Initial Business Response /* (1000, 11, 2015/12/22) */
This is a response to case id # XXXXXXXX
I have spoken with the buyers several times, prior to them coming to Springfield to pickup the vanAfter establishing the buyer's intentions with the van, I knew they were going to be using the
spare van seatsOnce I learned the buyers needed to use the spare seats, I informed them that the seats were missing the basesI strive for satisfied customers, which is why I made the extra effort to inform the buyers about the missing seat basesI made it very clear to the buyers, that additional parts would be needed to re-install the seatsThe buyers and I established this on the phone prior to the purchase and their trip to Springfield
The buyers have acknowledged that I informed them of the extra parts required for the seats, prior their purchase of the vanThe buyers had no hesitations during the sale and never brought an issue to my attention; until several weeks after the saleThis issue led me to believe the buyers were unsatisfied with the van, only after learning the cost of the missing parts
As for the window shades, I never portrayed the van with all of the window shades and never listed the van as having every shadeThe buyers never mentioned the missing window shades as an issue, at any point during the saleI list every vehicle I sell accurately, with no intention to deceive
In closing, the van was sold "as is," which is stated clearly on the Bill of SaleThe van was sold as a handicap vanThe buyers are obviously free to customize their purchased van as they wish, but at their own costI will not be paying for any costs requested by the buyer, as they were costs incurred after the sale
The buyers have lost their EBay, PayPal, and Attorney General cases against meThese results are due to the fact that I conduct a fair and honest business; which I will continue to do
Please review the signed and initialed Bill of Sale and Attorney General case file, which I have attached to this statement

Initial Consumer Rebuttal /* (3000, 13, 2015/12/28) */
(The consumer indicated he/she DID NOT accept the response from the business.)
BUYER RESPONSE TO CLAIMS MADE BY SELLER, MID-STATE AUTOMOTIVE ON DECEMBER 22, 2015; Revdex.com CASE #XXXXXXXX
DECEMBER 28, BUYER IS CLAIMING SELLER, MID-STATE AUTOMOTIVE MISREPRESENTED THE VEHICLE THROUGH DECEPTIVE ADVERTISING
This vehicle was purchased after reviewing an Ebay ad and after several telephone conversations with the sellerPlease review the attached Ebay ad regarding the vehicle
Buyer is claiming that the seller misrepresented the vehicle through deceptive advertising in this adThe ad states, "center row captains' seats are included if you wish to convert it back" (from a wheel chair van)
In telephone conversations with the seller prior to purchasing and paying for the vehicle, the question was asked whether everything mentioned in the ad was present and includedWorded another way, it was asked if there was anything missingThe seller responded by saying that everything stated in the ad was included and in proper working condition
It was only AFTER the vehicle was paid for and we arrived in the seller's office in Springfield, Illinois, that there was a discussion about the missing seat partsWe the buyers pointed out to the seller that parts were missing on the captains' seat and that they could not be used in their present conditionWe the buyers also pointed out to the seller that two window shades were missing
The seller has presented a blatant lie when he states that he informed us about "missing seat parts"prior to us purchasing the van and prior to our arrival in SpringfieldIt should be obvious that if we had known, prior to the purchase of the vehicle, that seat parts were missing thus rendering the seats unusable, we would have requested that the seller correct the problem by replacing the missing partsThe appropriate time to have told us about missing seat parts would have been in a telephone conversation when the buyer was asking the seller whether everything mentioned in the ad was present and in good working conditionAgain, not a word about missing seat parts was mentioned
In paragraph 2, of the seller's response on December 22, 2015, another blatant lie was made by the sellerSeller states"the buyers have acknowledged that I informed them of the extra parts required for the seats prior their purchase of the van" This is completely untrueWe the buyers certainly never acknowledged that the seller informed us that we would need to replace missing parts prior to purchase of the vanAs is stated previously, upon inspection of the vehicle at the dealership, WE the buyers, told the SELLER,there were missing seat parts
Once the fact was established that there were missing parts, on July 7, 2015, in the seller's dealership, the seller stated that we, the buyers would need to contact Explorer Manufacturing Company and inquire about purchasing replacement parts
After driving the vehicle back to our residence in Idaho, we contacted Explorer Manufacturing CoWe were told that it would cost $including shipping fees to replace the missing partsThis included two missing window shades
In answer to seller's assertion that "the buyers have lost their Ebay, Paypal, and Attorney General cases against me", our response is WE DID NOT LOSE ANY CASEThere was No case established with Ebay and Paypal because these companies deal only with vehicle mechanical or parts misrepresentations under their VEHICLE PURCHASE PROTECTION PROGRAM (VPP)Our claim was vehicle misrepresentation through deceptive advertisingWE WERE NOT ELIGIBLE FOR ANY PROTECTION
The Attorney General only acts as a mediatorThe Attorney General advised us to take the seller to small claims courtPlease see attached letters
In conclusion, it would have been appropriate to refuse the completion of the sale once we arrived at the business place of Mid-State Automotive, in Springfield, IllinoisThe vehicle was completely paid for, so it would have been difficult to settle this matter without going to court
The buyers hope that by bringing this matter to the attention of the Revdex.com, it will serve as a warning to others who want to buy a vehicle sight unseen: do not pay for a vehicle in full or sign a bill of sale without personally viewing the vehicleIt is the buyers' suggestion to not deal with Mid-State Automotive or with the sellerIt is our opinion that he is dishonest and deceiptful
