paid for and ordered an ISBU shipping container house design and did not receive it, andthat we did not survey her propertyThe latter, we are not an engineering firmWe do not performsurveysWe delivered the designs and we have proofSee page of Design & ConsultationAgreement.Typically we charge 2% of design fees which Ms*** understood but since she was our firstcustomer we agreed to $She gave us a budget $150,We went through a few variationsof a custom design until we delivered a final design, which she said she loved! She posted this onFacebook, along with her plans, which actually is a breach of contract in that she’s not permitted toshare publically (she signed a confidentiality agreement)She decided a mortgage based on$150,was too high so she changed her budget to $130,We kindly provided a seconddesign, which we were ready to deliver to the lender upon her approvalShe didn’t get the approval,which we learned by following up with her mortgage lender due to her lack of communicationA fewweeks later we received a demand letter from an attorney, *** and ***, on her behalf,stating she didn’t receive the plans and we didn’t survey the property.Ms*** breached her contract in two waysShe broke the confidentiality agreement by posting itpublically on her FacebookWe charge for designs, and they are for the consumer and the builder(us), not the general publicShe also breached by hiring Legal Shield/ *** and *** given shesigned an Arbitration Agreement.Attached are the agreements I mentioned, the Facebook post showing how happy she was with ourwork, and a Facebook post by her lender showing proof he received the plans for her project as well.His contact information is: *** ***, Vice President of Gulf Coast Bank, (*** ***I’d like to add that the owners of METCON Group, LLC include two people who have nothing but thehighest of standards, has won numerous civic awards, and has much community respect in our otherfirms which have existed for over (Green Home Realty, LLC) and years (Greenboro Homes).METCONSPACESMy theory as to why Ms*** filed the complaint is that she just wants her money back; she’sbrokeShe has never bought a home and lives in a one bedroom trailer with her daughterShe wasnot mentally or financially prepared to be a home buyerThat’s not on us.Lastly, her general disposition is excessively demandingShe not only was the most unpleasantperson I’ve ever had to serve, but she regularly slams every company Facebook, as she did usOneof our other buyers researched her after seeing her ugly reviews and messaged us with proof of hergeneral unhappiness as a person and offered to post a positive reviewShe did.Thank you for reviewing our case.Sincerely,*** ***Managing PartnerPlease see attached
