Went and visited MrBrock days after I received a notice of a complaint being filed I was surprised to get the complaint as I had recently met with MrBrock and collected the final check I asked him if there was something I could do to correct any items that may have been left undone He said no In the process of installing his roof we did some extra work on a new addition that he was building by trimming the perimeter decking and installing ice and water shield on the entire room addition at no extra chargeOur original gutter guy that we assigned to do gutters on MrBrocks house had a tragedy in his life with the passing of his father and we spent considerable time trying to reconnect with him but were not ableWe are sorry for the delay in getting his gutters done on a more timely basisWhen we did get another gutter crew assigned to this job they did not install a downspout correctly I had another gutter crew fix the issue to MrBrock's satisfactionRegards, [redacted]

If no reason is received your complaint will be closed as Assumed Answered] Complaint: [redacted] I am rejecting this response because: 1) I didn't ask for the skylights to be replaced, but the skylight flashing was supposed to be replaced since it did show visible hail damage. [redacted] replied on 7/20/2015 by e-mail stating that he believed the flashing up the sides of the skylights were replaced but not the top and bottom caps. I don't know why he is now reversing his statement by now saying that no flashing was to ever be replaced or ever was. I have contacted the local rep of the flashing, [redacted] at [redacted] (###-###-####), and they don't offer parts to the flashing kit, just the entire set. I also had [redacted] personally inspect all the flashing on the skylights and he stated that none of it had been replaced. Also, $590 was added to the initial estimate and additional flashing was listed as one of the reasons on my final bill that was approved by [redacted] Insurance. 2) The last time the repair man named [redacted] was sent to correct my skylight blinds on July 9, 2015, he stated to me that nobody else in the company knew how to fix the blinds since [redacted] had left the company. Also, I was told that they didn't want to do any more repairs on the blinds since they had lost too much money on fixing them already. To me, in my opinion, that was your company stating that not only they wouldn’t help fix the issue now, but even in the future while still under workmanship warranty. 3) I was not able to file a claim with Liberty Roofing insurance carrier since [redacted] had already filed a claim on my behalf once I had requested his carrier insurance information due to unwillingness to address any of my concerns found out by an independent roofer [redacted] Roofing and mold specialist, Michale [redacted] (###-###-####). Since [redacted] initiated that claim I find it hard to believe he would have not known that the claim had been unresolved or denied. 4) My concerns on the contract violation was not addressed in his response. I had provided evidence of this by product receipt submitted from [redacted] Supply provided by [redacted] from Liberty Roofing, which shows two different shingle manufactures on the billing sheet. I paid for a uniform roof with one product from one manufacture as listed in the contract. 5) On January 20th, 2016 I was told by phone by [redacted] (###-###-####) that [redacted] from [redacted] Insurance has denied my claim due to lack of liability insurance coverage for Liberty Roofing at the time of the claim. Since then I have not had any luck in reaching [redacted] by phone, voice mail message or e-mail message since. Nor has anybody names [redacted] ever contacted me stating that they were either working on my claim or had denied it. I was only contacted by the following. i) Claim number: [redacted] . [redacted] didn’t believe both reports from [redacted] Roofing and [redacted] Consulting nor did he believe the damage to the pipe jack was caused by Liberty Roofing. By doing that repair, in my opinion, Liberty Roofing was accepting fault for damaging the pipe jack during the roof tear off and install and any insuring damage from water entry, otherwise it should have been left in place so a proper insurance investigation could take place. I also asked Liberty Roofing via e-mail to save that piece of equipment for reference in the insurance claim investigation since it was taken from the site. Regards, [redacted]

We have been working with the ***'s to repair a wall on the exterior and interiorPatrick, an insurance adjuster from *** *** *** said that If Liberty Roofing would agree to make the repairs he noted in the insurance scope of work to be performed and that if The ***'s
would send the insurance check back to *** *** ***, that *** *** *** would drop the insurance claim against the property and against Liberty Roofing Inc.Liberty Roofing Inc, in good faith made the repairs to the exterior wall assuming that the ***'s, in good faith returned the insurance claim check to *** *** *** and dropped the claim as agreed.Liberty Roofing was in the process of setting up for the interior repair when we learned from Patrick at *** *** that the ***'s had not sent the check back to *** *** *** but had cashed it insteadAt this point Liberty Roofing informed Mr*** that we would resume repairs to the interior wall when *** *** contacts Liberty Roofing Inc to inform us that the ***'s have returned the insurance money to *** *** and that the claim has been dropped.We are anxious to complete the repairs.If the ***'s choose not to return the claim money to *** *** *** and drop the claim within business days of this response, then Liberty Roofing Inc will assume that the ***'s have chosen to use the claim money to complete the work themselves or to hire another contractor to complete it as they determine

