 The business response of 9/30/2014/ 3:1546 PM is not a truthful account .
My response is as follows :
Professional service contractors routinely schedule work several months in advance.  This is proper planning and certainly not considered "strange".
It was requested that work would commence the week of August 10th.  It was impossible to contact [redacted] Painting at the number provided, hence it was necessary to stop at the address given .  Perhaps this was due to the fact that the owner listed of [redacted] Painting was deceased as of July 21, 2013 and therefore unable to answer the phone number listed.  Unfortunately, we learned of this misrepresentation after proxy painter walked off the job.
Subsequently, an additional amount was asked for due to our request of the use of Sherwin Williams Duration Paint.  This paint has a list price of $70.99 per gallon.  However, the documented actual invoice charge was for seven gallons of Sherwin Williams Paint at $30.89 per gallon with the actual cost of $216.26 with added tax of $11.89, total cost of $228.15.  This paint was the only product that remained with us after work ceased.
The person who power-washed the house admitted that he was a quarry worker trying to get into the landscaping business.  He was inexperienced using a rental power washer and complained he was " stuck with the job ".  His unfamiliarity with the equipment as well as proper procedure resulted in extensive damage due to deep gouges in the surfaces of the siding.  
The ten storm windows were completely sanded and prepped in our garage by the homeowner, prior to the painter arriving for painting.  Painter suggesting a charge of $35.00 each is excessive since the entire process took less than four hours.  The finished result was unsatisfactory because paint was dribbled over the edges, left to dry and needed to be removed before the storm windows would fit back into the house . 
At no time did we agree to or have any prior knowledge such as " [redacted] Brothers Painting " work on our house .  This was another case of gross misrepresentation.  [redacted] Painting was the business we were told would be responsible for the work done.  It was agreed that the painting would be done by spraying and brushing.  Painting of the prior smooth siding using heavy long-napped rollers was objected to because the result of pronounced texture.  [redacted] became irate saying this is how they did 95% of the houses.  Why was [redacted] of " [redacted] Brothers Painting " making the decisions when no agreement existed with him ?  [redacted] went on to say the paint was too thick and they did not care for the Duration paint and never had used it.  At no time did we suggest that the paint be " watered down ".  Apparently they were unaware of the product " Flowtrol " used by most professional painters with the Duration paint for smooth surfaces.  [redacted] did not cover the outdoor brick chimney , splattering paint there as well as all over the gas meter in the area he worked on.  Rain began coming down hard at which time they packed up their things and began to leave.  At this time [redacted] complained loudly about my attempting to clean the gas meter , which is certainly my prerogative since we do own the house.  age has no issue whatsoever.  
The next morning [redacted] arrived and began sanding the heavy texture briefly.  He again became irate when the poor work was addressed.  After heavy rain overnight it would have been impossible to sand the heavy texture which had not even dried properly.  He stated that we were just too fussy and that they would be leaving immediately.  Discussion of the $1,400.00 made before work began was a factor in not allowing removal of the equipment stored in our garage .  The painters check of $400.00 was not sufficient in respect to unsatisfactory work and therefore was handed back to him (definitely not crumpled and tossed as erroneously stated ).
This disagreement resulted in our refusal for removing the painters equipment from our garage.  [redacted] Painting chose to contact the police rather than attempt to mediate the situation and come to an agreement .  With the police observation the equipment was removed from our garage.  Painter telephoned that afternoon stating that a check would be mailed along with an invoice for work done.  However, as of this date this has not been done .  One visit to the business address was unsuccessful in resolution.  
Statements attributed to the police sergeant who also contacted [redacted] Painting at resolution are untrue as per police sergeant involved.  The filing of theft by fraud was suggested and encouraged at the time the facts of this situation was presented to the police department.  There is no reason to suggest an " unstable mental state ".  This is derogatory and totally irrel[redacted]t.
An amount of $600.00 for less than eight hours of work is generous and fair.  The cost of the paint was $228.15.  All painting done by [redacted] Painting needed to be redone by the Profession Painter contracted to repair and restore our house to the condition required.  Therefore , we ascertain the statement made at the time of [redacted] Painting cessation of work should be the return of at least $800.00 of the down payment of $1,400.00.  Future lack of resolution will result in the just return of all of the down payment due to damages incurred and well documented.

