vehicle was purchased, the brake noise was not addressed as a condition of purchase. Also at the time of purchase a price was negotiated for the vehicle which included both the good and not as good points of the vehicle. As a goodwill measure when a noise was brought to our attention, the brakes were inspected again. The edges were chamfered to minimize any resonance caused by square edges hitting the rotors. Now three months after purchase we cannot renegotiate the purchase conditions of the vehicle. The brake pads have appreciable wear left on them. The noise, as much as an irritant, is in no way a safety issue. To protect both parties in a vehicle purchase, any work promised is noted as a work due bill or 'we owe'. There is no outstanding work on the vehicle pertaining to any mechanical issues. We understand the frustrations of having a vehicle that doesn't perform as expected. However we as the seller have done our due diligence in making sure the vehicle was safe to drive prior to selling. At the time of sale, a mechanical breakdown insurance policy was also offered to these customers but was declined. The purchasers accepted the vehicle in AS IS condition and the federal disclosure statement was signed agreeing this was the case. After the initial complaint about the brakes, the [redacted] were offered assistance from Middlekauff Honda. The offer was to install Toyota OEM parts with the cost of labor provided by Middlekauff Honda so the [redacted] would only have to cover the cost of the parts. We felt this was a very fair offer. The complaint alludes to labor being of no value and no sacrifice to our organization. I assure you those working on any vehicle feel they have a right to be compensated for the work they perform and that their work is valuable. We pay our technicians by the actual work they perform whether we get paid for it or not so any labor done would in fact propose a cost to our organization. We still hold the offer open for this. We received the complaint letter filed with the Revdex.com by [redacted] and would like to respond by explaining the facts as we see them. The 2008 Saab 9-7x was sold on Oct. 30,2014 by Thrifty Car Sales of Twin Falls to this customer in good faith, after having been purchased at an auction, serviced in...

our service department, as well as subleted for repairs at another local repair shop, as Saab is not our specialty. During these services, the vehicle was put through an inspection process by a certified repairman, at which time any needed repair items found were addressed and repaired including an issue with the rear air bags and the lock cylinder, as well as installing a new battery and a couple other minor repairs were also made. The inspection report shows the tire tread was marked as "ok" and not needing replaced at that time, which there were 94,142 miles on the vehicle. We should mention since the purchase in October a considerable amount of additional miles have been put on the vehicle which would put additional wear on the tires so if they are now showing cord it may be that the tires will need replaced now. When this vehicle was purchased at auction, the vehicle inspection report showed it was clear from any accidents, which the report still shows this to be the case. Please see the attached report. After being serviced and inspected, it was put on our lot for sale at a very competitive market price of $9,950. Please see the attached Retail Kelly Blue Book sheet showing this vehicle, even with over l00K miles that it has on it now, is still valued at $11,084 almost nine months after we sold it. We are not sure where the customer is getting the information that it is only worth $2000, as her letter states, but we rely on Kelly Blue Book as a professional source for retail pricing. When it came time to sell this vehicle to this particular customer, due to her derogatory credit history and limited ability to qualify for an auto loan, the only bank that would approve financing for her set the selling price at higher than market value, which is common with sub-prime lenders, as they take a higher risk in financing to customer's with challenged credit, they get a higher price to take this risk. The market price as well as the actual selling price was clearly disclosed to this customer on her purchase order. She was also explained that she was paying a higher price and a higher interest rate than others might qualify for based on her credit score, which she agreed to the price and the terms by signing all the documents and taking delivery of the vehicle. Some of these documents clearly stated that she was purchasing the vehicle "as is-no warranty" and that "the dealer assumes no responsibility for any repairs regardless of any oral statements about the vehicle", and a statement that says there are no warranties, express or implied by the seller covering the vehicle. With that being said, Middlekauff Automotive Group still agreed to make repairs to this customer's vehicle after the sale, only as a gesture of good will and not due to any obligation or fault of our own. We did these repairs at no charge to this customer and attempted to work with her in her situation even though she had accepted it in the condition it was in at purchase and then put additional miles on it and additional wear and tear on the tires and even though we were not obligated to do anything. At this time, and all these months and attempts to help her later, and after repairing all of the items we initially agreed to, as well as additional items that came up after the sale costing us well over $1000,we do not feel that there is anything else we can or need to do. The vehicle was priced fairly, her initial and subsequent concerns with the vehicle were addressed, and the vehicle was sold to her in good faith with no accidents to our knowledge. Is she not now the owner and the responsible party? We are sorry for any subsequent troubles she has had since her purchase, however we do not feel we have been dishonest or unfair to this customer in any way, nor do we feel we owe her anything further.
