Merrill & Associates had completed the petition for a restructured mortgage for client's lender, however, Client decided that he did not want to proceed and apply for a restructuring of his mortgage and
asked us not to send in applicationWe complied and client was approved for a full refundWe have a complete maintained file of all contacts with this client and the amount of work that went into this file

We did not accept this person for representation and therefore, we have done no work nor received any funds for this person.  As a law firm we are bound by any and all confidentially privileges.  Therefore, as per ABA and state rules, any information...

[redacted] signed and went over with her attorney.  When [redacted] came to us she was 4 months behind and under threat of foreclosure.   It was explained to the client that the lender makes the final decision.  However, we are trying to reach [redacted] to discuss a refund of any funds still in escrow.

Review: I was contacted by [redacted] at Merrill and Associates with regards to handling a modification for my current mortgage. I told [redacted] that I was previously denied because my payments were with in guidelines, and my mortgage wasn't own by [redacted] or [redacted]. I was told that since my loan is an interest only and I'm paying 5.87% I would qualify because of the new laws and changes to the current program. I faxed my paystub, and copy of a mortgage statement and I was told that she will submit my information to make sure that I would qualify. I was also told that I would need to be at least two months behind.

The next day I was told that I qualify for a modification and for $2995, M&A can work with my lender. I felt since this is a law firm, there must be some truth to what they were saying. I was also advised the they often turn down customers with loans that wouldn't qualify.

I started the process in July, and by November it was evident that I was scammed as I got two denial letters from the mtg company for the same programs that I applied for on my own. M&A would not return my calls. I was told by [redacted] the lead processor that she would have the compliance representative call me, so far I haven't received any calls. I've left messages for [redacted] and [redacted] another processer and also a lady by the name of [redacted] who claims to be an attorney with the company. So far, no return calls.

I spoke to a [redacted], explained the situation and he said the office was closed, but he would personally reach out to the head processor and someone will call me. Never got a call or even an email response.

I'm now without my hard earn money and on the brink of foreclosure.Desired Settlement: A full refund of the $2700. paid.

Review: Merrill @ assoc contacted me in Feb 2014, stating for 2400.00 they would assist me with working to get a home loan modification thru Bank of America. I had tried this once before on my own with no luck. they told me because they were a law firm they knew the laws better than the consumer and could use that knowledge to work with the bank. I fell for it. I faxed all the documents they asked for. For the first 3 months my case was handed down from one person to the other, my documents never reaching the bank. In june [redacted] took my case. I made many calls to him, he never returned them. When he finally did, after I threatened to take action, he told me one of the people, [redacted], had been fired. I asked him why he didnt return my calls, he said he was out of the office, when in fact I was told one time he was in a meeting. On or about june **, he faxed my documents to BOA, to [redacted], they were incomplete. [redacted] said they were not., that he faxed corrected documents to [redacted] said he didnt have them., and that he, when talking to [redacted] was dishonest with him, and [redacted] didnt want him to be my representatve any more. The end result of me modification was I was denied. When I emailed [redacted] on Monday 7/**. he has not returned my email. They knew I would be denied. they didnt do anything I didnt do myself. They were dishonest with me. It should never have gone on for 5 months 5 months. The first 4 months little to no communication. I am out 2400.00 that I did not have/Desired Settlement: I feel I have been wronged thruout this process. I has caused me much upset, and worry. They did not do 2400.00 worth of services.

