To the best of our knowledge, Mrs*** was of sound mind and body when she made the purchase on April 19thThere were absolutely no indications that she wasn't completely aware of her decisionThe day free look written on the contract in bold next to her signature was good through April 21stShe could have returned the item and received a full refund during that periodOn April 27th at approximately p.m., Mrs*** verbally verified on a recorded line with the finance company that she agreed to all of the terms of the purchaseThe first indication that she changed her mind was on May 15th, almost a month after the purchase, when she and her pastor came by the office before we openedOn Tuesday May 16th, we received a voicemail, prior to our office hours, from her pastor stating that she was upset and wanted to cancel the purchaseHe was immediately contacted and it was explained to him that the contract had already been sold to the finance company and no longer had any type of rescission rights

We were saddened to hear about [redacted]'s passing and our sincerest condolences to her friends and family. As many of our customers...

do, [redacted] chose to purchase our product using a 3rd party credit company, which we do help facilitate by processing the paperwork. We have no direct affiliation with any of the credit companies. Due to [redacted]'s credit rating, the credit company required a co-signor in order to accept the debt. We do offer a free no-risk 3 day look period, during which time customers can cancel for any reason. After that time, the agreements are assigned to the applicable credit company as non-recourse loans and we are no longer a party on the contract. As far as the 30 days referenced in the complaint, that was never expressed by any representative of Health and Home. All cancellation terms and instructions are clearly marked in bold letters on the Purchase Agreement, which [redacted] and the complainant both signed. The total price appears clearly twice on the Purchase Agreement, as well, and was never indicated otherwise. The timing of [redacted]'s passing is certainly unfortunate, and we are certainly sympathetic to the complainant's situation, but the contract now resides between the co-signer and the finance company. All corresponding documentation will be gladly provided upon proper request.

I do understand that this company may no longer be responsible or able to release me from this contract and that my complaint might only be the responsibility of the finance company called [redacted], which I have also made a complaint against and have an active cade number for.
I do object to the price [redacted] was being charged for the hyla vacuum. It does state the price on the contract that we signed, and neither she nor I gave any notice to, as we knew that was the original price, and [redacted] was told her discount would be applied and she would be paying a little over 1400.00 dollars for the vacuum. She and I discussed this verbally in from of the sales guy and he never once corrected any of those comments. I also believe it is unethical for home and health to turn over the contract in 3 days to a finance company, and release them of any responsibility to the consumers that they so blatantly take advantage of and lie to. I am not happy with their response. But don't know that I can get satisfaction from this company on this issue. [redacted] was never told this was being forwarded to a 3rd party Finance company, she nor I understood that at all and thought her payments would be made to health and home.
I am willing to persue my complaint with [redacted] and disregard my complaint with home and health if that is what the Revdex.com advises me on this complaint.
I do not know what the law states on this matter and want to make sure I don't hive up any of my rights to fight this in the future. I need to know that I am doing everything I can to have the vacuum returned and be released from this contract.
I am willing to do whatever you advise at this point.
