First and Foremost we are not legally obligated or required to issue a refund As per the terms of the contract that both [redacted] and Adam signed, the contract states "If the event is canceled inside of days the client is responsible for the full balance due." (See page & of the first attachment) The contract was initially signed by both [redacted] and Adam on 1-25-16, not January 29th as stated in the complaint In the complaint it states that I was not fulfilling my commitment to be in contact through the planning process When a client is booked, the call schedule with that client is as follows: month call, month call, month call, and then a week call If you look at page of the first attachment, you will see a copy of a date and time tag You will see that on 12-21-I in fact made my month check in, and its noted that emails between myself and Adam occurred If you look at the next line of the same document, you will see that on 4-19-I placed the month call and left a message On May 11th I sent an email to Adam, making him aware of some serious medical issues that had recently occurred Because of those medical issues, it required us to cancel the show, as I had no work and no driving restrictions placed on me by my doctor Per the email that I sent to Adam on the 11th, I stated to him that they would be getting a refund back, as I wanted to do the right thing, it was the way I was raised, even though legally I did not have to issue a refund Also I stated to him that it would take a little bit of time for the refund to occur, I just asked for a little patience and understanding on his partOn June 28th I replied to an email that was sent from Adam In that email I stated to him that as I have stated in my previous emails, the check was sent out on the 17th of June I also stated to Adam, that if the check was lost or stolen, we have to wait weeks as per the policies of my bank, before they will cancel the check, and start to investigate the missing check I stated to him, that since the first check was not received, that due to security reasons, and due to me not wanting a second check floating around with my companies banking information, I would bring a check to the wedding on July 22nd, and personally hand it to him, so that way I knew he would have received it He was not happy about that, and did want me to do that, he wanted the money sooner(Please see the second attachment, for all emails between myself and Adam [redacted] that occurred.) In terms of the bounced check that was given to [redacted] and Adam at the wedding on July 22nd When I wrote the check out on July 21st, at the time there was over $dollars in the account, so the check should have had no issues clearing However I did forget about auto payments that would be occurring, which took the balance in the checking account below the $that the check was written out for However before I was given the chance to resolve the situation, or even talk to [redacted] and inform her of what had happened, she took it upon herself and caused a lot of major issues On Monday July 31st, for most of the day I was away from my cell phone I am on the board of directors for our county fair, and on Monday I was on the grounds helping to get things set up for the upcoming fair It was after 10pm when I got home, and there were voice mails that were left by *** The first one was left at 6:34pm, I was called a liar, there was attitude and she threatened to take me to court if I didnt call her back The second voicemail was left at 8:08pm, she was even more angry with me, even more attitude, and even more threats occurred I do have voice recordings of both messages that occurred on Monday July 31st Being that it was after 10pm, it was only courteous of me not to call that late, and actually planned on calling her on Tuesday the following day However at 9:24pm there was an email from the knot, notifying me of a negative review that was left by *** On August 1st at 9am I received and email from the Revdex.com stating there was a complaint against me from *** How is that fair to me, to receive a negative review and a complaint from the Revdex.com, when I wasn’t even given a chance to explain things to her, or even given the chance to resolve the problem? Last but not least I am not a Liar Yes I did an event on July 10th, but what [redacted] didnt know is that on July 8th when I saw my doctor, some of my restrictions were removed Now the only reason why I did the show on July 10th is because the entertainer that was supposed to cover the show, called in that morning, so in order for the show to be covered, I went against DrOrders and did the wedding, otherwise there would have been no one for the event Yes I did have the serious medical conditions that I originally reported to Adam, and no I wasnt lying It would be pretty shallow to lie about something that serious, when there was nothing to gainIn terms of a refund, that will not be occurring After the voicemail message that occurred and after speaking with my attorney, I was told to remove myself, and stick to the terms of the contract, which again state "if the event is cancelled inside of days the client is responsible for the full balance due” Also if [redacted] and Adam want to take me to court, they should be cautious since they both work in the medical field, in which they both should be well aware of Hippa Laws, and the laws established to protect patients medical records and historyOn Tuesday May 16th, I received an email from their friend whos wedding I did on July 22nd, stating how [redacted] and Adam informed her of the medical issues that I was currently experiencing If I wanted to I could place a medical malpractice lawsuit against the both of them for releasing medical information about me, without my consent and without either of them or their friend being my primary healthcare provider Also I could place a lawsuit against them for releasing confidential information without my consent as well In every email I send out, there is a legal statement that the contents of the email are confidential and are only to be viewed by the person the email was addressed to However I dont want to talk anyone to court if I dont have to(Please see page of the first attachment, and reference the emails between myself and Adam [redacted] for the legal statement) In closing legally my company did nothing wrong, and by the terms of the contract they signed is also not legally obligated or responsible to issue a refundThey made the choice to sign the contract and agree to the terms listed

Yes [redacted] and her husband were married on June 10th, and yes the event was canceled and here is why.  On the contract it states that if the event is cancelled inside of 60 days the client is responsible for the balance due.  What that means is, even though yes [redacted] and her husband were married, and yes the event still occurred, however when you define the wording, when we or anyone in the entertainment field, refer to the event being cancelled, it means that the event is taken off the books, and services are not rendered. So the event was cancelled and by the definition that was just stated, the event was taken off our books and services did not occur.As previously stated the event was cancelled due to major medical issues.  It was something that occurred unexpectedly, and something that was out of our control. Unfortunately medical issues occur.  The client was contacted 29 days prior to the event, and found another DJ to take care of them, the day after the cancellation email was sent to her husband Adam.  Again as previously stated, once the other DJ was hired, we have no legal responsibility to provide services.  Since they were able to find another DJ, their wedding still occurred, and services were provided to them, from another company.However the bottom line is this.  [redacted] and her husband reviewed the terms listed on the contract, and agreed to those terms by signing the legal document.  As previously mentioned numerous times, the contract states: "If the event is cancelled inside of 60 days, the client is responsible for the balance due."  At this current point and after all this back and forth, all [redacted] is trying to do is back out of a legal binding document that again her and husband agreed to the terms by signing it.  Since [redacted] threatened legal action in a voicemail that was recorded, our response is the same as previously stated.  We are following the terms of the legal binding contract, and since the event was cancelled inside of 60 days, and since the contract states the client is responsible for the balance due, no refund will be issued.  A contract is a contract, [redacted] and her husband agreed to the terms by signing it.  We are just following the very same terms listed on the contract that she signed.
