Hello:As we responded earlier we had forms attached that the customer signed which stated the vehicle was "as is" meaning they inspected the car and test drove it before buying the car. The customer drove the car hundreds of miles and then started complaining. When we sold the vehicle there was nothing wrong with the car. My manager was willing to help the customer out and pay half of the cost out of his pocket and get him our discount at the shop to get what ever he needed fixed. Customer signed multiple documents that stated vehicle was sold as is. If you need us to provide the documents we will be happy to.Please let us know if there is any way we can help.  Thank you

HelloI am responding to the complaint we received. first of all [redacted] did not purchase the vehicle from us it was [redacted]. The customer test drove the vehicle, viewed all the reports and a VA inspection and also inspected the vehicle before driving it off the lot. there was no problem with the...

vehicle at all.  This is a High line car, its a [redacted] and there is no manual way to turn any signs off or buttons off the display. If there was a problem when the customer test drove and inspected the car they would have seen it. we have the documents attached to "As Is" sale. Customer reviewed and signed multiple documents stating they are purchasing a used "AS IS" vehicle. (please see attachments)the customer was suppose to get a MD inspection and provide us with a copy in order for us to get tags for them in ten days. We did not get that as well. [redacted] spoke to one of my sales reps who was willing to pay out of pockets just to help them out. we go above and beyond for our customers. I am rejecting this response because:Although, the complaint was made verbally over the phone, and the contract stating I inspected the car there was no spare tire in the car. Calls to Alex (owner), B[redacted]r (service manager) who was trying to sell me the tire. Alex told me that Walter (car manager) and Steve U** were going to send a check that reimburse me for the spare tire. Alex (manager) told me to text my address so that he would be able to send a check for the cost of the spare tire. The dealership inspected the car before I received the car. I inspected the outside of the car, but not the trunk area until the car was at my home. When I brought it to their attention Mr. B[redacted]r said that we can sell me a tire or it need in writing. However, when I contacted the Alex (owner) promised me that he will get the two to reimburse for the tire. And a promise was a promise stated by Alex. The contact numbers in the message are the numbers from the shop, and not Alex's phone number (personal). His number is ###-###-####, if he has not changed it by now.

In
response to Merlex Auto Group, when I walk into the location I already knew I
wanted the [redacted] priced at $11,through [redacted]'s price
protection certificate program, the car dealerships website and then the car
window's sticker price. There
website also states guaranteed financing is available; however it does not
state includes bank fees. As a
result of my credit situation, I took advantage of the alternative financing
provided by the dealership.
As far as signing the contract I
was told the reason why the price changed from $11,to $13,was due to bank
fees. After the car was totaled,
it was discovered that the sales price sent to the bank was $13,not
$11,500. I inquired with the
dealership regarding the difference in the sales price and was told the $13,
was the financing price and $11,was the cash price which is not stated on
the website, sticker price, [redacted] price protection nor the contract. Thus the interest on the loan was added
to the price of $13,and not $11,500.
In addition, the contract reflects all other processing fees, taxes and
warranty charges along with the GAP coverage, but did not show bank fees
The attached documentation includes
a copy of the web page listing the sales price of the vehicle I purchased as
$11,and as well as another [redacted] (same make and model) priced at
$13,966. It is my opinion that the
sales prices of the two vehicles got mixed up. Additional attachments include purchase order and the [redacted]
price protection certificate.

I am rejecting this response because:We took the truck home and we drove it the next day which was a Sunday the light for the suspension system came on, I took the truck back that day and that's when they told me to take it  to shop to get the work done. then the guy at the shop called and told me what it was going to cost to fix so I went pick it back up. we drove the truck from his dealership to our home and then back out to the dealership, right now the now the truck has been sitting because on the way back home the check engine light came had the code checked now we are looking at over 2K more to fix this truck,when is it so that you take a vehicle home one  night and he's saying all this stuff wasn't there, I'm trying my best to this the right way but I don't think it's fare that he write and lie about this,my wife and I love the vehicle just don't like that we'er lied to make the sale,  just tell what I can do other then this to fix this problem without me getting in trouble.

