The subject engine is a Mercury , model: Pro Series with serial number: [redacted] (years old) Mid Shore Boat Sales has never been nor proclaim to be a Mercury dealer We sold the pontoon boat, engine and trailer to the ***'s on July , This was sold on consignment with no warranty implied From the time the ***'s purchased their pontoon boat to the last invoice dated May 15, 2014, there have been a total of transactions A few of the purchases included are from May 25, and May 28, each time for one can of 2+Instant Gum Cutter Carburetor Cleaner and then on June 8, for two carburetor kits that the customer installed himself A clear indication that the ***'s were experiencing engine problems Within the first part of the customer's statement it reads that "it (the engine) was running but you had to tip the motor out of the water to get it to run once you shut it off." Because of this the ***'s assumed the carburetor floats needed to be adjusted and that was all that needed to be completed Furthermore how is the engine going to propel the boat if it is out of the water , so even though the engine was running it still was not moving the boat so the ***'s were stranded It also states that "What we got back from Mid Shore was a boat that would not run at all It would start and 500-feet from the launch it would shut down and not start at all." The statement is confusing because it first states that it "would not run at all" then the next line states "It would start and 500-feet from the launch it would shut down" so did the engine run or not? The bill for the work that was completed on the engine (a copy is attached with this letter) was for parts, shipping and labor The parts that were needed amounted to $shipping was $and labor was $for a total of $(not the stated $589) Mrs [redacted] was contacted before the parts were ordered and was given the amount that it would cost for the parts and also the full descriptions of the parts to make sure she wanted us to order them or if she wanted to order them , if she could get them cheaper She replied that she wanted Mid Shore to order the partsThe parts were ordered on April 26, It was found during the initial evaluation of the engine that the compression was low, a clear indication of the age of the unit Mid Shore replaced the carburetor flange gaskets , diaphragm kit, gasket sets, fuel filter, coil assembly and needle valve Mid Shore installed the parts needed to complete the job and test ran the engine Everything was running well at the time At the time of pickup , the ***'s were made aware that there was minor leakage coming from the carburetor bowl gasket due to the bowl having a minor dent The ***'s picked up the boat and received the bill We explained the charges on the bill and made them aware of the compression levels, Mid Shore was paid $on the date of pick up and it was agreed by all parties that we would be paid the remaining $through payments weekly for up to two months According to the ***'s and their statement , they took the boat out and it ran for 500-feet and shut off and could not get the engine to start The ***'s brought the boat back to Mid Shore for repairMr [redacted] brought in a purchased used carburetor that Mrs [redacted] purchased online No one at Mid Shore Boat Sales told the ***'s to purchase a carburetor on lineWe would never suggest to anyone to buy a used carburetor on line due to the fact that you don't know if you are purchasing a workable item The fuel had a bad odor, and smelled like varnish We came to the conclusion that the ***'s had installed bad fuel in the tank Because of the fuel issue, we took the original carburetor apart and cleaned all internal parts and again replaced the diaphragm kit, fuel filter , flange gasket, two gasket sets and adjusted the timing We also treated the fuel in the tank , added five gallons of fresh high grade fuel and also added two stroke oil After two days of observation , it was determined that the seals on the carburetor bowl had set and displayed no signs of leakage and the fuel had stabilizedWe test ran the engine in our shop in the morning and afternoon for three days for ten minutes each time at different RPMs with no problems and no alarmsIt was also decided to take the boat to the ramp and put it in the water and run the engine at different RPM levelsWe took the boat to the ramp and ran the engine for twenty minutes and experienced no problems When Mr [redacted] picked up the boat and the carburetor that he purchased, but we did not use, he was told of the work performed and that he could send the carburetor that he purchased back for credit It was discussed that even if the problem with the leakage from the carburetor bowl was not fixed , we would not install the purchased used carburetor because we could not be responsible for any problems that may arise from the used carburetor We would only install new ordered parts due to the fact that if there was an issue, we would be able to file a claim with the company from which the part was ordered We also explained that we were not going to charge the ***'s for the addition parts ($49.70) that were used and the six hours ($582.00) of labor that was consumed and the fuel ($19.85) by what we believe as a result of the ***'s adding bad fuel into their fuel tank We also talked with Mr [redacted] about the times we started the engine in our shop and the time spent at the boat ramp with to apparent problems To be clear, neither Mror Mrs [redacted] talked with our mechanic as stated in their Customer Statement The only communication has been between Mr [redacted] , Mrs[redacted] , Jerry Banks (Owner, manages service and wholesales) and [redacted] (Owner, manages parts, financing , A/P , AIR and HR) Mrs [redacted] called and talked with [redacted] and stated they were on the Nanticoke and the engine shut off and would not start After some discussion it was decided the engine was overheating that may result from the low compression (as stated earlier , most likely due to the age of the engine)The ***'s were told to lift the engine up, let it cool down, lower the engine, apply the choke and start the engine In the conclusion of the Customer Statement it reads "We took the boat to another dealer and this is what we were told The oil is leaking and mixing with the water ..." To be clear, there should not be any water anywhere in the engine nor in the tanksIs this indicating that more bad fuel (water in the fuel) had been added to the fuel tank which then mixes with the two stroke oil causing the oil to mix with the water in the fuel? If so, this would have nothing to do with the repairs Mid Shore performed The ***'s have stated that the desired settlement is $A total of the amount paid ($not the billed amount of $579.09) and $that was paid for the used carburetor (that we did not advise them to purchase) Mid Shore's reply to the desired settlement- The original bill was for $and paid only $with $to be paid within two monthAlso, be it known, that the second time would have been billed at $due to the bad fuel that was used in the boat- this was not something we did and could have billed, but we decided not to bill due to our relationship with the ***'s and wanting to help them out due to their limited working capital We will credit the remaining $that is owed from the only bill that they receivedWe feel this settlement is beyond fair and ethical Regards, Mid Shore Boat Sales, LLC

