Midtown Green Apartments Reviews (1)

Property failed to collect correct deposit before I moved in early June 2015. Then attempted to collect same months after the fact.Moved into the facility in early June - was notified in August that I owed $700 that was moved from a rent payment ledger to a deposit ledger - and is now an outstanding balance. I had established residency - and had been living in the unit for several months before the property decided they collected the wrong deposit !!!! And are now calling my job and ignoring multiple emails advising them that the amount was not valid.Desired SettlementThe business to accept they failed to collect the correct amount following my move in - and to accept I am not responsible for a failure to collect a deposit, and pay it months after moving out Business Response Resident had a partial security deposit collected at move-in. There was a Deposit Audit performed at the community and the error was found. The resident was notified of this two months after he moved in. We asked that he pay the remaining amount due for his security deposit as soon as possible. After numerous attempts to make contact, we had no choice but to re-allocate payments to make up the difference in the amount owed. We also informed him that this was occurring stating we had given him notice of the outstanding balance two months prior with no response. The resident then had his power turned off in his apartment without making us aware. Once we found out we informed the resident of this as well. He stated he would not be turning it back on. We had the electricity put back in our name and let the resident know they were violating the lease contract by not having the electricity in their name. They said they would be moving out and paying a termination fee as well as rent for those 60 days, however no further payments were received. We charged back the electricity that was billed to us during his lease term and he moved out owing a balance. Which was sent to collections.Consumer Response The better choice for the business is to accept they failed to collect an adequate security deposit - as a result of that failure - the business lost the money they failed to collect for a security deposit. Instead the business is trying to collect money a year after failing to collect the correct deposit amount despite not being a resident of that facility. I see no evidence that the business is going to take responsibility for failing to collect the correct security deposit at the start of the lease.
