Just to be clear, I am dropping the complaint even though I disagree with the response from Mr. [redacted] (i.e., the response to complaint ID [redacted]).Many elements in Mr. [redacted]'s response do not address the complaint that I brought. Mr. [redacted] planted a number of plants without consulting my wife after my wife told him not to plant anything without talking to her. This is our central issue and Mr. [redacted] does not address that issue. Also, while Mr. [redacted] states that we do not need a retaining wall, he is wrong. We had a very expensive lift put in to assist my wife, who is disabled, and I put in a small retaining wall to prevent the soil in our garden from flowing under the lift, which would have been very problematic.
Nonetheless, I have decided to drop the complaint. I have paid Mr. [redacted] his requested $265.00 because I feel that is a fair value since we ended up using some of the plants he planted even if we did not ask for them.

Review: Mr. [redacted] has performed gardening services for us for several years. This year we had a lift put in the front of the house which necessitated using some garden space, making the garden smaller. Also, some soil where the lift was placed was removed and put on top of the remaining garden area. This soil was clayey and not suitable for gardening without enhancements. After the lift was put in, we needed a small retaining wall installed to prevent soil in the garden from running off onto the lift. I put in two small plywood boards as an interim step. Without my approval or my wife's approval, Mr. [redacted] came and removed soil from the garden and replaced it with new soil. This was before I could have a retaining wall installed. I had intended to ask Mr. [redacted] if he could do this, but did not get the opportunity. After he brought in the soil, my wife told him not to do anything more without her approval. Mr. [redacted] replied something like, " I know what I am doing. I have been doing this for over 30 years." He then came a few days later and planted the garden with plants my wife did not ask for and which he did not get approval for. My wife is disabled and has difficulty hearing, so she was not even aware that he was at our house doing the planting. When she found out he had put plants in our garden, she fired him.Desired Settlement: I am willing to pay Mr. [redacted] for the soil he put in and the preparatory work he did on the garden. However, I do not want to pay him for any of the work he did or the plants he planted in our garden. I am in the process of installing the small retaining wall myself and we will then be removing all the plants Mr. [redacted] planted and putting in different plants. My wife wanted to change the type of plants in our garden and she never got the opportunity to discuss this with Mr. [redacted]. This comes to $215 of the $337 bill he sent us ($125 for bed prep, $50 for hauling and disposal, and $40 for composting).
