"I am rejecting this response because: The builder is now fabricating stories about drunken behavior, cost escalation, assaults, etc."If different people have observed the homeowner's habitual drunken behavior, how is that a fabrication In addition, while the homeowner was assaulting me, I actually dialed his wife on the phone and she heard the entire episode and heard her husband assaulting me Now, she is denying thisShe obviously has no moral compass whatsoever And I have invoices for every change order that was signed and approved by the homeowner personally so how can that be a fabrication "Builder has never provided any settlement statement, releases of liens, or a notarized certification of all bills paid."This is so ridiculous because the homeowner knows the day her husband assaulted me, I personally delivered a final cost statement showing all the changes that were initiated by the homeowner's themselves I left the statement at their home so this is another blatant lieAnd I won't provide a certification of all bills paid until you actually pay all of your bills This is clearly an attempt to get out of paying your bills I had intended to sit down and go over every line-item with the homeowner as I always have with every customer, before I was violently accosted by the homeowner and forced to flee "He showed up at our home on Friday, threatened my husband (police report filed with [redacted] Police Department) and said he "better have eyes in the back of his head" because he was "a dead man" I will never accept anything from him until he sits down at mediation He has refused all attempts to do such and instead has resorted to libel and intimidation."Regards, [redacted] This is simply laughable While I won't deny there was an adult-language-themed exchange between [redacted] and I, there were no threats made Perhaps a hearing aid would serve a purpose here When I passed by the house and [redacted] flips me off, you can bet I am going to respond Especially in light of his actions towards me already.I have stated I was willing to sit down and work towards a resolution but will not tolerate your trying to force me to do anything This is another example of your trying to bully your way through something again

Good morning, Here is my response to this: "This builder built my home in [redacted] He was over budget without suitable explanation or documentation, was two months plus late on the contracted completion date, unresponsive to requests for documentation of costs and payment to subs, and unresponsive to legal requests for mediation for resolution of the issue."This is categorically false: the homeowner made material changes to the architectural plans that caused the drawings to have to be resubmitted for approval from the historic commissionThis added months to the process Construction began at the end of February and completion occurred a little over months later The only amounts over budget were items initiated by the homeowner and agreed upon with a signed draw request identifying the change orders All signed by the homeowner "He threatened to abandon the project on multiple occasions because we asked for documentation of payment to subs, asked for written schedules for completion and legal releases from subs"The only times I warned the homeowner that I was upset, were the multiple occasions the homeowner brought alcohol to my jobsite I warned the homeowner on more than one occasion that if they didn't cease bringing alcohol to my jobsite, they would have to find someone else to complete the job The homeowner showed up almost daily under the influence and it was brought to my attention constantly that the homeowner was at site "drunk." A final bills paid affidavit was provided to the homeowner at their request"He did not provide the final accounting and held the property hostage until we agreed to pay the overages and did so under protest in order to mitigate our damages (temporary housing, moving twice, etc.)."I never held anything hostage, I very adamantly stated that until I was paid, it wasn't their propertyThat's consistent with every builder I know"He never completed punch list items (sealing of siding, replacement of locks he lost keys to, rekeying locks, completion of painting among others)."The truth of this is, that when I scheduled the punch items to be completed, the day I showed up, the homeowner drunkenly physically assaulted meI had to flee the property for fear the homeowner would do me physical harm I have a witness account of the homeowner attempting to spray tear gas at me as I hysterically tried to get into my vehicle I filed a police report and am pursuing charges against the homeowner for spitting in my face and assaulting me"In addition, he has advertising on his website which shows him to be a member of Greater San Antonio Builders Association (GSABA), Texas Association of Builders and the National Association of Home BuildersNone of these associations has any record of him being a current or former memberHis "***.com" webpage shows him to be a "multiple year award winner for GSABA Summit awardsGSABA has no record of him or his company ever winning an awardWe intend to forward this information to the Texas Attorney General's office as well for completion of a complaint under the Deceptive Trade Practices Act." My website boasts of multiple GSABA awards because I won multiple awards While it was while I was with a different company at the time, I was a principal of that company and as such, those are my awards to boast of I have been a member of every organization that is listed on my website While membership may hap lapsed with some, there's no intention to deceive anybody.These homeowners have shown a pattern of trying to bully their way with builders Their previous builder has told me that they parted ways due to the " [redacted] 's being some of the worst human beings I have ever met."
