10/4/2017: Nothing has been resolved since the complaint was filed back in June I have recently found another spot where the wiring was only buried 2-inches deep instead of the 3-inches required of the industryI will sent an email as soon as I am able with pictures that show the spot mentioned in my original complaint, as well as a picture of the recently discovered spotThe business did a good job so I would be apt to letting them come back and fix the issues with the wiringHowever, I am confused as to why they would need to lift my patio - I do not know if this got lost in translation between the business and their attorneyIf they are unwilling to come out and fix the issues with the wiring, I would like them to compensate me for then having another company come out and do the workAlthough I have not looked into an estimate for the work just yet, I believe that it will be a couple hundred of dollars or around $I would like to be present, however, if they do end up coming out and fixing the wiringThis is something I would do even if I had another company out, so I would like a date that would work with me in regards to taking time away from my jobI did mention in my original complaint that I was considering hiring an attorney to deal with this matterNonetheless, I am an attorney, so I am not going to be pursuing the reimbursement of legal feesLastly, I would like some sort of consequence to be given to the business as they have led me on for months without contact or redoing the job.10/4/2017: In follto our conversation of this afternoon, attached please find some pictures reflecting the work at issue in my complaint Should you have any questions, please do not hesitate to contact me. 10/11/2017: Mediator called consumer to relay response by Meyer Landscaping and left a voicemail10/12/2017: I would prefer them come while I am at home either during the evening or on a weekendI will be out of town for work from October 18th - 26th, so if they could come after the 26th, that would be great10/18/2017: I wasn't planning on interacting with Meyer Landscaping at all while they were here inspecting my propertyI simply want to be there when they come onto my propertyIn fact, I would prefer if Mr*** accompanied them because then there would be no question as to whether or not an interaction took placeI will be home on Monday, October 30th for an unrelated electrical inspection, so that day would work for me if they agree to it.10/27/2017: Mediator called consumer and left a message.11/3/2017: I am not comfortable with them coming on to my property without me thereI am willing to be flexible, howeverIf they can just give me a minute heads up, I will just go home and stay insideI'm in a dispute with them and so I do not want them on my property without me there11/29/2017: Their proposal sounds great, however, this has been a lot of time and troubleI do believe that some consequences need to be imposed due to all the time I have spent dealing with this issueIn addition to absorbing the cost of the repairs and completing the work, I would like them to issue me $500, while also giving $to the charity of their choice12/1/2017: Mediator called and left message stating that Mr*** should leave a message detailing either his acceptance or rejection of Meyer Landscaping's offer.12/11/2017: Mediation department sent email again asking if they accept or reject business offer.12/11/2017: My apologies for the delay in my response. Their proposed offer does not address the issue with the power lines having been buried too shallow throughout the yard, so I'm afraid I must reject the offer. Also, I don't really like the idea of the same company doing the work since they did such a sloppy job the first time, but I am willing to let them do it as long as they will continue to stand by the work and as long as they address all of the issues with their previous work in the yardPlease let me know what the next step isAnd let me know if you would like to discuss this furtherThank you.12/19/2017: Mediator informed consumer of company final offer.12/19/2017: Good morning and thank you for the update. I assume you explained to them that the issue with their last offer was that it does not address the problem with the electrical lines having been buried too shallow. I'm disappointed they are ignoring that issue as it leaves us with no chance of a resolution. I must also decline their last offer as it would mean that I have wasted all of this time and effort and have to start over with a new contractor. If they can come up with an offer that includes the issue of the power lines I would be agreeable to thatOtherwise, I will choose to hire someone to remedy all of the issues and will then seek reimbursement. I am rejecting this response because:
The response misstates the scope of my complaint My complaint is not merely that the wiring was done in a sloppy manner, but that the wiring was sloppy where it meets the house, the wiring was left exposed on the
ground, and the wiring was not buried to an appropriate depth The response inaccurately suggests that my dog digging may have somehow been the cause for all of the wiring issues As stated clearly in my complaint, however, I do not blame the business for anything having to do with my dog's digging However, my dog's digging revealed the fact that the business had buried the wiring only two to three inches deep, or less, in some yard areas Furthermore, my dog's digging did not have anything to do with the jumble of wires were the wiring meets the house or the wiring that was left exposed along the brick patio.The business states that the wiring was buried three to four inches deep in all areas This is inaccurate Further, the business does not offer any support for its claim that three to four inches deep is consistent with industry standards The business suggests that the lifting of my patio and the use of a conduit must be done to address my complaint, and this work was not included in the estimate However, the business's failure to bury the wiring to a sufficient depth in the yard area has nothing to do with the patio or conduit Further, the sloppy manner at which the wiring was left where it connects to the house is a couple of feet above ground and likewise has nothing to do with the patio or a conduit It is also not credible on its face that in the absence of lifting the patio and using conduit, the business had to leave exposed wiring in the manner they did I can supply pictures of this upon request To my recollection, the issue of a conduit and/or lifting the patio was never discussed or suggested at any time before the business's Revdex.com