With regards to the letter from Revdex.com dated August 4, we feel that this complaint will not be resolved In the response letter dated July 17, it lists the facts as we know and we have no other information that can be added to the original response letter We do acknowledge the ***'s concerns and feel that we have gone above and beyond any ethical and moral obligation to rectify the concerns We will still offer the original settlement dated July 17,which states- Mid Shore's reply to the desired settlement- The original bill was for $and paid only $with $to be paid within two monthAlso , be it known, that the second time would have been billed at $due to the bad fuel that was used in the boat- this was not something we did and could have billed, but we decided not to bill due to our relationship with the ***'s and wanting to help them out due to their limited working capital We will credit the remaining $that is owed from the only bill that they received We feel this settlement is beyond fair and ethical

stated by [redacted] ***) We told [redacted] about this problem last year and he said at that point it sounded as if the float was sticking, We told him it would have to wait until after we got income taxes done and back We finally got the money to take the boat to them for repair After having the boat in their possession for three weeks we called to check the status of the repair, it was then he told me that the bowls were bent and said Mr Tharp bent them putting on the carb kitsIf that was the case the boat would not have run even tilting the motor last year When we picked the boat up the first time [redacted] told us the bowls were bent but he put a gasket in them hoping it would take care of the problem At that time he said he could not find bowls from any of his marine contacts or you put it under the stress of going through the water, that is when it would cut out and not start The boat was not river tested by Mid Shore, all they did was tie it to the dock and run the motor at different rpm's even after we told them that it would run all day sitting stillWhen we picked the boat up for the second time we went out on the river and broke down once moreSame thing, idled fine at the dock but when you started going through the water it would stop and not startAt this time I was able to speak to [redacted] and told him we were broke down in the riverIt was at this point that he said [redacted] told him the compression was bad and there was nothing else they could do for the boatWhen I inquired how we were supposed to get out of the river I was met with silence and we ended up spending hours on the water fighting the current until someone came along and towed us in As for the gas and oil that Mid Shore says were bad and had to be replaced, if they had replaced those they would have seen the debris of the fuel hose in the gas and seen that the deck fill cap and o ring was bad and needed to be replaced (please reference invoice from [redacted] )Also there was nothing wrong with the compression of the engine as verified by Mercury and [redacted] MarineWe did not put bad fuel in the boat, it was Mid Shore's negligence at not checking the fuel for debris and the oil for water It cost me another $to get the boat running properlySome of the same gaskets that MidShore say they replaced were replaced by [redacted] It was found that the bowls were not bent , but the gasket that Mid Shore put in the bowls were crimped which was causing the float to hang up and fuel not able to get to the carb(Again please reference the invoice for [redacted] ) We believe that due to questionable repairs, the bowls on carb not being bent as stated on Mid Shore invoice and the fact that if they had replaced gas and oil they would have found the debris and water that we should be reimbursed the amount of $which was paid to Mid Shore We have run the boat three times after getting the work done at [redacted] and the motor runs fineThere is no stalling or cutting out , the float now does not stick, and the fuel hoses are not dumping debris into the gas

