Good Morning,Kurk Homes is currently working with Mrand Mrs*** to address their concerns. (Attached is an email written yesterday memorializing the current status). As noted in the email, there was an interoffice mistake that caused a misunderstanding regarding the status of the ***'s warranty. As the President of Kurk Homes, I spoke with Mr*** yesterday expressing my sincerest apologies for the error that caused so much understandable frustration. It is expected that the work at their home will commence soon. We are looking forward to resolving this matter for our customers. Thank you for the opportunity to respond to this complaint. Sincerely,Chris M***, PresidentKurk Homes

Mark with the *** *** *** *** *** has been instructed for weeks to turn in his vendor paperwork and copy of insurance to Kurk Homes. On Friday, 11/27/15, he texted me he would not sign our vendor paperwork and will be pulling the equipment off the
jobsite. I have a copy of that text. The homeowner, Mr ***, send me an email on 11/informing me that Mark would be sending in his paperwork and insurance. On Wednesday, 12/2/15, Mark told our *** *** office manager that he already sent in the paperwork. I confirmed with both the *** and *** *** offices that he did not send it in. He did get us a copy of his insurance, just started on 11/30/15, and signed our paperwork at our *** *** office on Wednesday afternoon,12/2/15, and we gave him the check for $7,155. Although an agreement was made to provide a check to *** *** upon the start of work, it was dependent on him completing our vendor paperwork and providing a copy of his general liability insurance. During the time of *** *** delivering equipment and finally getting paperwork he called both offices an harassingly amount of times and would scream "where's my *** *** money?" Good Evening,We are in communication with the painting contractor and both of us have agreed to repaint the treads for the exterior staircase. We will bring in a little dirt to fill in around the septic tanks.Sincerely,Chris M***

***,I apologize for the inconsistency It has been a busy year but with your comments I remember the agreement to the Revdex.com complaint I'll have Larry get a trade out to add dirt to the area that settled around the septic system

Thank you for the opportunity to address and provide response to this complaint. An email was sent to the homeowner after the complaint was received and the homeowner replied stating: "...I'll let you know when you can visit..." Five days later, the homeowner emailed
stating that a Kurk Homes representative would be allowed to come to his home any afternoon - "...the sooner, the better". A representative of Kurk Homes arrived onsite the next day to review the exterior door as described in the complaint. It was confirmed with the warranty log and the homeowner that the door had been addressed on a prior warranty call in May 2016. At that time, the lockset strike-plate was adjusted at the customer's request and to his satisfaction. A follwith the homeowner following the strike-plate adjustment confirmed the issue had been resolved. On the most recent visit, it appeared as though the deadbolt was slightly difficult to open. With the recent unprecedented / historic weather conditions in the area, it was suspected that the door may have experienced an atypical amount of moisture causing swelling; however, the Kurk Homes representative stated that the door reveals appeared relatively equal in size and the door appeared to open and close with ease. The Kurk Homes representative offered to further review and/or attempt to adjust the strike plate; however, the homeowner was concerned that movement would allow an opening with daylight and declined. The Kurk Homes representative stated that he told the homeowner that he would be happy to further review the issue should the customer later change his mind. When the Kurk Homes representative arrived onsite, the homeowner was quick to tell him that his wife was going for tests the next day and he had previously made Kurk Homes aware that he has asthma. It should be noted that the response of letting Kurk Homes know when we could visit when responding to the complaint came as a bit of a surprise. While onsite, the Kurk Homes representative performed a non-intrusive visual inspection in the area described as an area where the homeowner stated "mold" could be smelled. The Kurk Homes representative stated that he could only smell what seemed to be a lingering perfume type scent; however, an inspection of the readily accessible areas revealed no evidence of damaged materials and/or leak source generators. When the Kurk Homes representative attempted to communicate the information to the homeowner, he became irate and verbally abusive. The warranty representative attempted to calmly communicate with the homeowner and the verbal abuse continued. The homeowner stated that Kurk Homes could anticipate hearing from "their lawyer". The onsite visit ended. Kurk Homes is committed to providing services as outlined in the *** ***'s Warranty (Builder Limited Warranty and Performance Standards); however, the homeowner should be aware that future visits to the site will not include any Kurk Homes representative and/or contractor enduring such verbal abuse. It is unfortunate that the meeting ended as stated; however, Kurk Homes management will not allow the abuse of any employee or representative as described above. Kind Regards, Chris M***, PresidentKurk Homes

Regards, I appreciate the response from Shavauna, but with all due respect, MrB***, MrM*** and MrR*** have all known there was a contract prior to starting the jobThey were all aware of the draws from the beginningThere was no misunderstanding or miscommunication with Kurk Homes just flat out Breech of ContractBoth MrB*** and MrM*** are liars, they have always known of the contract periodI hope the Revdex.com does not hide this complaint on there websiteI want all contractors in *** and the *** *** *** to know what a fight it will be to get PAID!!!!!!!!!!!!! My response has nothing to do with MrsH*** or Mark R***Thanks *** ** ***

Good Morning,It has come to my attention that Mr*** has an executed contract with Mr*** as well as a sub-contractor agreement with Kurk Homes. The contract and agreement are not parallel in terms. I spoke directly to Mr. *** this morning and he stated that he has not yet generated an invoice for the amount of money he is owed (amount as stated on his prior response), but would email it to me when he returns to his office. In response, a check will be cut by Kurk Homes to satisfy the invoice. We previously believed the Kurk Homes responsibility had been satisfied in full. I expect this matter will be resolved shortly. It appears to have been the result of an unfortunate misunderstanding / miscommunication between parties.Kind Regards,

[As stated earlier, the Kurk Homes warranty department do not respond to emails or phone calls as Chris M*** instructed them to not provide any warranty work on our home. For him to respond now that we should contact them directly is disingenuous. We will work through the Revdex.com and you can negotiate on our behalf. We are awaiting the results of the independent mold analysis to proceed further. We have also engaged a third party inspection service to inspect the entire home for warranty issues and expect Kurk to address them all
