Review: On July 15, 2014 we entered into a contract with Metropolitan Painting LLC to paint the exterior of our house, providing Metropolitan with a deposit of $2,750 (one third of contract amont) at the time of contract exceution. The work was supposed to start no earlier than August 4th, agreed upon verbally and stated in writing. On July 30th, we learned that the work had begun on our house (we were out of town, and wished to be home when the painting work commenced). This August 4th start date was agreed upon in a confirming email. We lost faith in the contractor, and on August 1, 2014 terminated the contract in writing. We were advised by Metropolitan that they would honor our termination request, but that they were entitled to keep the $2,750 deposit. The contract language is silent on cancellation, stating only that "By signing this proposal the customer accepts the work and prices stated above". We were advised by Metropolitan that [redacted] County law provided for cancellation for three days after signing the contract, and after that, the contractor could keep the entire deposit amount. My investigation of this State of Maryland provision is that the three day "cooling off" period with full refund applies to sales conducted door to door. This contract was not obtained through a door to door solicitation.Desired Settlement: We understand there may be some rescheduing of work associated with our termination request, but do not believe that cost to the contractor is equal to the full one third deposit amount ($2,750). We request a refund of the majority of the deposit amount, excluding some consideration to the contractor for rescheduling work, delivered via a Certified Check.