To address our complaint against Mid Shore Boat Sales I would refer you the last line of the last page of HP.pdf. The serial number of the motor in question is [redacted]. That falls in the category of 1995 40 hp 30 Jet Pro Tracker series.  We did purchase this boat from Mid Shore , most of the purchases made at Mid Shore were accesories for the boat which included 2 anchors .As far as the carb cleaner that was purchased, it was suggested by [redacted] to try using this and getting the carb kits . We were told that they were easy to install and should help the problem. After replacing the carb kits the boat ran just as bad. We would have to tip the motor out of the water, start the motor, then lower it back into the water to move the boat (or propel it as stated by [redacted]).  We told [redacted] about this problem last year and he said at that point it sounded as if the float was sticking, We told him it would have to wait until after we got income taxes done and back.  We finally got the money to take the boat to them for repair.  After having the boat in their possession for three weeks we called to check the status of the repair, it was then he told me that the bowls were bent and said Mr Tharp bent them putting on the carb kits. full descriptions of the parts to make sure she wanted us to order them or if she wanted to order them , if she could get them cheaper.  She replied that she wanted Mid Shore to order the parts. The parts were ordered on April 26, 2014.

Also, be it known, that the second time would have been billed at $651.05 due to the bad fuel that was used in the boat- this was not something we did and could have billed, but we decided not to bill due to our relationship with the [redacted]'s and wanting to help them out due to their limited working capital.  We will credit the remaining
$189.09 that is owed from the only bill that they received. We feel this settlement is beyond fair and ethical.

We took our boat to Mid Shore in Laurel, DE because it was running but you had to tip the motor out of the water to get it to run once you shut it off.I told them not to put anymore than $400 in the repair. What we got back from Mid Shore was a boat that now would not run at all. It would start and 500-600 feet from the launch it would shut down and not start at all. The first time we picked it up he said that we needed seals and gaskets which that bill was $589. It broke down 5 minutes after taking off. After waiting for hours to get towed in we called them and [redacted] then tells me that the bowls on the carburator were bent and he could not find them so he put a gasket in them hoping that it would take care of the problem. They again supposedly tested it and said it was fine. In the mean time I found a carb with good bowls on it, bought it at the cost of $150.00 and took it to them because [redacted] said be would put it on at no charge. When we picked it up the carb was still in the box and the mechanic that was on there that day said that the bowls weren't bent and besides he didn't even know the carb was there to put on. He told us that the screw to adjust the carb was tight and he loosened it and set the timing. Again we go out to the Nanticoke and three minutes later we are broke down. I call Mid Shore and talk to Chad, he says [redacted] told him the compression was bad and the motor was shot, no good, could not be fixed. We were stuck on the river for 5 hours before we got someone to tow us in (Mid Shore made no effort to come tow us). We took the boat to another dealer and this is what we were told. The oil is leaking and mixing with the water, the seals that supposedly replaced by Mid Shore were bad and needed to be replaced. The parts to fix the motor will be $85 but the bill will be around $400 because of the labor but they guarantee the motor will run. EIGHTY FIVE DOLLARS WORTH OF PARTS IS ALL IT NEEDED... THE MOTOR IS NOT SHOT AND THE COMPRESSION IS FINE.Desired Settlement: I would like to have the cost of the supposed repair reimbursed and the cost of the carburator that I did not even need reimbursed. A total of $550.00 I only paid them $400.00 the first time we picked up the boat because that is all I told them to do.

$579.09 (not the stated $589) . Mrs. [redacted] was contacted before the parts were ordered and was given the amount that it would cost for the parts and also the

full descriptions of the parts to make sure she wanted us to order them or if she wanted to order them , if she could get them cheaper. She replied that she wanted Mid Shore to order the parts. The parts were ordered on April 26, 2014.

