The complaint was submitted by one of our rental customers The rental agreement which was started in May allowed for the customer to apply 70% of the rental to purchase of the mowers The intent by the customer was to pay it off in the first month, this didn’t happen and the rental continued In late November with the mowing season over we requested the return of the mowers or execute the rental purchase On 11/28/we mutually agreed to payments on specified dates We received of the payments Since the 3rd payment on 12/9/was missed and customer refused to return the mowers we turned the matter over to the State Police and D.A’s officeThank You, Joe Joe [redacted] Mid Country Machinery, Inc
In response to *** ***: Unfortunately the purchase option was not executed at the agreed upon time and the customer is still be charged rent. The DA determined this is not a criminal matter but a civil matter, so we have turned this over to our attorney and we’re in the process of taking customer to court. I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. A complaint was filed by this company against me and the State police and the onadaga county DA has determined that there is and was no criminal acts committed and based on all the documentation proved to them have dismissed the complaint Mid county has received payment on these mowers and is attempting to continue adding rental charges ***
