Despite my best efforts, funds coming to me have been delayed by several weeks, so I have been unable to make a refund to date. I expect to be able to make a partial refund within 1 week, with the balance to be refunded in July.

Review: [redacted] was hired as our wedding photographer for our ceremony on April 20, 2013. [redacted] told us that he would send us a link to our pictures after the wedding for us to pick which ones we wanted in our albums. He said once we chose the pictures, it would take 2 to 3 months for the albums to be made and sent to us. We selected the pictures in September 2013. In October 2013, [redacted] told me we should have our albums by late January 2014 or early February 2014. We did not receive our albums by then so I contacted [redacted] in early March. He then told me that due to circumstances beyond his control, things were running a couple months behind. A few weeks later I still had not received anything so I emailed [redacted] again on March 25, 2014 asking to have my money refunded. He emailed me back saying that his bookings had slowed down and because of this, he didn't have the money to fulfill some of his orders and therefore canceled albums in progress. He said that he would refund my money to me in full, but that that it would probably be 30-60 days. I emailed him back asking that he refund my money by April 18, 2014. On April 18th, [redacted] emailed me to say that he would not be refunding my money because I was not willing to work with him, but instead would get the albums done. He sent a link in the email with his proposed layout. He told me I had until April 25th at 5pm to make any changes to the design. If I did not let him know of any changes by then, he would assume an acceptance of the design 'as is' and would start the printing process. I again told him that I wanted my refund. As of today, we still have not received our refund.Desired Settlement: To receive our refund of $2,619.75

I am trying to work with [redacted] to resolve their issue. Let me explain my situation, which was explainied, in detail,, to the [redacted]. In the Fall of 2013, bookings suddenly dropped off severely and have not picked up since. In order to pay my bills and not have my house foreclosed on, I have to use the cash reserves I had which are normally reserved for album production. I expected a normal amount of bookings in the Winter and Spring, which have not occurred. From conversations with other photographers, this seems to be an area-wide trend at the moment, and we are all unsure of what to do about it. I have cut my pricing to rock-bottom to attract bookings and cash-flow to fulfill album orders. I have also been seeking outside employment, unsuccessfully so far, to achieve the same goal.

As forr the [redacted], I initally agreed to refund the album portion of their contract, but explained the refund delay due to cash-flow issues and hoped to have it within 30-60 days, and perhaps pay it in installments as they paid me for my services. The album amount is $1500, plus sales tax. They have received $1000 worth of services, including the digital files from the wedding, so the entire amount is not refundable. In fact, per the contract they signed, I am not required to provide them with any refund unless I was unable to provide any service at all. The album delivery has no set timeframe, and my web site specifies that there may be delays due to various reasons, however under the circumstances, I was willing to work with them to resolve this.

I only rescinded my refund offer when the [redacted] issued a two-week full-refund ultimatum or legal action if I did not comply. I am still willing to give them the partial refund, and I am trying to get the funds together as we speak. They have been informed as much.

I am still seeking alternate employment, and I am continuing to offer exceedingly low pricing to attract new bookings. I am also in the process of selling any items I have of value that are not essential to the operation of my business in order to fulfill my obligations to the [redacted] and other affected clients.

I should have the funds available within the next 30 days to refund the [redacted] the $[redacted], plus sales tax.