multiple documents that the vehicle was being sold "As is" condition. 1. [redacted] was given the 3 month warranty as a curtsy from Merlex Auto Group. When he returned to us 3 months later the warranty had already expired. It was a 3 month warranty which was active from the date of purchase. We use a thrid party vendor and [redacted] was told that his three months had expired. 2. This was a Non-Negotiable deal-Which was explained to the customer. the title was perfected and sent to his bank so they could request state to state transfer. He did not Pay us any sales tax to do his tags for him. He had a lien holder and he signed the contract saying he will pay his own taxes. We have fulfilled our end of the contract. [redacted] came to Merlex Auto Group on January 14, 2017 to purchase a 2008 [redacted]. Due to her credit not being strong enough and would not qualify for this particular unit, she decided to use her father [redacted] and finance the vehicle under his name. As you see on Ex. 1 she...

agreed to purchase the Vehicle for the amount of $25,966.00. The price was including fixing the item that she had concerned. We finalized the deal, [redacted] signed all the documents and we sent the package to the bank. Two days later, we received a call from the bank stating that [redacted] called the bank and cancelled the loan. We contacted [redacted], she advised us that she did cancel the loan with our bank and she will pay cash for the vehicle. On January 18, 2017 she came in, she had a check with a sale's price of $23,866.00 which is $2,100.00 less. (Please see Ex. 2). We agreed with the numbers and when she asked for the items to be taken care of we told her we cannot fix anything on the vehicle. We advised her when the numbers changed, the condition of the sale changed as well and now she is she is buying 100% "AS-IS". (Please see Ex. 3 and Ex. 4 and we also refer you to Ex. 5 paragraph 3). As a courtesy to [redacted], we advised her that we can address her issue to the shop that we do business with and if she decided to get the work done, it would be at dealer cost, which means she will pay for it, but she would get to use our discount. We refer you to EX. 6. She complained to other social media, and she stated that she got tricked by the dealership, but we believe it is the complete opposite. First she agreed on the price including fixing the item, later on she wanted to pay $2,100.00 less and still get the items fixed. At this point, we can only do what has been put in writing and signed by both parties that she purchased the vehicle in an AS-IS condition. We are not going to be responsible with any issue with the vehicle, but as a courtesy, we are willing to let her use our discount with the shop that we are doing business with. We are responding regarding the above complaint.As we stated in our previous respond we need a copy of a cleared check from the GAP company in order for us to make the refund to the consumer. for any GAP cancellation the consumer has to contact the GAP company and request a cancellation. The GAP...

company will then send us the check for the refund which we deposit into our account. Once the Check clears then we cut a refund check to the consumer.At this moment we do not have any records of any cancellation check being sent to us from the GAP company and has not been cleared in our account. Here are photos of the  warranties that were suppose to cover the vehicle, but were never submitted to the Penn warranty cooperation. I have spoken to several different reps at the business that told me that I never had and account with the company.

I am rejecting this response because: let me say this first off when I was they are you can say all the features were shown to me if you'd like but you would be lying in the reason being is because that Trump was never open while I was there and you know the reason why is because if you had to explain to me that the remote that came with the car want to open the trunk I probably would've changed my mind. Also if you don't think I know what I'm talking about and that apparently I was giving the correct remotes call the  [redacted] dealership that I went to and listen to what they have to say. Also I read reviews on your business before I came down there which was 3 1/2 hours away  and you know I tried not listening to them because I liked your inventory but now I probably would've been better if I would've listen to people  on there because apparently they were correct. So anyway I knew there would be nothing that you would do for it but just thought I'd give it a try but I will make sure that this case is publicized   And also I had my review to the Internet as well.  And another thing because if you're smart comment about if the customer had had any issues he should've called within the 30 days I work every day that's the reason why I bought the car so when I don't get a chance to take the car immediately to a dealership I don't really think that's my fault but when I did get a chance to take it there it when I find out about all the issues that you should've fixed before you sold it.

05/25/2015Dear [redacted],[redacted] came to Merlex Auto Group on January 8th, 2015 & he was looking for a pricier luxury vehicle but due to his age and credit situation he was not qualified for that. We managed to get him qualified for the 2013 [redacted] at his interest....

