believe Thursday, several days prior to his second visit to our dealership with his wife on Saturday 4/11/His first visit he came to view the car and really liked the car as it is a low mileage, and very clean car for a 2008, with only 30,miles and fairly priced at $7,He said he would have to let his wife see and drive the car and he was very impressed with the condition of the car, and he was researching the Smart Cars online and found them very safeWe talked about the safety design of the car, and discussed a crash test that is online hitting a cement wall at miles per hour with minimal passenger dummy damageHe said I really want the car, but have to bring the wife out Saturday.He and his wife came out Saturday afternoon and inspected the car for some timeHe asked to take the car for a good ride so they both would have time to drive it, which they didWhen they came back they were very impressed with the carHe asked about a second key, and we said we only got the car with the main keyHe asked about warranty, and I explained that we give a day 50/internal drive train warranty with car priced $10,and aboveI told him we do have optional warranties at extra cost and he said he was not interested in a warrantyHe then asked for a better price on the vehicle, and I explained that this was the lowest mileage best priced Smart Car in the areaHe offered $7,500, and I told him the price was firm at $7,He said I am pre approved at my credit union, and will pick up the car TuesdayWe agreed on a price of $7,and he said I will give you a deposit and pick up the car this coming TuesdayWe drew up a sales contract for that amount and he gave us a deposit of $100.There was no mention of things like Navigation, Leather, Moon Roof, Bluetooth, Tilt Wheel, Which are NOT EVEN AVAILABLE ON THIS MODEL? They don't offer those options on Smart Cars!! They are very basic commuter cars, and price very reasonably for that reason.We had a couple from West Virginia stop in late Saturday afternoon that came to see the Smart Car and we told them sorry it was just soldMonday afternoon *** *** called and said I want to cancel the order on the Smart Car! I asked why, and he said mainly because there was no warranty, I said you could purchase a warrantyHe declined and said I changed my mindI told him since it was a 2008, with only 30,miles I would deviate from our policy and give him a day warranty included for the reduced priceHe then said there was only key, and I said yes, we discussed that SaturdayHe then said he thought it was more equip? It is the same car that you saw, and we discussed everything on that Saturday for hours and nothing has changedHe said he was looking online at other cars and was cancelling the dealHe asked about his deposit and I told him that he is changing his mind, which is his option, but the deposit was good faith money to purchase the car on Tuesday as he agreedHe said I am sending a self stamped envelope and you better return his deposit when it arrives.Obviously *** *** found another car looking on the internet, and was making every ridiculous excuse to cancel the dealWe don't take deposits on cars unless the customer has secured financing, and is ready to purchase the vehicle*** *** said he saw the car on one of the internet sites that said it had all the options of a late model *** ***! He came twice and saw the car, and knew what equipment was on this vehicle before he agreed to purchase itIt is his prerogative to cancel the contract on the car, but the deposit is on the car he contracted to purchase, and is not refundable.He refers to item number on the contract, and it refers to a New Car that is ordered from the factory and does not come equip as ordered! I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
[redacted],    I will address each of [redacted] statements as they appear in his letter. Paragraph one [redacted] states that I visited his place of business on two occasions Thursday then Saturday. I visited only on Saturday about 415pm along with my wife. There was never an earlier visit or communication other than a phone call asking if car was still available as I had seen it on [redacted]. Everything in paragraph one is untrue other than we did talk about the safety and crash test but that was on Saturday.On Saturday as stated my wife and I arrived about 414 pm after spending the day at my son's track meet at [redacted], I know the exact time as I was worried about making it prior to the 5 pm closing time. My wife and I took the car for a short ride, not knowing the area we went down two blocks up two blocks made a right went 3 blocks turned around retraced our steps to dealer. 10-15 minutes tops on ride and my wife did not drive vehicle. I had never contacted my credit union prior to this visit, although I did tell him that was where I would take the deal and they faxed a copy to them Attn. [redacted] that you can see in their attachment. When we first arrived [redacted] was not there but [redacted]  was taking care of us, we asked about every option that was listed on auto trader (SINCE BEEN CHANGED) including sun roof, tilt wheel, leather, power windows and original keys (PLURAL) [redacted] even helped us determine if roof would come off to no avail. Upon returning from test drive [redacted] was there and when we asked about the non existing options and he laughed at my wife and said I lied in a joking manner. I asked about the keys (2) as there is a transponder inside to make the car start and they are between 175.00 to 400.00 to replace depending on make and model of car. I questioned over and over why no warranty