To Whom it May Concern: In June 2015, Mr*** contacted Metro Legacy Homes LLC in regard to the possibility of building a home at ** *** *** ***, NYThis is a lot developed and owned by Metro Legacy Homes and is listed in the MLS. Mrand Mrs*** met with our designer,
modified a plan to suit their needs and were given a contract price and specifications for the new home buildOn October 1, Mr*** signed Metro's lot reservation contract and gave a deposit to secure the lotWe are sorry to have received a complaint from Mr***It is the practice of Metro Legacy homes to avoid any misunderstanding about our lot reservation policy by having the customer sign a lot reservation contract that clearly outlines our policy in regard to any deposits(attached) Our contract clearly states "if a Buyer decides not to move forward to final plans, the Buyers deposit will be refunded minus the invoiced cost of the preliminary design fee and any required engineering costs to date"Metro Legacy Homes was billed $By *** *** *** ***., (invoice attached) for modifications made to a base plan at Mr***'s request. The lot reservation refund as per the signed lot reservation contract was written and available to Mr*** on October 12, 2016, when he came to our officeHe was presented with the check for $9,which was the lot reservation deposit minus the invoiced design fee from *** *** *** *** of $850. As I attempted to give him the check, Mr*** became enraged, verbally loud and abusive, threatened legal action, stormed out of our office and drove in a reckless manner out of the parking lotThe only communication we have had with Mr*** has been through his attorney to our attorney Thomas SolomonSince Mr*** elected to get his attorney involved all action in regard to the lot reservation refund must now be processed with attorney approval. No bills were ever presented to me or spoken of at any time prior to Oct.12 2016.  This dispute is not a misunderstanding. our agreement was crystal clear: only design costs incurred after the deposit were to be deducted.
