Faulty instalation of Upper ball joint and forgot grease fitting on tie rod end REFUSE to resolve
Was out of state in NOV 2021 driving my 04 Dodge truck experienced floating and banging (classic Upper ball joints) I was 300 miles away from home and had no other option than to go to Midas 614 location. They diagnosed the issue with upper ball joints and tie rod play. After the job was done we proceeded on our 300 mile trek home. The vehicle began to increasingly become unstable floating on the road. We were forced to continue as we were closer to home than the Midas 614 shop Middletown OH.

Since there is NO MIDAS franchise location within 90 plus miles of us we were forced to got to our local mechanic we trust.

I contacted my local mechanic shop soon after for an evaluation (assuming it must be something else since I just had the work done ($900 worth upper ball joints) This shop video taped the excessive amount of play in the MIDAS installed upper ball joints as well as a missing grease fitting on the tie rod. They recommended that I take the truck to a front end specialist to be repaired as this was a " negligence of installation issue"

We did and they replaced the upper ball joints and charged us for the job.

We contacted "Kevin" manger of the MIDAS 614 Middletown Auto Center, LTD Roosevelt Ave, Middletown, OH and explained everything as above.

He refused to compensate us for the replacement upper ball joint job for 2 reasons

1. He claims the invoice we provided does not say that we had an upper ball joint job re done ( It absolutely does).

2. That because we did not take the vehicle to a MIDAS franchise there is NO warranty.

3. We are only asking the shop be responsible for their failed workmanship as PROVED by our follow up shops work. This is far less than MIDAS charged us for the faulty work they did.

We contacted MULTIPLE TIMES (they failed to respond back for over 3 months) TBC Corp. which governs the MIDAS franchise in hopes we could get a rep to actually read our invoice correctly and resolve the issue by simply contacting the mngr "Kevin" and READ the damn line that clearly shows the UPPER BALL JOINTS were RESEMBLED and the line that shows we were charged the $300 plus dollars for the parts and a portion of labor (the shop included other labor as a total). All they did is regurgitate what the manger said already

We also asked them to consider this ridiculous claim that because we would not TOW the vehicle over 90 miles to the nearest MIDAS franchise it's not covered. they refused 2 times on this issue

We will NOT accept this BS and the idea that this mngr thinks he can IGNORE what 2 shops put in writing and one shop charged us to redo his shops faulty work as in RESEMBLE the upper ball joints.

We now have NO CHOICE but to file in claims court and WE WILL

Be warned if your out of state and don't have a local Midas where you live they will DENY all claims and you will have to SUE as we are.

We are more than happy to provide PROOF of these invoices for anyone asking

I can be reached via my FB account at Ed Beard Jr if anyone would like to see proof as I will be posting this case and talking about the willful intent to evade responsibility for faulty work from this Midas 614 location

regretfully

Ed

Initial Business Response /* (1000, 11, 2014/07/28) */
2 weeks after oil change customer returned complaing of oil leak we found a slight leak at oil filter the car was only 1 qt low on oil we repaired and toped off the customer stated car shut off after leaving but it was runniing and...

driving in our store it did have engine noise not due to low oil car has XXXXXX miles on it we explained this to the cunsumer we did not hear from them for 3 months we do not feel we are responsible for a motor with XXXXXX miles on it and we did not have an oppertunity to look into the problem
Initial Consumer Rebuttal /* (3000, 19, 2015/03/30) */
I never received any form of response, both from Midas and Revdex.com regarding this issue. I had been waiting to read from Revdex.com. The "response from Midas on 7/28/2014" according to Revdex.com did not reach me. I do not know what the response was. Please re-activate this case. Thanks

Final Business Response /* (4000, 21, 2015/03/31) */
in regards to complaint XXXXXXXX/b/[redacted] we did respond directly to the customer unfortunately there is not a lot I can do the part was tech out of warranty that being said had we been contacted we would have directed them to a midas shop and worked something out but with no old parts no phone call we cant do anything as we explained the warranty was with midas there was several in the area I cant refund without old parts we have no way of knowing what was wrong and the manufacturer would need the old bearing they wont just take our word that it was bad I am sorry but at this time there is nothing we can do
Final Consumer Response /* (4200, 23, 2015/04/08) */
(The consumer indicated he/she DID NOT accept the response from the business.)
1. Contrary to Midas' claim that I did not contact them, I sent them a U.S. Postal Certified Mail (tracking number ending with 6690) dated 3/26/2014.
2. The content of this letter was pasted above as part of my 5/4/2014 complaint to Revdex.com. Please read through it again and notice that I made reference to the estimate (R.O. #XXXXXXX of 12/30/2013)which Midas gave me.
3. In this estimate, Midas clearly stated that "this vehicle will need a new/used engine to repair".
4. Contrary to Midas' claim that the car was running, their estimate showed that the car was rendered undriveable without engine replacement.
5. Since I did not reach a workable agreement with Midas as to own their responsibility for the damage caused to my vehicle, I had to tow it out from their garage.
6. I had to leave the vehicle in my premises pending the resolution with Midas. During this period (between January 1st, 2014 and March 26th 2014), I sought a second opinion from another mechanic.
7. This was a nearby mechanic, whom I earlier (on December 28, 2013) drove this car to his workshop when I noticed a heavy oil leak in my garage. He confirmed that the oil leak was between the engine and oil filter. He refused to work on it but suggested that I return it to whoever did the oil change.
8. Later on April 2,2014, after having waited without any response from Midas, I had to tow this car to the same (second) mechanic who earlier identified the cause of the oil leak.
9. This second mechanic confirmed that the engine had been damaged and needed replacement - just as Midas had also stated that the engine needed a replacement.
10. In addition to confirming that the vehicle needed engine replacement, this second mechanic established that the cause of this damaged engine was due to the improper handling of the oil change thereby causing serious oil leak.
11. In view of the above, it is obvious that my car that I had been driving before the oil change did not breakdown abruptly due to high mileage as Midas wrongly claimed.
12. I am hereby once again seeking a refund as claimed in my earlier complaint.
