Work was NOT completed as it was supposed to be and then the owner [redacted] falsified the contract AFTER it had already been signedI signed a contract on May 19th 2014 for Metro Awnings to come and place an addition on an existing awning. The contact I signed had 3 layers a pink sheet on top and then a yellow and white and after I signed the contract and gave the owner a check for $475.00 he did NOT give me my top copy. He arrived at my home with 2 employees on the 23 May 2014 and installed the addition to my awning but upon completion it was NOT installed correctly as he had not placed the support beam for the 1 corner down in the ground with concrete as he had previously done on prior installations but had simply attached it with a couple of screws into the surface of my wooden deck. I indicated that I was not happy with the installation and he told me if I wanted it fixed like the other posts that he was going to bill me for extra materials and labor and he would have to come back another day. I told him that it was not installed correctly and that I should not be responsible for materials or labor costs as he was the one who installed the post incorrectly and cut it accordingly. I asked him for the top pink copy of my contract which he had in his hand at the time of this disagreement and he refused to give it to me and then asked his employee to pass him tools to dismantle the awning addition. I told him that he was not going to take the materials unless he refunded my $475.00 and he became rude and I asked him to leave my property as I called 911 to ask for the assistance of the Sheriff's dept to prevent him from taking materials that I had already paid him $475.00 for. At this point I still had no copy of my contract as he had not provided me with the copy when I gave him the check and he then refused to give it to me after the botched completion of the awning addition. The sherif's responded to my home to tell the Owner named [redacted] that he was not allowed by law to come onto my property and take anything and that this is a civil matter and at that time the responding deputy had a copy of the contract in his hand but the owner had removed the top pink copy which he was supposed to give to me and only had the white and yellow sheets, which the owner had obviously amended by writing "1 post next to fence surface mount" which was NOT on the contract that I signed. The Sheriff then allowed me to make a copy of the contract that the Owner named [redacted] had falsified for my records so I would have confirmation that I did in fact pay him $475.00. This owner is an extremely dishonest man as he apparently has no problem with amending an already signed contract to adjust details that were NEVER in the original contract. The amendments that he made after I signed the contract reflect that I was in agreement with the sub standard workmanship that he and his employees provided but that is not the case. I will not pay Metro Awnings and the owner [redacted] Billings for sub standard craftsmanship or be bullied into paying for goods and services which were not provided to me. I asked him for the pink copy of the signed contract in front of the 2 Sheriff's officers and he refused to give it to me. The company Metro Awnings and their owner [redacted] Billings is not only operate an unethical business but the actions of the owner attempting to dismantle materials that I have already paid for is illegal as he was informed by the Sheriff's office. Not satisfied with my experience with them at all.Desired SettlementI asked the owner named [redacted] of Metro Awnings to fix the issue and place the post that he installed incorrectly into the ground with concrete like the other 3 posts and he stated that he wanted more money for materials and labor! I have done business with him before and had no issues but I will NEVER do business with him again.Business Response In response to the complaint filed by [redacted], I tried to explain to her cutting into her wooden deck to place a post was going to weaken the deck and possibly be dangerous and would make me deck weak in that area, She didn't care and wanted the post put in that location. I told her I would move it, I had 1 of my guys to hand me the tools and I was in the process of taking it down to move the post where she wanted it and before I could do that she called the police and had me removed from her property thinking I was taking the whole cover down.She was given a copy of the contract when she placed her order for the cover, Customers are always given the pink copy at the signing of a contract with us. The pink copy she is referring to was the pick ticket from our supplier.That goes with our paperwork. The police tried to talk to her also and finally threw his hands up and told her that she needed to pay for the job and showed her our copy of the contract with her signature and informed her that if this gets taken to court that she would end up paying more for the job that had been done. She is now saying that the contract was altered.Her contract has not been altered.We installed exactly what she signed off on.It's never been denied that she paid $475.00 up front for the materials.She still owes for the labor which we feel she never intended to pay. We have been in business for many many years as you can see from your records and have never had any thing like this happen.I will gladly send you a copy of the contract if you would like. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)I was NOT given a copy of the contract the day that I signed it and the contract which the Sheriff's officer showed me, that I made a copy of had been altered by the owner while he sat in his truck in front of my property the day that the work was not completed correctly. I saw him altering the contract whilst he was sitting in the vehicle while I waited for the Sheriff's to arrive to instruct him to leave my property. The owner never tried to tell me anything about the post being attached to the deck as that was never discussed prior to installation and he stated that he would have to return another day with a full length post to put it into the ground with concrete as the one he had installed had been cut too short now. He told the employee to pass [redacted] tools to remove the materials that I had already paid for not to fix any issue as he stated he did not have another post to put in the ground at that time so how could he replace it? He falsified a signed contract after the fact because he knew that he had not provided me with a copy and he wanted to attempt to show that I had agreed to the post being installed incorrectly on top of my wooden deck when that was never in the original contract that I signed. the owner is not only a liar but he is also a bully who has since I filed this complaint called me and threatened to put a lien on my home if I don't pay him the balance of the contract. I have tape recordings of ALL conversations that have taken place and a witness who was here at the time of the signing of the contract. I have copies of other contract from previous dealings with this company from several years ago and keep a detailed catalog of contracts and payments in a file cabinet which I can present to show that I am meticulous about keeping contracts and therefore am 100% accurate in stating that not only was I NEVER provided with a copy of the most recent contract but that also the owner lied and falsified a legal binding contract after it was signed to benefit himself and his disreputable and dishonest business practices. In addition since the hurried and unprofessional installation I have found that the awning addition is un level measuring 74" one end and 78" at the other so it dips very low in the corner and looks crooked. It also leaks profusely from all areas, and I have provided numerous pictures to show this. This product and services provided by Metro Awnings and the owner are substandard and not worth the $475.00 I have paid for them.Final Business Response In response to [redacted]..I'm attaching a copy of the contact signed by her. Please review the pictures she has sent you along with the contract and you can see what's on the contract is exactly the work that was done.I'm also attaching several other contracts from other customers for you to review to see this is how all contracts are filled out.Mrs [redacted] has not called the office to discuss this matter and I'm not exactly sure what she's expecting us to do.We tried to explain the post issue with her and the police was called to have us removed from her property.We tried to take the post down and place it where she wanted it after trying to explain to her that it was unsafe and she didn't want that either.At this point we are done with this issue and have moved on regardless that she still owes us a balance on the signed contract there is no resolution in a situation like this. This is our last correspondence on this matter. Metro Awnings has decided to move on.