for a 30,000 mile car and was given the run around over and over. We did haggle on price and I said I would see what my credit union had to say, they ASKED for a down payment to hold the car and we reluctantly gave them $100. If Smart car website is checked one can see that leather seats, heated seats, sun roof even cabriolet convertible roofs are available, so if it was advertised that way I would have no way until seeing the car to know the ad was false. We should have walked away from them but was just unsure about the car and wanted a day to think. When we left dealer they were closing as it was past 5 pm by this time and as we were leaving they pulled a vehicle across entrance to block entry and also left, so I don't know how a couple from West Virginia stopped by. I called at 8 am again at 815 am again at 845 am and at 9 am each time a message from [redacted] came on saying that the voice mail was unavailable. I called back at 920 am and talked to [redacted] informing her we didn't want the car and the 2 reasons were (1) did not match ad and (2)was concerned about a car that dealer would not back for at least 3 months 3000 miles that is pretty standard on used cars, especially if it was the 30,000 mile cream puff we were being told it was. She at that time said " Well I just had three phone calls on that car and had to turn them away" no mention was made of West Virginia couple, which I am positive given she said three phone calls, would have been mentioned. I asked for our money back and she said [redacted] would have to talk to me I then received a call from him approximately noon to discuss this matter. I gave him my reasons and he said how about 50/50 split is that fair, I told him no that with the complete false information in his ad and the no warranty I wanted all of my money back. He appeared surprised that [redacted] had it listed that way and agreed to return my money and I offered to send a stamped self addressed envelope to facilitate the process. I waited 9 days and called at which point he said your not getting anything back you violated the contract. There was no approved loan as he states or he wouldn't take a down payment, that is another false statement. #5 he claims is on NEW cars when this document was made for his dealership as you can see by his own attachment, he does not sell new cars only used cars and has about 12 to 15 cars on a very small lot. If [redacted] feels that $100  is worth his credibility as an honest business man, then there really is nothing I can do about it but the Revdex.com as a consumer advocate with a reputation above reproach can by rescinding his triple A rating that he uses in his ads. If verification is needed from credit union that no preapproval existed or if my wife is needed to swear to and verify these facts we are both willing to swear under oath and/or take polygraphs to show this Dealer for what he is.

[redacted]Hello [redacted]: I would like to tell you about what really happened between Metro Motors and [redacted]. On Monday Jan. 16th in the evening customer came to dealership to see our 2005 infiniti FX 35 Sport...

Utility. He said he had been looking for a very clean one, and had not had much success. He looked the Infiniti over very closely, and drove it on a long test drive and when he returned he said I definitely want the Infiniti. He said I will give you a deposit of $1,000 so it does not get sold. Linda, my wife was writing up the contract and receipting him for his deposit. He did say his credit was a little below average score curve of the credit rating numbers, and said if we could not get him financed is the deposit refundable. Linda told him if in fact we could not secure any financing thru our sources, that it would be refundable, but otherwise it is a Firm Deposit. [redacted] said OK and signed a sales contract with the notation that this was a Non Refundable Deposit otherwise. He agreed and put the $1,000 money down and was given a copy. The next morning we got a fax from the bank saying they can approve the loan, but would require more of a down payment from the $1,000. Linda called him to tell him the banks counter offer, and he said "no problem" my friend will lend me the additional money. He asked is the Infiniti ready, and we told him we had to install a gasket, and have it state inspected, and we can deliver it Wednesday morning to him, and he said asap please! Mid afternoon a customer that was in earlier Monday afternoon liked the vehicle but said it was a little more that he wanted to spend for his daughter, and would see if he could increase his loan amount. Mid afternoon Tuesday the other customer showed up and said he got additional money, and pulled out his check book and said he was here to take it with him. We told him it was sold, but just making sure Linda called [redacted] and said that another customer was here to buy the Infiniti, and are you 100% sure you are buying the vehicle. He told her yes, I definitely want it, and she told the customer sorry it is definitely a sold vehicle! All the finance, state papers were made out and waiting till Wednesday morning delivery.I was in the shop late Tuesday evening with the mechanic and [redacted] called and said "I can't buy the Infiniti because my friend won't give me the money! I told him that was a problem because we struggled with the bank to get an approval, and Linda called in the afternoon to make sure everything was still on for sure with the sale. He said well, I will stop in to talk to you. I did have the number for the other customer, and I called him the next day, and he said they had purchased another vehicle, and was very disappointed that it was not our Infiniti because that was his first choice.We don't have sales people, and we don't take deposits unless the customer is sure they want the vehicle, and it is explained that the deposits are non-refundable.