response The business's response states that when I contacted them about the issues, they agreed to perform the remedial work but then when they did not respond quickly enough to me, I withdrew authorization of permission for them to enter my property This is misleading in my opinion I contacted the business about the issues with the work on April 16, The business responded promptly two days later that hoped to be doing some work on my street in the coming week, and that they would come by to take a look at the issue However, no one from the business came by, contacted, me or attempted to contact me that week On April 29, 2017, the business contacted me and told me they had not forgotten about me I thanked them and asked them when they could get to it Three days later, the business responded that they would be in the area that day, and asked for access to my property I responded within minutes, told them how to access the property, and unlocked my gate for them However, no one from the business came by the property Instead, I received a message from the business that night telling me that an unexpected load of trees had arrived, but they would get the issues at my property taken care of that week No one from the business came by the property, contacted me, or attempted to contact me that week, or the following week, or even the week after that On May 21, 2017, I contacted the business and asked them when they would come by the property I also offered to hire another vendor to remediate the issues and have the business reimburse me for the expense The business responded promptly that they would take care of it themselves Given that it had been five weeks since I first contacted the business about the issues and they had repeatedly failed to show up when they said they would, I responded that I would need to seem some progress within the next week I received no response, and no one from the business came by the property, contacted me, or attempted to contact me that week Therefore, on May 31, 2017, six weeks after I had contacted the business, and only after they had repeatedly failed to show up when they said they would show up, I notified the business that I would file a complaint with the Revdex.com and take other appropriate actions I received no response from the business In fact, the business did not respond until after I informed them that I had made a complaint with the Revdex.com In light of these facts, it is misleading for the business to say that I revoked permission for them to enter my property because they "did not respond quickly enough" to my communications I decline the business's offer to install lift my patio and install conduit I also decline the business's offer to remove all of the wiring and the transformer and refund my money I do not want to deal with this business any further given their repeatedly failures to do what they say they will do Further, these offers fail to address the fact that the business left jumbled wiring where the wiring meets the house, and left the wiring inappropriately shallow in some of the yard areas These offers also fail to address the fact that I have spent, and continue to spend, hours of my time attempting to get this business to do what they contracted to do I will not spend any more time dealing with this business other than to recover sufficient funds to compensate me for the expense of remediating the issues with their work

10/6/2017: Mediator called Mr*** *** of the Law Offices of *** and *** to discuss the complaint as there is a fax dated 6/7/that states Mr*** will be handling the matter from thereon outHe was unable to find any material regarding the matter and stated that he would call Mediator back once he found the materials.10/6/(via Mr***): I will inquire with my clients whether or not they are still willing to come back out and complete the workAdditionally, I will ask them to specify why the patio would have to be lifted in order to complete the jobI will get back to you sometime next week after I have spoken with them.10/11/2017: Mediator called Mr*** *** back at his request and left a voicemail10/11/2017: Meyer Landscaping will send someone out to Mr***'s property within the next two weeks in order to reassess the property and see what all needs to be completed in order to remedy this situation.10/18/2017: Meyer Landscaping is unwilling to come during the parameters set by Mr***They have no intention of speaking to Mr***, they are simply wanting to inspect the property to see what, if anything, should be done with the property going forward10/18/2017: Mediator called Mr*** to relay Mr***'s clarification in regards to his request to be present at the time of inspection10/27/2017: We're not going to pick a defined time and dateMeyer Landscaping is simply going to come to the property when they canWe don't want him thereMeyer Landscaping will only come out if the terms are agreed upon11/3/2017: Mediator called and left a message.11/8/2017: I guess we are just confused because wouldn't giving a minute heads up be basically making an appointment? Nonetheless, I will give the business his phone number and see if they are willing to come to his property on these termsFurthermore, I don't understand what resolution he is seeking exactlyHe seemed satisfied with the work my client did, but then filed a complaint with the Revdex.comMy client is willing to come back out and look at the property, but there is no guarantee that they would see anything that needs to be fixed.11/29/2017: My client called Mr*** and waited the requested minutes before entering his propertyUpon their inspection, they did find about $worth of work that needed to be doneThey are willing to absorb this cost if the consumer then agrees to close the complaintI will send an email detailing the list of work that Meyer Landscaping would be completing upon agreement to the resolution11/29/2017: Ms***:As a follto our conversation a few minutes ago, my client, after the requested notice to the Complainant, inspected the Complainant's property.As a result of its inspection, my client proposes to provide the following additional services:• Remove the brick along the east side of the basement staircase and place the low-voltage landscape lighting wire below grade;• Place the brick back to its prior location;• Above grade, the low-voltage wire will be secured to the exterior brick wall with cable clamps and masonry screws to the transformer;• The electrical power cord from the transformer to the existing outlet will be rerouted and secured in the same fashion mentioned above.The cost of this work is estimated to be $325.00.
