built crooked and not to specifications. When first request was made to fix them “We are fine with the 44" landing as long as you can fix the crooked top steps. If fixing them means re-pouring at 36" inches, that is fine too.”, Mr. Merino’s response was “Yes, we will make sure all that is corrected. We also have to build a small wall along side the bottom steps but it will go with the same layout as we have it at the moment.” As can be seen below the steps have not been fixed properly.

ii. The step below it is also not square.

iii. The entire length is off

iv. The lower wall does not even align with the steps – the other side is flush.

k. Basement steps

i. Built without a permit.

ii. Not square

iii. It is crooked

iv. This created a 3“ gap at the top of the steps. To fix it, the gap was filled in with concrete and the entire thing was supposed to be resurfaced. Clearly it wasn’t done well. Again the brick was uncleaned.

v. A new storm door was installed, but all the old storm door trim was left.

III. Failure to complete contract

a. As seen above, none of the brick was cleaned properly. Finishing the job would mean cleaning the brick.

b. As seen above there was very poor craftsmanship for masonry and carpentry work. Nothing is level, nothing is square.

c. As seen above the basement stairs were not refinished completely

d. As seen above the retaining wall steps have not been fixed, and I have in writing they would be fixed.

e. As seen above the façade has not been patched and fully painted.

f. As seen above the trim on the screened in porch door has not been removed.

g. As seen above the oral contract to fix the bricks in the retaining wall have not been remedied.

Contract:

1. As you can see, we made good faith payments of 12,500.

2. Of the 13 labor items listed above; only 1 was done correctly and completely (replace wood attic window)

3. The Invoice also lies about Courtesy labor for the Door Façade and Pediment: April 11 email :

1. The front door façade comes included in the price of replacing the front door with the landing.

2. I terribly sorry about that. The brick flower bed was missed in the estimate but it will be $998 extra in that estimate. I can send you another estimate that includes that in there as well.

4. When attempting to get Mr. Merino to finish the job; his response was:

“Most of the issues that have raised again were resolved with other work done at no charge to you. I didn't think that you would consider not paying the rest of the amount. Yes, we have lost a lot of money on this project. We have done our best to make sure you have what you wanted. At this time we no longer have any budget to go back and do anything else in your household. If you don't wish to pay, that is a shame and didn't think you would do that. A lot of what we have done to your house wasn't even written in the contract and have done it out of our will. However, you haven't taken that into consideration. We did all we could to remedy your preference, but as often the case with old houses, it's not going to be perfect as you wish things to be. At this point, we will send you and invoice for the remaining balance and if you don't wish to pay at that point, we can solve it in a different manner. I hope you would reconsider your stance and pay us what is owed.”Desired Settlement: At this time we are withholding the last payment of 1332.

I am asking for an additional $3668 refund for a total of $5000.

The estimated cost to fix the problems that they have left me with exceeds $8000.

We did not ask for the wall to be lower. I can paste 3 emails concerning the height of the wall. I can provide an affidavit from my neighbor who over heard the conversations of the wall. c. NO FINAL WALK-THROUGH WAS DONE. They just LEFT and sent an e-mail saying they were done and wanted money.d. We DID NOT WANT the brick around the tree done; that is why we didn't ask for it originally; we have been told by an arborist that the tree is very unhealthy and may not make it.e. The quote that I received by Mr. Merino to back-fill dirt, quadrupled after I obtained the permit. I found another company to do it for 1/3 less. Mr. Merino does a poor job, and then tries to strong-arm you into to paying an outrageous cost to fix their mistakes. The dishonest and pathological lying of Mr. Merino should not go unnoticed. I can provide documentation for all of my claims, Mr. Merino just makes false claims. It is not my fault that they didn't file a permit, had to tear down the wall, had to rebuild around the tree (when I gave them the option of removing it) when it wasn't circular, had to rebuild a window well brick because it was too shot. Everything, as I can document with pictures and a tape measure is off. If you take your car into a shop for spark plugs replaced, and they only replace 5 out of the 6 but wash and vacuum the car, the shop failed to do their job. It is unacceptable to do lousy work and say you did other work for free.f. No offer was made in resolution to the case.

We will not be going back and forth with this individual. He has done enough damage to our company and still seeking retribution.