Review: I was contacted in May 2014 by [redacted] of Merrill and Associates (###-###-####) in order to refinance my current mortgage. Due to the property not meeting the current requirements for refinancing [redacted] advised me to complete paperwork in order to renegotiate my mortgage with [redacted]. I asked him on multiple occasions if this process would affect my credit or be reported as I do not want anything to affect my credit due to my current position as a Federal Employee with a TS Security Clearance. He advised me each time that it would not and even though I would be told that by the bank it is not true. In order to receive this benefit I had to make a payment of $3001.00 I was very skeptical as I had already been scammed once before but [redacted] assured me that if I did not receive positive results I would be reimbursed my money. As soon as I sent the money to Merrill and Associates I was contacted by my bank and advised that they were made aware of the situation if this process was to be completed they would have to annotate this on my credit report. I immediately contacted Merrill and Associates to terminate the process as I did not want anything to be annotated on my credit report. I was assisted by a [redacted] and a [redacted] They advised me of all the paperwork that needed to be filed and they also advised me that this would in fact be listed on my credit report. [redacted] again sent me an email stating that that was false. After I completed the proper paper work [redacted] advised me that my request for refund was approved and I should be receiving a refund shortly. This was still in May 2014. Since I never received payment in June I continued to send emails throughout July and into August 2014. I also called Merrill and Associates numerous occasions but [redacted] and [redacted] were never available I would only get their voice mail. I was advised also on many occasions by whoever would answer the phone someone would be calling me right back and that never happened. I have kept the email traffic and all forms I have sent in. I only wish to receive my refund as promised.Desired Settlement: I wish to receive my refund of $3001.00 and at least a phone call from the agencies management explaining why the lack of customer service and professionalism.

Review: M&A sent me a mortgage relief offer in the mail and I responded. As with many of these I checked it out hoping to get my interest rate lower. I do not qualify for refinancing because my house is underwater. My mortgage company hasn't been helpful so I felt that an attorney might help me take advantage of the low interest rates because they understand the programs better than I do.

I was upfront in explaining why I have not qualified for mortgage relief in the past: 1) I don't have the debt to income ratio to qualify 2) my mortgage is not [redacted] or [redacted] 3) I am not in foreclosure.

M&A assured me that they could help because two other criteria which ARE TRUE puts me into the "hardship" category: 1) I am underwater on my house 2) I have a 6.75% interest rate which is higher than the market norm right now.

I asked very pointed questions and searched the Revdex.com and internet for complaints before moving forward with them. They assured me that they would not waste their time on me if I did not qualify. I paid them $1,753.50 in two installments.

I received word from my mortgage company on Monday that I do not qualify for the loan modification because of my debt to income ratio. I called M&A and tried to discuss this and they said they couldn't help me. My grievance isn't that I don't qualify - I was surprised that I did. My grievance is that they lied and said I qualified for criteria that was untrue. They knew I would not qualify because they filled out the monthly expense form for me. I provided them supporting documentation for everything. They were very specific about this part of the process.

When I called M&A to understand how I was denied for the reasons that I was concerned about upfront, I was passed to the retention office and told that I would receive a callback in 24-48 hours. A coordinator left a message and said my file had been sent to her and she would be reviewing it. I have not received a call from the retention office and it's been 48 hours.Desired Settlement: I paid $3,507 because they "qualified" me as a candidate fully knowing I was not a viable candidate for a loan modification. I provided alot of personal information. I want my personal information securely destroyed and the money refunded.

Review: The above service has requested personal information to refinance our home with a lower monthly rate and cost. After sending information to them a call was to be made today to me to let me know what my options were. After no call came through at the scheduled time, I called every number that was given to me. No response or answer at any.

They also advertise that they are a Revdex.com member with an A+ rating. False advertising as well.

Review: This company told me that if I pay them $3000 they can get my mortgage reduced by $300 a month. I was up front and told them that I already had a loan modification on my property in December 2012. They told me that was no issues and I will know in a few weeks. The process started in February 2014 and just in August 2014, I found out that my request for a modification with [redacted] was denied. The reason was that I already had one in the last 2 years. [redacted] stated that I could reapply for a loan modification in December 2014. Since I have done a modification on my own without any assistance from any agencies, I would have NEVER used Merrill & Associates had I known that I could only have one modification per year. If I had not paid Merrill & Associates I would have been caught up on my mortgage. My home is currently in foreclosure due to this and I want to keep my home.Desired Settlement: They should apologize for giving me misinformation. Again had I known and been informed by Merrill & Associates about not being able to have 2 modification in 24 months, I would have never gotten into business with them. I was upfront about all information in regards to keeping my home. I would like my full refund back. I could have filed all papers on my own, like I did with the 1st modification.
