In response to Mr***’s reply there are a few points I would like to address He stated “When I came into their establishment, I asked for the trailer in the ad, this part is true It did not matter to me whether the trailer had brakes or not The trailer pictured in the ad clearly shows a trailer with a ramp gate This was the feature I needed, I could have cared less about the brakes.” I don’t think I clarified well in my first reply that the brake option is an additional $ So again, I could not offer him what he wanted because we did not have it available.He claims we are being malicious in out advertising by baiting and switching The definition of bait and switch is: bait-and-switchnounnoun: bait-and-switch the action (generally illegal) of advertising goods that are an apparent bargain, with the intention of substituting inferior or more expensive goods.We did not intentionally advertise a trailer we do not even have in stock just to try to upsell a customerThere were mistakes made, we acknowledged thatWe apologized for thatWe deleted the error as quickly as we could Mr [redacted] stated in his complaint that the desired settlement was to “Sell the trailer as advertised, I am willing to pay the price they advertised of $1599.00” so we made the offer he requested in order to settle the complaint In his last reply he stated he had already purchased from our competitor so I honestly don’t think that is what he really wanted in order to settleWe offered him the trailer after we had a chance to investigate further and also because that is exactly what he requested that we do in his complaintIt leads me to believe all he wanted was to make sure he could negatively impact our reputation, he has also filed with the [redacted] office and on ***Stating it is “repulsive that they attempt to get away with this cheap, sleazy tactic” and on his [redacted] review, “Funny thing too, at the bottom of their ads, they quote a bible verse, John 3:Don’t think I was handled in a Christian-like manner AT ALL.” only further tells me he had no intention of trying to settle, he just wanted to pretty much slander the business name and beliefs.I have done all I can to satisfy Mr***, I am at the point now where my only option is to keep the information provided to the Revdex.com, [redacted] and [redacted] (along with any other place he might see fit to speak badly of us) accurate.This is the only complaint like this against us, if we tried the bait and switch tactic there would be more people complainingWe have been in business since 1998, have sold thousands of trailers, our reputation speaks for itselfLike any good, family business we do our best to make things right by our customers, we are disappointed this matter could not be resolved.Thank you for your time, [redacted] ***, ManagerDeer Valley Trailer

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
When I came into their establishment, I asked for the trailer in the ad, this part is true.  It did not matter to me whether the trailer had brakes or not.  The trailer pictured in the ad clearly shows a trailer with a ramp gate.  This was the feature I needed, I could have cared less about the brakes.  [redacted] from Deer Valley Trailer stated in her response letter that she explained to me that a trailer with a ramp gate would be more expensive and we would need to order it.  She said I was upset that they didn't have the trailer in the picture and that I asked her to give me one for the same price.  I was not upset that they did not have the trailer in stock.  I would have waited for one to be ordered.  I was upset because they advertised a trailer, pictured with a ramp gate for $1599.00 and she refused to sell it to me at the advertised price.  Picture # 1 clearly shows the trailer with a ramp gate.  Picture # 2 clearly shows the trailer with a ramp gate.  Picture # 3 shows what appears to be 7 trailers in a row.  The first one in picture # 3 only shows about half the trailer so you can't tell if that one has a ramp gate or not.  Of the 6 you can see, 4 of them are shown with ramp gates.  All 3 pictures lead you to believe that this trailer they advertised came with a ramp gate.  [redacted] stated in her response letter that I again asked for the trailer in the picture for the price of 1599.00 and she told me that she did not have in stock any 8x16 without brakes but with a ramp gate.  She is avoiding the point and the complaint.  I didn't care about the brakes. The feature I wanted was the ramp gate.  I would have waited for an ordered trailer, with a ramp gate, for $1599.00.  She told me the ad was a mistake, and refused to honor the advertised price of $1599.00 for the pictured trailer.  I asked to speak to her boss, but of course, there was no one above her present.  There was an employee in the room as well that mentioned they were owned by a larger corporation and gave the impression that [redacted] was the person to talk to.  Yet, they state in their ads, and in their response letter that they are a small family business.[redacted] stated in her response letter that they are a small family business and they pride themselves on good customer service and repeat business.  I was a repeat customer. I bought a trailer from them in 2005 which is why I came back.  I am also a small business owner.  If I make a mistake and price something incorrectly, I honor the price I quoted because that is the right thing to do.  [redacted]'s last paragraph in her response letter states that she would love to offer me a trailer, just like the one in the picture, without brakes, with a ramp gate for $1599.00. This offer only came about because I complained to the Revdex.com and the [redacted] office.  She flat out refused to sell this trailer to me for $1599.00 the day I was in their office.  She should have made this offer the day I was in their office.  I find it repulsive that they attempt to get away with this cheap, sleazy tactic, which is why I complained.  No business should be permitted to get away with false advertising or bait & switch tactics.If DV Trailer truly felt that they made a mistake, then they should have honored the price they advertised.  The fact that they did not, (until pressured for a response by the Revdex.com & the [redacted] Office) shows that they do practice the tactics I'm accusing them of.  They have lost this repeat customer for good.  I will not buy a trailer from them, in fact, I have already purchased one from their competition.

When Mr. [redacted] came into our establishment he showed me the ad and asked for this specific trailer. I told him we did not have a trailer in stock without brakes but with a rear ramp gate.I told him we had a 8x16 with no brakes and no gate, that the ad he had was for what we had in...

stock, the description was accurate (it does not say in the description that the trailer has a gate for the price of $1599.99}.I explained a trailer with a ramp gate would be more expensive and we would need to order it. He was upset we didn't have the trailer in the picture and asked me to give him one for the same price. I told him we did not have a trailer in stock without brakes but with a ramp gate and that I would have the picture removed because it does give the assumption wrong and I apologized for that.I did reference the 3rd picture in the ad showing that there is a trailer without a ramp gate in that picture and we try to show a lot of inventory in all our pictures. He again asked for the trailer in the picture for the price of $1599.99, I told him we did not have in stock any 8x16 without brakes but with a ramp gate. I did not have anything to offer him that was the picture he was asking for.I agree the picture was an error, it should have showed a trailer without a gate and I contacted the person who runs the ads to have it updated correctly. It was their day off so the ad was removed about 1-2 hours later.1 It has not been rerun with that picture again.We are a small family business (as stated in the ad) and we pride ourselves on good customer service and repeat business. We have a very good reputation and I'm sorry to hear Mr. [redacted] thinks we would run an ad to 'bait and switch'. That is horribly untrue, we are human and accidents happen.Mr. [redacted] filed this complaint and one to the [redacted]. I would love to offer Mr. [redacted] a trailer, just like the one in the picture. It would need to be ordered without brakes but with a rear ramp gate.The build time would be about 4 weeks and to keep our reputation in high standard we can sell it for $1599.99 (cash or cashier's check, before tax).
