Complaint: ***
I am rejecting this response because:I hired *** to represent me in a relocation case. *** failed to file the objection in a timely manner, admitted 100% responsibility to the failure in court, and was then fired by me for her failure to represent me. She did not represent me for the remainder of the court hearing (many months after that). She was my attorney for approximately months. This is irrefutable and is well documented. Judge *** own words from that same court doc that *** references, page 2, line 3-- "Ms*** served Notice of Intent to Relocate with the children to Virginia on April 3, 2016. Mr*** files an Objection to Relocation one day late on May 4, 2016. Judge *** *** considered Mr***'s reasons(s) for filing the late objection and overruled his motion for reconsideration on June 10, 2016. In the Order, Judge *** found that Mr***'s objection was 'not perfected as he had not served the mother properly with the summons in this action." Judge *** permitted the relocation but appointed a GAL to investigate the case and report back to the Court for the adoption of an appropriate parenting plan. During the course of this trial, Mr*** argued against the children being allowed to relocate. Judge ***'s June 10, Order was binding and has not been appealed. The court will not reconsider it here." {emphasis mine}.If you refer to the Judge *** hearing, there were absolutely zero factors relating to my behavior, mental health, alleged alcohol abuse, etcthat went into Judge ***'s decision. The opposing counsel accurately argued that the law indicated that an untimely objection MUST result in the court awarding relocation, period.***'s failure cost me a significant amount of $$ while the court case was going on as the court immediately allowed my ex to relocate while the trial was going on and I had to pay out of pocket for monthly trips to VA to visit my daughters***'s failure also cost me a signification amount of money getting new attorneys to investigate if we could file a misrepresentation complaint to have the judge reconsider. I should not have to pay her for her failure. ***'s reasoning is similar to a person getting charged for keying someone's car and then later saying they should not be responsible because the car ended up getting damaged in another wreck weeks later. This line of reasoning is ridiculous.I paid for a service and *** failed to provide that service and is still requesting that I compensate her additional funds for her failure. If you notice in the Revdex.com response, *** takes zero responsibility for her failure to file in time, nor her failure to issue the summons until weeks later. And yet those are the exact two things I am complaining aboutIt is quite telling that *** is unwilling to address her own failures in this but instead tries to divert attention from her failure to provide a service. As I understand it, missing deadlines is one of the main sources of malpractice suites, and is not an insignificant failure as *** would have you believe. This kind of failure is unacceptable, and her insistence on getting paid for her services simply adds insult to injuryI have spoke to multiple attorneys about this and all of them indicate that the very least she should do is refund me my money. The only acceptable outcome here is for *** to drop her request for additional funds and reimburse me for the retainer and costs that I paid her to date. Even that leaves me at a net negative, but I want to be done with this and move on with my life
Sincerely,
*** ***

Mr*** has a view of his case which is inconsistent with the factsMr***'s case wasdecided at trial on the merits, including approximately two days of testimony from the children'sGuardian ad Litem who recommended mental health interventions for Mr*** to protect thechildren. The
court found that Mr***'s conduct negatively impacted his children's mental, physicaland emotional well-beingFor those reasons, the court allowed relocation, limited Mr***'scontact with his children and issued significant restraints against Mr***Enclosed is acopy of the court order which can be found in the public file of the King County Courthouseunder cause numberJudge *** conclusion was based on the following findings:• 2.33: " the Court is not confident, at this point, that [the father] is able to fully managehis jealousy, disappointment [and] anger."• 2.35: "The real problem with this decision flows from three areas: the first is Mr.***'s fixated belief in Mr*** and Ms*** perfidy; the second is hiswillingness to act out on those beliefs in ways that are damaging to this children ( e,g., thechildren being pulled from their classroom to be interviewed by CPS);and the third beinghis lack of insight to how these actions, as self-satisfying as they may be to him, actuallyharm his childrenThis type of conflict and passive-aggressive lashing out at Ms***,using the children as both shield and sword, is abusiveThe Court is unpersuaded thatMr*** has full control over these emotionsRather, it appears that he remainssingularly focused on being proved right about his suspicions and extracting some type ofpunishment from Ms***."• "Alcohol has played a role in Mr***'s recent troubles and the Court is notpersuaded by his assertion he no longer drinks appreciable amounts."2.39: "It is in the best interests of the children that they be permitted significantresidential time with their father, conditioned on him maintaining and progressing inmental health treatment and refraining from harassing Ms***, either directly orpassively."Enclosed is the full court orderI am sorry that the court ruled against Mr***, but theprocedural issue he identifies had no bearing on the ultimate outcome.Yours truly,*** * ***
