I am *** ***, owner of Ramirez Auto BodyI have been in business since On April 16, 2015, Mr*** *** drove his *** and dropped it off for an estimate to repaint his vehicle complete and redo the upholsteryApprox 1-months before this Mr*** sent me some photos of a
vehicleThe vehicle that Mr*** brought to my shop was a different vehicle than the one in the photosI questioned the photos and the different vehicle and he said he sold the original *** because it needed to much work and was going to use the one he recently purchased as the body was in better condition and the paint was really nice (appeared to be recently painted)I explained to Mr*** about the risks and warranties about putting new materials on top of pre-existing materials if the vehicle is not sandblastedAlso, I have a posting in my shop in two different places re: our warranty policyOn the first work order *** dated 4/16/lines and clearly state,” NO SAND BLAST”Mr*** read and signed the work order to start repairsWe inspected the vehicle and repaired any minor imperfections that we foundI contacted Emery Brothers Upholstery, took the interior parts over to their shop, to have them start the upholstery workEmery Brothers was only charging for labor as I supplied the material that Mr*** picked out, see line number on work order ***From 6/1/thru 6/15/Mr*** came into the shop to inspect his vehicleHe told me that I was not going to be able to complete the job on time and that he was going to have some other shop finish itHe also said, “ I’m not going to pay the remaining balance($at the time) because the job was not completed”I told him he was not going to take the vehicle out of my shop as I have completed 90% of the repairs and I still have two weeks left of the original time frame for completionMr*** said he was going to take the vehicle and not pay the balance and if I wanted to, I could take him to small claims court to try and collect the balanceThe paint work was complete at this time and the only thing left to do was get the upholstery from shop and install it which, could be done within the remaining two weeksMr*** started arguing and raising his voice and not trying to communicate in a rational manorIt came to the point that I was feeling threatened by him the way he was actingI tried to keep my distance from him and call He walked over to the keyboard in my shop and grabbed the keys to his car, jumped in it to try and take itI ran over and locked the front gate so he could not leave the premisesHe got out of the car and started chasing me around trying to intimidate meHe then showed me some kind of Law Enforcement Badge and said he was a Police Officer and said once again, Im taking my carA Stockton Police Officer showed up moments later and started talking to himI told the officer that the vehicle will be ready for pick up in weeks on the time we agreed, which was 6/25/While officer was present, I once again explained the warranty policies and Mr*** said I never told him about the warrantyI showed him the work order *** that he signed and the posted signs on my shop wallsThe Stockton Police Officer explained the Mr*** that he cannot legally remove the vehicle without paying the balanceMr*** came back on 6/25/after repairs were completed and paid the balance and leftAfter or months, Mr*** called me and told me the vehicle rear top quarter panel where the rear glass molding sits, had a small crackMr*** brought the vehicle back to shop to repair the crackI explained the crack issue was because the molding was tight and the pressure caused itWe repaired the cracked area at no chargeI explained it was going to happen againApprox 2-months later Mr*** brought the vehicle back one more time to inspect the paint because it was cracking in multiple areasI verbally explained about the old materials under my new materialsI told him I was very busy at this time but if he left the vehicle, I would inspect as soon as I had free timeIn December I had to fly to Mexico for a family emergencyMr*** said he was trying to call me however, I did not have any cel coverage in Mexico therefore, I did not get any of his phone callsMr*** picked up his vehicle and said he would bring it back when I returned but never didRe: work order #***, below line it states, “ shop is not responsible for cracked paint or bubblingMr*** was givin the original copy and paid the balance off of this work orderHe now states “ that I crossed out the line and he and I initialed it”However, I did not cross out the line, Mr*** altered the work order *** by crossing out the line in question and told me,” If I did not initial it, he would not pay the balance due because supposedly I did not advise him of the warranty policy”Look forward to hearing from you on this matter