It was found during the initial evaluation of the engine that the compression was low, a clear indication of the age of the unit. Mid Shore replaced the carburetor flange gaskets , diaphragm kit, gasket sets, fuel filter, coil assembly and needle valve . Mid Shore installed the parts needed to complete the job and test ran the engine. Everything was running well at the time . At the time of pickup , the [redacted]'s were made aware that there was minor leakage coming from the carburetor bowl gasket due to the bowl having a minor dent. The [redacted]'s picked up the boat and received the bill. We explained the charges on the bill and made them aware of the compression levels, Mid Shore was paid $400.00 on the date of pick up and it was agreed by all parties that we would be paid the remaining $189.00 through payments weekly for up to two months .

According to the [redacted]'s and their statement , they took the boat out and it ran for 500-600 feet and shut off and could not get the engine to start . The [redacted]'s brought the boat back to Mid Shore for repair. Mr. [redacted] brought in a purchased used carburetor that Mrs. [redacted] purchased online . No one at Mid Shore Boat Sales told the [redacted]'s to purchase a carburetor on line. We would never suggest to anyone to buy a used carburetor on line due to the fact that you don't know if you are purchasing a workable item.

The fuel had a bad odor, and smelled like varnish . We came to the conclusion that the [redacted]'s had installed bad fuel in the tank . Because of the fuel issue, we took the original carburetor apart and cleaned all internal parts and again replaced the diaphragm kit, fuel filter , flange gasket, two gasket sets and adjusted the timing . We also treated the fuel in the tank , added five gallons of fresh high grade fuel and also added two stroke oil. After two days of observation , it was determined that the seals on the carburetor bowl had set and displayed no signs of leakage and the fuel had stabilized. We test ran the engine

in our shop in the morning and afternoon for three days for ten minutes each time at different RPMs with no problems and no alarms. It was also decided to take the boat to the ramp and put it in the water and run the engine at different RPM levels. We took the boat to the ramp and ran the engine for twenty minutes and experienced no problems.

When Mr. [redacted] picked up the boat and the carburetor that he purchased, but we did not use, he was told of the work performed and that he could send the carburetor that he purchased back for credit. It was discussed that even if the problem with the leakage from the carburetor bowl was not fixed , we would not install the purchased used carburetor because we could not be responsible for any problems that may arise from the used carburetor. We would only install

new ordered parts due to the fact that if there was an issue, we would be able to file a claim with the company from which the part was ordered

We also explained that we were not going to charge the [redacted]'s for the addition parts ($49.70) that were used and the six hours ($582.00) of labor that was consumed and the fuel ($19.85) by what we believe as a result of the [redacted]'s adding bad fuel into their fuel tank. We also talked with Mr. [redacted] about the times we started the engine in our shop and the time spent at the boat ramp with to apparent problems.

To be clear, neither Mr. or Mrs. [redacted] talked with our mechanic as stated in their Customer Statement. The only communication has been between Mr. [redacted] , Mrs.[redacted] , Jerry Banks (Owner, manages service and wholesales) and [redacted] (Owner, manages parts, financing , A/P , AIR and HR).

Mrs. [redacted] called and talked with [redacted] and stated they were on the Nanticoke and the engine shut off and would not start . After some discussion it was decided the engine was overheating that may result from the low compression (as stated earlier , most likely due to the age of the engine). The [redacted]'s were told to lift the engine up, let it cool down, lower the engine, apply the choke and start the engine.

In the conclusion of the Customer Statement it reads "We took the boat to another dealer and this is what we were told . The oil is leaking and mixing with the water ..." To be clear, there should not be any water anywhere in the engine nor in the tanks. Is this indicating that more bad fuel (water in the fuel) had been added to the fuel tank which then mixes with the two stroke oil causing the oil to mix with the water in the fuel? If so, this would have nothing to do with the repairs Mid Shore performed.

The [redacted]'s have stated that the desired settlement is $550.00 . A total of the amount paid ($400.00 not the billed amount of $579.09) and $150.00 that was paid for the used carburetor (that we did not advise them to purchase).

Mid Shore's reply to the desired settlement- The original bill was for $579.09 and paid only $400.00 with $189.09 to be paid within two month. Also, be it known, that the second time would have been billed at $651.05 due to the bad fuel that was used in the boat- this was not something we did and could have billed, but we decided not to bill due to our relationship with the [redacted]'s and wanting to help them out due to their limited working capital. We will credit the remaining

$189.09 that is owed from the only bill that they received. We feel this settlement is beyond fair and ethical.
