paid out on every item listed on the claim up to our shipper’s maximum
liability limit. Upon settling this claim we assume that the case is now

I am rejecting this response because: my perspective is that I was between two commercial trucksThe truck in front of me had something on the top of his cab which was blocking my view of the traffic lightIt was only after the first truck went through the intersection that the light was yellowI "suddenly stopped" on yellow because I would not have time to go through without causing an accident because there were other vehicles in the areaI was hit just as the light turned redI even have a witness to confirm that

Response to Complaint ID 12046618The events in question occurred on December 6, at approximately 2:p.mat the intersection of Queen Kaahumanu Highway and the road leading to Kona International AirportAccording to the Kona Trans driver, the car driven by the complainant stopped suddenly in
the middle of the intersection when the light turned yellow and he was unable to avoid hitting her carKona Transportation accepted responsibility for the accident and referred the situation to its insurance company, First Insurance Company of Hawaii, for settlement. After examining the car, the insurance adjuster determined the car to be a total loss based on the finding that the cost to repair the car exceeded the current fair market value of the carBased on its estimate of the car’s fair market value, FICOH offered the owner a settlement of $3,The driver has submitted an estimate of $8,to fix the car, which is clearly more than the car was worth at the time of the accident. Although Kona Trans understands this driver isn’t satisfied with the way insurance coverage works in this situation, Kona Trans’ insurance company has followed the proper procedures and has offered the appropriate compensation in a timely manner
