Review: I contract [redacted] to remove a tree for me for $3200. All of our discussions were about tree removal, his email to me specifically states the tree was to be "remove[d]," and my check memo line stated that it was for "tree removal." His crew came and started the work. I had to leave before work was finished for the airport. I called him during my lay over when he told me that he couldn't complete the job because the county told him he couldn't block the street. At that time, he promised to (i) come back within the next couple of days, and (ii) to not cash the check until the work was done. Ultimately, despite many broken promises and me having to make several overseas phone calls, the results were: (i) [redacted] cashed the check the same day (before I had even left the house and before he promised not to cash the check until the work was done) and (ii) he claims that the full $3200 was only for TRIMMING and not removing the tree; therefore the work is done. He even claims that tree removal for $3200 would be impossible as the job would cost $8000 for removal (this claim despite me telling him about his competitors bid to (i) trim for $975 or (ii) remove the tree for $3100). Furthermore, the job was clearly not finished when he left given the fact that his crew didn’t place my pots and plants back into place and left trash in my yard. These things indicate that the job was not complete and perhaps at one point they meant to come back. To reiterate, he lied several times about (i) coming to finish the work, (ii) not cashing the check, (iii) the scope of the job for which he was hired. Again, all our conversations were about removing (not trimming) the tree, his email states "remov[al]," and my check states "removal." It’s been several weeks and [redacted] has stopped returning my phone calls or responding to my email. I can document (i) his email, (ii) my check, (iii) the competing bid for tree removal for $3100.Desired Settlement: I don’t want to see [redacted] again. I want a refund. To be more than fair, I’ve offered that he can keep $1100 of the $3200 for the partial trimming he’s done. He was not responded to his final offer. I want a refund of $2100.
