Complaint[redacted] did my wedding photos 2003. I recently contacted him in needing my album and some photos that was part of my package. I had talked to him in [redacted] He said he would get those photos together and give me a call to meet and pick those up. He promised he would call me in a few days. Never heard from him leaving him several at least (6)no return call. I call again I get him this time and he tells me again we will meet, this is now [redacted] he will call me with a date never heard again. I call again in [redacted] and told him I need these pictures for [redacted] he said that shouldnt be a problem and we will meet once he finds the pictures, I said find the pictures he said yes in storage. He goes on to tell me he has moved but he knows were they pictures are. I than call at the end of [redacted] his home # he gave me, his cell work # for a different business he is now doing.He will not return my calls. I am so upset that he has either misplaced my photos or something has happened to them. Further more I cant even make copies of what I have becasue the proofs I do have have numbers across our faces. He was paid in full for all services and packages!When we orignally sat with [redacted] he said that he keeps all proof and we would have to get reprint and albums from him I couldnt use another company to print. I mentioned to him that this was a concern of mine because of something like this to happen or that they get destroyed on accident, ot that something should happen to him , himself were does that leave us with obtaining photos.Product_Or_Service: wedding photographyDesired SettlementI would like the albums promised and copies of all my photos, and now all my proofs that I dont have to have this issue again.Business Response [redacted] and her husband, [redacted], got married in [redacted] of 2003. In [redacted] of 2003 they met with me and picked up 221, 4X5 photographs for review and made a follow-up appointment for [redacted] 12, 2003 J 11: am to go over the selection of her photographs and design of her album. She never kept her appointment nor did she call to reschedule.In [redacted] of 2004 I ran into Ms. [redacted] and her husband at a wedding that I was attending. In casual conversation I mentioned to them that they missed their appointment with me to go over their photographs and that we should reschedule at some point soon.She may or may have not mentioned that we actually did meet to design her album approximately four years ago, (7 years after their wedding). At that time, my business was closed and we met in the dining room of my home. We laid out her photos of how she wanted them in her album. When I gave her a balance of what she would owe me in addition to what she contracted me for in 2003 she was displeased and said she wanted what she wanted and did not want to pay me a dime more, and if she did have to pay more she wanted to discuss this matter with her husband first before making any decisions. She took the photographs, left my home and that was the last time I heard from Ms. [redacted].As to her complaint, Ms. [redacted] did contact me early part of this year needing photos before her 11th year anniversary. She called me at my workplace which I had no problem with because I had given her two contact numbers for me. Within that same week I called her twice at her place of employment and left messages and never received a return call. In her complaint she said she called me six times. I can only assume not the landline at my workplace the one she knows she can get a hold of me.In the most recent turn of events, Ms. [redacted] called me on [redacted] 2014 at 3:20pm, at my workplace at which time I told her that I could call her back in 25 minutes or at 3:45pm. She stated that was not convenient for her and we both agreed to a time later that evening (approximately 6:00pm) and provided me with her cellular number, XXX-XXX-XXXX. When I attempted to call her I got a message that this was not a working number. I looked up her work number and called her the following day from my place of employment at 9:20 a.m. and left her a message on her voice mail. After not hearing from her I left her another voice mail on [redacted] 2014 at 6:00 pm. Page -2-In conclusion, I have no photographs of Ms. [redacted]'s wedding. I do, however, have 221 negatives. The photos that she has are no longer returnable and at 2003 prices I sold 4X5 images for $10 each, she has $2,210.00 worth of photos of which I only received $1,895.00 payment for.I believe I have provided my services to the best of my ability and Ms. [redacted] contributed to the inability for us to come to a mutual meeting, and agreement. My only interest is to provide the scenario of events as they happened and future resolution would have to be through legal matters should Ms. [redacted] choose to take that route.Respectfully,[redacted]Consumer Response I am also responding to [redacted] Mislaks response. His services were paid for in full. There wasnt a balance, there was never any mention of a balance during any of our conversation. The package that I paid for I am intitled to 3 albums. That is what I am asking for. He has told me during several phone calls that he hasnt had time to locate the negative due to his job keeping him busy and that he has moved and will need to locate the negatives. We did have an appointment as he stated, I called him to confirm the appointment and asked if he has located them he said he had not, so I did cancel at that time. There would be no need to meet with out the negative. He also mentioned I had the proofs, they are not good to me, when he intentionly marked them so that they cant be copied, I understand that so that one can not copy them and would have to go through him to make copies. What I am asking for is just what I paid for, I did not recieve the service to our contract. Albums are still owed. If that is the problem he I will be ok with recieving the negatives and I will print my own. All though that would not be my first choice.I think [redacted] and I can sit and get through the albums and move forward from this . At least this is what I would like to do.
