Hi,My understanding is that you have been in touch with [redacted] regarding this matter Please feel free to call our office to let me know if this has not been resolvedThanks [redacted] ***

Initial Business Response / [redacted] (1000, 5, 2015/06/10) */ I spoke to the property manager about this matter. The last time he talked to the resident was to discuss a transfer to a larger apartment. It was his understanding that he would contact her again when the unit is ready to be moved into. If a... unit transfer is going to happen, he wouldn't renew a lease in the current unit so no 30 day notice would be given. A new lease will be written for the new unit when the transfer occurs. Initial Consumer Rebuttal / [redacted] (3000, 7, 2015/06/11) */ (The consumer indicated he/she DID NOT accept the response from the business.) None of this has ever been explained to me. I was also told by [redacted] that over a week ago he would call me and we would go over paperwork which we never did. Previously, he was supposed to show me two different units at sister properties, which he also never did. I called that weekend, left a message and never received a call back. When I confronted him about it, he was defensive and rude as if it was my fault. Bottom line, the communication between management and residents is lacking. I have been interested in the two bedroom but I have never agreed 100% to rent the two bedroom unit. I have not seen the unit, we have not gone over official pricing and again, communication is lacking. If there are different circumstances with transfers then someone should have already explained this to me and that has never happened. Final Business Response / [redacted] (4000, 9, 2015/06/15) */ I will ask the manager to contact the resident to discuss the new unit. Final Consumer Response / [redacted] (2000, 14, 2015/06/17) */ This issue has been resolved. I have been in contact with the company. No further action is necessary. 6:51pm 6/16/2015

Per Ms ***'s e-mail above she did not provide the required days notice per her lease agreement. In accordance with her lease agreement, we charged her for the rent due for February. However, in reviewing the ledger, we did charge a pro-ration for the move out where we should not
have. Ms *** does still have a balance on her account. We previously mailed and e-mailed statements to her all within the days required in her lease. I will mail and e-mail a revised statementShe is welcome to contact me with questions

My issue has been resolved Thank you, *** ***

We originally sent her security deposit back with her statement to the last known address on 12/11/within two weeks of her move out. She never received it though. Once we learned that she had not received it, we cancelled the check and reissued it sending it to her updated address

Complaint: ***
I am rejecting this response because:According to Colorado State law, on a month-to-month lease, a day notice is not legally requiredI did provide a weeks notice, which is more than actually required by lawI never received the statements via usps and not only did I not receive the statement, the one I received via email was not itemized as also required by lawThe February rent charges are fraudulent as my last temaining day on the pemises was January 29th and I already had paid Januarys rentThe balance the company states I owe is the rent for February which I do NOT owe and I want it removedThere is also a charge of $for "cleaning" but never states what kind o cleaning and what each cost wasAccordig to Colorado law, they cannot charge for painting or replacing the carpet because I livzed there for monthsMy deposit should have only covered routine cleaning which I was told was $The charges are bogus and I do not owe rent for February because I was gone in January and have documentation of thatI did not receive the notice within daysThey may have mailed it but did NOT mail it to the forwarding address I provided.
Sincerely,
*** ***

Initial Business Response /* (1000, 9, 2015/11/23) */
Metrex let her out of the lease despite the fact that treatment was underway. She was aware of the situation when she moved in and insisted upon moving into the unit as long as we continued treatment as we were doing. She would not have been...

assessed the $50 NSF fee had she not placed a stop payment on her check.
Initial Consumer Rebuttal /* (3000, 11, 2015/11/24) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The above statement from Metrex Group is misleading. I saw two cockroaches on 9/1 prior to moving in and was assured by Metrex employee [redacted] that it would be handled immediately when I got the keys on 9/1 and also when I moved in on 9/3. This promise that Metrex was going to address the problem immediately was also stated by a male maintenance employee on 9/3. No extermination began until 9/16 and it had become a full infestation with thousands of roaches.
The fee on the letter they sent me initiating this complaint did not state the reason for the charge except as "Security Deposit Statement" in the subject line and "outstanding amount." I am attaching a picture of the letter so you can see that it does not state that it is a fee for stopping a check.
Additionally, Metrex employee [redacted] stated very clearly on the phone during our last communication on 9/21/2015 that I was not going to be charged further and that I had a zero balance.
I find Metrex's request for funds to be unreasonable. I appreciate them acknowledging in writing that I have been let out of the lease, but I am not responsible for any charges (now or in the future) as that lease has been nullified.