At this time I went to their home and gave them a estimate for the power washing and painting of the exterior of their home including the storm windows and shutters. The price on this estimate was $3400.00. The Client then informed me they  did not wish to have there home painted in till the end of summer, I thought this a bit strange as it was only April, but agreed to schedule their home to painted in late August. Over the course of the summer, the male client came to my personal residence three times, all of these visits were unannounced and served no purpose but to confirm I was still going to paint the clients house, again I thought this strange but reluctantly decided to go ahead with the job. The clients then informed me that they would like the entire home painted in Sherman Williams Duration Paint. I informed the client that this would affect the total price of the job as Sherman Williams Duration paint has I list price of 63.79 a gallon, nearly double the price of a normal exterior paint. The reason for this price increase is a thirty year warranty on the thicker more durable paint. I gave the client a new price quote of $3700.00 to account for the in increase in material cost. I did receive a $1400.00 down payment check from the client on August 13, the day a dropped off my equipment. This down payment is  standard procedure especially with the large job size and the excessive price of the materials. On August 16th one of my employees went to the clients home logging four hours and power washing the entire exterior of the house. On the following Monday I returned to the clients house and began work on the ten storm windows in the garage. Over the course of that Monday and Tuesday I painted both sides of the eight storm windows and the one side of the large sidelights. The client was fully satisfied with the work on the windows as they will admit to. The next part of this complaint is the what I find humorous, the employee they refer  to repeatedly as "DAD" is indeed my father. My father owned [redacted] Brothers Painting and Decorating for 45 years a very successful company and is by no means a novice as suggested in the compliant. My employee [redacted] (as he is referred to) assisted me for an entire afternoon in which we painted the service door on the garage, the garage window, the overhang and fascia on the garage the and all siding in regular standing reach. As we were packing up for the day the female client came out and began rubbing he hand over were we had rolled the siding. She began to complain that the paint was on to thick and not applied in a smooth enough manner. [redacted] then did indeed inform her that because of there selection of Sherman Williams Duration paint that a perfectly smooth rolled finish would not be possible because of the thick body of the specially requested paint. The client then asked if we could water down the paint we informed her no as this is not something to be done with paint. However, because of her dissatisfaction [redacted] did agree to return the next day and sand the area in question and re roll it using a brush behind method. We then noticed the female client by the utility meters on her hands and knees furiously scrubbing the surfaces, this concerned us as she is advanced in age. We asked her what she was doing when she informed us she was removing the paint we had splattered on the meters and would do so on the chimney above. We then pointed out to the client that we had not even reached the area near the utility meters or the chimney in question. In fact we had not even come within about ten feet. This again raised a major red flag for me has it seemed the clients had a major problem with anything my employee [redacted] did, and as mentioned before has been a professional painter for forty five years. Also, when ever someone is not familiar with the previous condition of there house it always results in conflict. The next morning my father returned and began sanding the applied paint on one portion of the house as promised, the female client then approached him telling him that we could do no painting that day, or that week for the matter, as they did not feel the weather was conducive. I have no explanation for why they would feel that way as they was no precipitation falling and I have painted in this type of weather successfully numerous times. The female client then informed my employee that the service door and window he had painted looked worse then they ever had, something that was extremely outlandish and one of the indicators that this professional relationship was not going to work out. Upon hearing this news, I contacted the male client and asked him to elaborate as to why the latest work was unacceptable. The client went out to inspect the work and said that the work  higher up on the fascia and overhang was acceptable, again the only work the clients had problems with was the work of my most senior employee. He then informed me that he did not want us to paint at all that week as he did not feel the weather was conducive. This was a problem for me as I had several other jobs also going on and could not leave my equipment sitting idle for a week. I went to the clients home and informed them unfortunately  it did not seem this professional relationship would work out as there expectation for the finish of the Duration paint was unrealistic, and they obviously we not aware of the previous condition of their home. I told them I was sorry it did not work out but would need to take my equipment and move forward professionally. The Clients then became very agitated and said they would not allow me to remove my equipment and slammed the door in my face. I then went to my vehicle wrote up a receipt for services rendered, I very generous  one at that in hopes of a civil resolution, approached the home again offered them the receipt  and a check for $400.00 dollars. They crumpled up both, tossing them back to me claiming that based on the hours they were privately tracking they were entitled to at least $800.00 in refund and still refused to release my equipment. At this point I was left with no choice but to Contact the local police in order to get my equipment out of their garage, I contacted the police they came and instructed the clients to release my equipment to me. I then began taking pictures of the work I had done  in order to protect my buissness when the clients became very agitated again refusing to let me do so. This was likely to back their ridiculous account of the work performed. (this refusal is recorded in a copy of the police report I obtained from the incident). The clients then began yelling remarks at me as I loaded my equipment, I again told them I was sorry it didn't work out and all the best in the future in a calm manner. My demeanor further infuriated the female client, who repeatedly yelled she would to everything in her power to "destroy" my business. I left their home and two weeks later the Male client again came to my personal residence unannounced demanding a check for $800.00 and refusing to leave my property. He claimed "it's a free country" only when I again threatened police action and a restraining order did he leave my property. I was then contacted by I local police sergeant who said he had been contacted numerous times by the female Client, claiming I was a criminal involved in some sort of fraudulent enterprise. After discussing the situation he apologized for the call and could tell the client "was grasping at straws" in regards to this incident. This just goes to show the unstable mental state of the Female client. In conclusion there was in fact a deposit for $1400.00. I rented a power washer at a days rate and paid a employee a half days wages for the power washing of their home. For this service I charged the clients $275.00 more than reasonable for this service. For the storm windows and sidelights I painted with which the clients were completely satisfied, I charged $35.00 a piece which at a number of ten brings us to a subtotal of $350.00. The specially requested paint is listed at $63.79 a gallon, of which I purchased 7 gallons which were left with the client adding another subtotal of $446.53. Finally, there was additional labor performed besides the windows and a complete day of work lost by two employees because of the clients unreasonableness to release my equipment  and the police having to  become involved. This totals two employees work of one and a half days or three full days of labor, this I value at $450.00. Again you can see the clients unreasonableness as they are trying to set what me and my employees make by an hourly rate. My work is done by the job not by the hour, not considering their gross underestimation of hours worked.  In conclusion my bill for materials and services rendered comes to $1521.53, However I will not be pursuing the outstanding balance unless I am taken to small claims court, in which I will counter sue for the remaining balance. I consider this matter closed and hope the clients all the best in the future.