[redacted] stopped in Wednesday evening and was demanding his deposit back! We told him that we did get him financing, and we even followed up after that with a call to make sure he was buying the vehicle because the other customer came in and was ready to buy it. The other customer even said "if I give you a couple of hundred more now will you sell it to me"? We told him that it was sold, and we would not do that to a customer who had a deposit on a vehicle. He said he wanted his money refunded, and he had no problem going to [redacted] Infiniti and buying a newer Infiniti! That really made me upset, and he parked the car he had purchased from [redacted] in the business next to us so I guess we would not see it![redacted]l said I can buy a vehicle where ever I want, and was getting very loud and demanding. I got up and said I'm not dealing with this aggravation, I am giving you back half of your deposit, and we are not in business to play mind games. He agreed and left with the check. About an hour later a guy called and said he was a friend and why are we keeping some of his deposit. I tried to explain everything to him, but he was yelling and threatening to come down and "mess us up"! I hung up the phone, and he called back three times and kept making terroristic threats on the phone. I called the police the next morning because I could not reach them that evening and explained the threats, and gave him the phone number of the guy. He said If he calls again or shows up you call me immediately!We were very upfront with [redacted], and put on the contract that it was a Firm Deposit that he signed and knew exactly the terms. We double checked with him when the other customer show up and he assured us it was a done deal, little did we know he was still car shopping while this was going on.We had other calls on the Infiniti in the mean time and we told them sorry it is Sold! We are fair with our customers, and this was just not right for him to be shopping for cars, while we were holding the vehicle in good faith, and did secure financing for him.I will include a copy of the contract between Metro Motors and [redacted]. Review: METRO MOTORS ADVERTISED ON [redacted] A SMART CAR THAT HAD POWER WINDOWS AND LOCKS, MOON ROOF, STEREO WITH BLUETOOTH, ORIGIONAL KEYS, TILT WHEEL AND A VARIETY OF OTHER UPGRADED AMENTITIES. WE DROVE 45 MINUTES TO POSSIBLY PURCHASE THIS VEHICLE, AND WHEN WE LOOKED AT VEHICLE IT HAD NONE OF THE AMENTITIES AND ONLY ONE KEY, TO GET ANOTHER WOULD COST OVER 300 DOLLARS. IT WAS CLOSING TIME ON SATURDAY AND ALTHOUGH WE WERE UNSURE OF THIS VEHICLE AND TOLD OWNER THAT IT DID NOT MATCH ADVERTISEMENT HE AND HIS WIFE SAID IF WE DIDN'T PUT A DOWN PAYMENT THAT VEHICLE WOULD BE GONE. WE PUT DOWN 100.00 AND LEFT DEALER. WE DISCUSSED IT SUNDAY AND DECIDED THAT IT WAS TO FAR REMOVED FROM AD TO BE WORTH THE PRICE AND I CALLED MONDAY MORNING 8:00 AM TO LET OWNERS KNOW WE WERE NOT INTERESTED, THEIR PHONE SERVICE WAS OUT OF ORDER. CALLED BACK THREE MORE TIMES BETWEEN 8 AND 10 BEFORE GETTING HOLD OF OWNERS. SPOKE WITH [redacted] AND INFORMED HIM OF OUR DESCISION AND HE INTIALLY AGREED TO REFUND OUR DEPOSIT UPON FINDING THE [redacted] AD WAS INDEED FAULTY. HE ASKED FOR A SELF ADRESSED ENVELOPE TO SEND BACK DEPOSIT BE SENT WHICH I DID. 1 AND 1/2 WEEKS LATER AFTER NO REFUND CALLED [redacted] AND HE INFORMED ME I BROKE CONTRACT AND WOULD NOT BE RECIEVING A REFUND IT WAS FORFIET ALTHOUGH IN #5 OF THE CONTRACT STATES IF VEHICLE IS NOT AS DESCRIBED A REFUND OF DEPOSIT WOULD BE MADE WITH NO LOSS. METRO MOTORS ADVERTISES A TRIPLE A RATING WITH THE Revdex.com AND I DO BELIEVE THIS IS A CASE WHERE A TRIPLE A RATING WOULD NOT BE THE CASE.DDesired Settlement: WOULD LIKE OUR 100.00 REFUNDED PLUS THE TWO STAMPS USED TO SEND AS DIRECTED THE SELF ADDRESSED STAMPED ENVELOPS.

I was very dissapointed with this dealer! Check the car, the add, prices, and fees very carefully. We found Bob to be high pressure, tricky, dishonest, and stuck up/rude. He listed the car I looked at with 2000 miles less than it actually had (I see from other reviews online this is not the first "mistake" on mileage from a Metro Motors add). After signing the purchase and noticing the difference in mileage when looking at the add again, we called back and decided to call the deal off when we felt he would not answer our questions clearly or directly and would not give us a breakdown by price on the extra fees he was charging, which we felt were excessive, after some research (he kept saying they had all just doubled, but the PA DMV site showed no evidence that they have changed at all this year). We also did not feel he was very fair on pricing or trade in value - every time I told him why I felt this way, he argued back in a way that made me feel he wasn't willing to even try to understand where I was coming from or listen to any of my concerns. We just could not go through with the deal after this. Then Bob ended our phone conversation by HANGING UP ON ME, and I knew we had made the right decision. I do not want to invest a large amount of hard earned money in a dealership where the owner does business like that! And the snarky replies I saw him make to some of his online reviews has further solidified my bad impression that he is very unprofessional and heartless in the way he conducts business