Merlex Auto Group offered him a purchase order to get his own financing but he was not qualified for outside lenders. He asked the dealer if we could obtain financing for him. By [redacted] signing the purchase order where all the numbers prices and fees are shown and disclosed to him. He agreed to the terms of the matter. He signed all documentation. He was disclosed that if Merlex Auto Group was to get him financed, that there would be a charge. He agreed to those terms. [redacted] signed all documentation and took delivery of the vehicle. Merlex, as a promise to the customer, obtained financing for [redacted]. [redacted] stopped by the dealership about a month ago stating that his vehicle was involved in a collision and that the insurance company will only give him a certain amount for the vehicle. The fact that [redacted] did not agree to purchasing GAP insurance through the dealership after we offered him one means the dealership cannot do anything about that situation. [redacted] is responsible for the difference in the amount of the payoff to the bank. Due to the mistake he made 5 months ago to not purchase the GAP he decided to show up not too long ago and make a complaint. He has been advised and disclosed every number to the penny, line by line on the purchase order he was asked to sign. Merlex auto group discloses on all advertisement that any vehicle listed or advertised, the prices exclude taxes, tags, processing, and any other fees as you can see via the attachment to this letter.Respectfully,Merlex Auto Group

We are going to itemize this consumers issue one by one, and we will have an answer to you individually.1. Wife and consumer drove 7.5 hours to purchase vehicle in car they traded which Javier and Walter stated that they would hold the vehicle for them and when they arrived the vehicle they wanted...

to purchase was not on lot as well as the other vehicles they were looking at, however there was another vehicle for sale which was more expensive but had higher mileage.Answer - Merlex Auto Group or any dealership will not hold the vehicle with only a phone conversation with a consumer. Out of 10 appointments confirmed only 1 or 2 show up to the lot. Walter or Javier may or may not confirm with the consumer to hold the vehicle, but that is always under the condition to leave a deposit on the vehicle with the confirmation from both parties both consumer and dealership. In this case, there was not an earnest deposit transaction as well as a written confirmation. As they made it to the lot, the sales associate walked them around the lot to see if they liked something that they would interest in. They approached the vehicle that they mentioned and showed interest on it and after test driving it. they like the vehicle and they asked the dealership to obtain the financing for the purchase.2. Consumer states that there was not record of trade in sales transaction, but was put down as a cash deposit, also customer did not go through paperwork after purchase until recently. Time consuming for doing the transaction.Answer-We would like to draw your attention to Ex. 1 as you see on the Purchase Order. there is no trade vehicle and there was $3700 cash down payment. Time consuming concern, if this had been a cash transaction it would be much easier and faster process, but due to the fact that the consumer asked us to obtain financing. it would take much longer to go through the process because we have to submit to the lender and they have to do all the verifications up front before they can make any decision on the loan, so that is up to the lender and is out of our hand.3. Consumer states that there has been a number of issues with the vehicle since purchase.Answer-Vehicle sales transaction was an AS-IS transaction. Please refer to Ex 2. and Ex. 3, but on Ex. 3, paragraph 1 & 2 clearly states that Mr. Clark initialed that they drove the vehicle and satisfied with it and asked the dealership to obtain financing for them and also they understand they are purchasing the vehicle in an AS-IS condition. Ex. 4, paragraph 3 mentions that they personally inspected the vehicle and had the opportunity to test drive the vehicle and they were satisfied with the vehicle. Ex. 5 mentions that obligations have been fulfilled and any verbal agreements not made in writing will not be honored. The consumer did purchase an extended warranty and they did have the opportunity to address those issues with the warranty company.4. Merlex Auto Group said it's best to leave the plates from the trade in vehicle and we will turn in once deal is complete and finalized. Consumer states that they received violations 7 months after purchase and plates were never turned in.Answer-First of all, Merlex Auto Group will not take any responsibility for the tags for any trade in vehicle that come in that are included on the sales transaction, It is a consumer responsibility to take the tag and turn in to the local DMV. As we mentioned before, and we want to draw your attention to Ex. 1 on this case there is no trade included in the transaction. I have the documents attached that [redacted].the first document attached is the ad from our website that [redacted] viewed and signed and as you an see the listed price of the vehicle is $36,966. and a witness signed the ad. We do this to avoid any discrepancy in price later on. 2. The buyers order has the price and all the fees listed which was provided to the client before signing any documents. He had the chance to review and go over all the forms before signing them. 3. both registration forms have [redacted]'s signature and date which also includes the price on there as well. The $5k [redacted] provided was for the down payment because that's what he was approved for from the lien holder. All the copies were provided to the client along with warranty information. all of our vehicles have "As is" sign on them and are sold exactly as that.