I am rejecting the claim of MG Stone for the following reasons:1. I got the phone number and information for the plumber from them so how do they make the statement that they had nothing to do with the plumber. 2. The estimator was the one who made the contact and set up the time and date for the plumber to come out to my home for the installations. 3. How many other people have been given the same type of information I was given and the same type of arrangements with the recommended plumber. They did not simply give me the names of several plumbers and I picked this one. This is the only plumber mentioned yet they say they don't have involvement.Yes,, I agree that I paid the plumber but the cost was given to me by the estimator at MG Stone. If they have no responsibility for the mistakes of the plumber why did they involve themselves at all. Why not simply say you will have to make separate arrangements with a plumber or plumbing company on your own. By virtue of the fact that they gave the name, made arrangements with the plumber, etcwould certainly imply that they are involved.As for their documentation, it does not relieve them of responsibility when the above facts are considered. Their actions clearly show involvement in the process.Thank you. *** ***

That being said the square footage remaining is 34.06. I spoke with [redacted] on 1/21/16 and [redacted] on 2/9/16 at 4:05 in response to the message left on my cell phone from [redacted] on the 9th of January to address this issue. I have yet to hear back. To resolve this, seeing as I have moved to Omaha and I am not in the state of Co[redacted]do anymore I will except the following. One reimbursement check of $135.15 and I will except his square footage count of 29 square feet which you have proposed and I do not want the remnant as I am no longer in Denver. This reimbursement should be for 29 square feet @ $28.45 a square foot in the amount of $825.05. If MG Stone agrees to these terms I will accept this and consider the case closed. Seeing as we are in agreement of the refund of $135.15 I would like a check sent to our new address [redacted], while we continue to discuss a solution. We are attempting to locate the remaining stone from Ms. [redacted]'s purchase from [redacted] on 11/30/13 and if there was any leftover stone. Even though 26.57 sq. ft. was billed, it does not necessarily indicate there is 34.06 sq. ft. remaining. There is approximately 15-20% waste when cutting slab. ...

I have tried to explained myself as best as I could of the problems with Liberty Roofing work.Here is a list of reasons and demands on what I feel will remedy this issue.1.       Liberty Roofing was contracted to do everything on the claim except for the Skylights and to use that depreciation money towards skylight blinds.  Skylights and skylight flashing kits are two separate products.  I was paid already by insurance for the price of the skylight blinds with the depreciation value of the skylights.  At no time did I instruct Liberty Roofing to file an additional fraudulent claim amount to [redacted] insurance to pay for a new product that wasn’t included in the claim.  Therefore, I demand the replacement cost of $590 to replace three skylight flashing kits from [redacted].2.       The reason again on why I asked for Liberty Insurance carrier information was due to the rejection of my initial observations of witnessing leaking in the flue pipe and failing to fix it which caused more water damage. Also Liberty Roofing further rejected independent inspections that showed there was issues with the roof install and the actual existence of mold damage upon the second visit to fix the leaking roof.  Therefore, I demand a payment of $700 for the mold and roof inspections.3.       [redacted] from Liberty Roofing agreed last time that two different shingles were used on the roof as shown on the invoice from [redacted].  Therefore, I demand a full refund of the cost of the roof material and labor for replacement of approximately $6,500.4.       [redacted] didn’t mark the flue pipe as previously damaged nor needing replacing on initial inspection nor on [redacted]’s first visit to fix the roof leak.  Also it was found by [redacted] Roofing as damaged due to a cracked solder joint rather than rust.  Also the furnace inspection by [redacted] Heating and Cooling found the heat exchanger heavily rusted and recommended replacing the entire system.  Therefore, I am demanding the full replacement cost of my HVAC system at $10,500 due to water entry from the damaged flue pipe jack.5.       Due to mold damage to my house found by [redacted] Consulting I am demanding $3,225 for mold removal services and $1,800 for insulation replacement.6.       [redacted] from Liberty roofing had already refused to do anymore work on the skylight and stated that nobody else in the company new how to repair them. Therefore, I demand a payment of $175 for the cost of [redacted] Skylight to come out and fix the jamming issue in the skylight blind in the sun room.   Here are my additional comments to Liberty Roofing’s reply.According to my contract carbon copy, I only signed the “Insurance Proceeds Option” and was told verbally by [redacted] that I didn’t need to sign the secondary “Acceptance of Contract” provision and wouldn’t be held to all the provisions as stated, especially for provision #19 since I found the wording of that provision to be essentially a “get out of jail free” card.I still have not received any denial letter from [redacted] Insurance of why the claim was denied, what the results of the inspection yielded and what provisions were not covered.I had contacted Liberty Roofing by e-mail at 1:02 PM July 21st 2015, on the same day of realizing that [redacted] had taken the damaged equipment off site that was part of an insurance investigation.  I feel that should have been soon enough to have [redacted] retrieve that equipment after of disposing of it.  Without it, neither [redacted] Insurance nor my own Insurance carrier will cover any damages since they require the ability to inspect the damage by themselves regardless of other independent inspections and documentation.  Regardless if [redacted] heard me or not on to leave the equipment behind for the insurance investigation, it should be common knowledge to not destroy evidence once a client has asked for a claim to be filed, especially when Liberty Roofing felt that they were not at fault.  Liberty Roofing has offered no evidence nor showed me any evidence that Liberty Roofing was not at fault for damaging the flue pipe jack.
