Ms *** entered into a Contract to purchase a year old home in San Antonio (for which I personally represented the Seller) on 7/16/and she was represented by another real estate Broker of her choiceThe Contract was for an "As is" condition, but after Ms ***'s professional home
inspection was completed by the INpsector of her choice, the parties (Seller and Buyer) were able to renegotiate the Contract terms (through her broker and myself) and the Sellers agreed to and completed approximately $in repairs to the homeThe renegotiation terms, just like the original Contract terms, were documented via Texas Real Estate Commission promulgated formsMs *** signed said Amendment forms with the list of agreed upon repairs on 7/23/Once the repairs were completed, Ms ***'s Mortgage company ordered the Appraisal on the home and although it did meet value, the Appraiser noted the recomendation of an Engineer to to perform an Inspection and Report on the foundation of the year old homeMs *** then caused the home to be inspected by a Licensed Texas Professional Engineer who stated that in order for him to be able to "Certify" the foundation as sound, he would require the replacement of the year old cedar posts supporting the foundationSince the Contract (promulgated by the Texas Real Estate Commission) specified that neither party was obligated to perform any "lender required repairs", the contract terminated and the home was placed back on the marketI have attached the signed Buyers Notice of Termination of Contract and the signed Release of Earnest Money (attached hereto) showing that Ms *** not only initiated and agreed to the Termination of the Contract, but that she was given her Earnest Money back in full. I can only surmise that the $"damage" that she has referred to in her complaint is the total of her $Option Fee, her Inspection Fee, her Appraisal Fee, and any other Lender Fees that she may have paid during the progress of the ContractI do not believe that the Engineers Report was part of that total because it is my understanding that her Broker agreed to pay for that himself. While I'm equally as sorry as she is that the Contract didn't culminate in a successful sale, I would remind Ms *** that these things happen in real estate sales and that she was kept informed and made informed decisions all along the way by her BrokerI would also like to remind Ms *** that at no time did I, nor her own Broker, do anything unethical and that even when she wrote me directly demanding that I convey the Engineers Report to my client, I responded very quickly and professionally and assured her that I had already done soI would be more than happy to provide the Revdex.com with evidence of same if needed, or even an Affidavit from the Seller (a Doctor in the medical field), or perhaps even one from her own Broker, if it becomes necessaryI have been practicing real estate for approximately years and I take exception to the accusation that I have acted unethicallyNO amount of commission on any transaction is worth my reputation, that's how I run my business and any one of my clients or colleagues in the industry can attest to that. One last note: the home is back under contract and the Buyer and their Agent not only reviewed the Engineers Report prior to signing a Contract, but I had the Seller amend the Sellers Disclosure to include the Report and the Buyers initialed every page of it. Again, I am sorry that Ms *** lost some of her heard earned funds on a failed real estate transaction, it happens, its never easy, and I wish it wouldn't have happened here. It is my hope that now that Ms ***'s had some time to reflect on the course of events that she may feel differently about my ethicsRespectfully,*** ** ***, PresidentWakefield, REALTORS, Inc
